सा.का.नि. 57(अ).—के न्द्रीय सरकार विद्युत अधिनियम, 2003 (2003 का 36) की धारा 176 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और धारा 83 के अनुसरण में, गोवा राज्य और संघ राज्य क्षेत्रों के लिए संयुक्त विद्युत विनियामक आयोग (वाषिक रिपोर्ट तैयार करना) नियम, 2010 का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. – (1) इन नियमों का संक्षिप्त नाम गोवा राज्य और संघ राज्य क्षेत्रों के लिए संयुक्त विद्युत विनियामक आयोग (वाषिक रिपोर्ट तैयार करना) संशोधन नियम, 2023 है।
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. गोवा राज्य और संघ राज्य क्षेत्रों के लिए संयुक्त विद्युत विनियामक आयोग (वाषिक रिपोर्ट तैयार करना) नियम, 2010 (जिसे इसके पश्चात् उक्त नियम कहा गया), आरंभिक भाग के , तीसरे पैरा में, "धारा 105 और धारा 180 की उप- धारा (2) के खंड (i)" शब्दों, अंकों तथा कोष्ठकों के स्थान पर "धारा 176 और धारा 83 के अनुसरण में" शब्द और अंक रखे जाएंगे।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. उक् त नियमों में, उक्त नियम के नियम 3 के उप-नियम (2) में,
(i) खंड (घ) के पश्चात् निम्नलिखित अन्त:स्थापित किया जाएगा, अर्थात्:-
"(घक) आपूति की औसत लागत- वसूल किए गए औसत राजस्व अंतर, और सकल तकनीकी एवं वाणिज्यिक हानियों की प्रास्थिति और इन्हें कम करने के लिए प्रस्तावित उपाय,"
(ii) खंड (छ) के पश्चात्, निम्नलिखित अन्त:स्थापित किया जाएगा, अर्थात्:-
"(ज) विद्युत अधिनियम, 2003 और उसके अधीन बनाए गए नियमों के उपबंधों के अनुपालन से किसी विचलन जिसमें लागत प्रबिबित टैरिफ के उपबंध, विद्युत अधिनियम, 2003 की धारा 65 के अधीन सहायकी प्रदान करना, खुली पहुंच, नवीकरणीय क्रय बाध्यता, विद्युत उपभोक्ताओं के अधिकार का कार्यान्वयन सम्मिलित है;
(झ) विद्युत अधिनियम, 2003 के उपबंधों के अधीन उपयुक्त सरकार द्वारा दिए गए निदेशों का अनुपालन।"

NOTIFICATION
New Delhi, the 27th January, 2023
G.S.R. 57(E).—In exercise of powers conferred by section 176 and in pursuance of section 83 of the Electricity Act, 2003 (36 of 2003), the Central Government hereby makes the following rules to amend the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Preparation of Annual Report) Rules, 2010, namely:-
1. (1) These rules may be called the Joint Electricity Regulatory Commission for the State of Goa and Union territories (Preparation of Annual Report) Amendment Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Preparation of Annual Report) Rules, 2010 (hereinafter referred to as the said Rules), in the opening portion, in the third paragraph, for the words, figures and brackets "Section 105 and clause (i) of sub-section (2) of Section 180", the words and letters "section 176 and in pursuance of section 83" shall be substituted.
3. In the said Rules, in sub-rule (2) of rule 3 of said rules,
(i) after clause (d), the following shall be inserted, namely:-
"(da) the status of average cost of supply - the average revenue realised gap, and aggregate technical and commercial losses and the steps proposed to reduce these;"
(ii) after clause (g) , the following shall be inserted, namely:-

"(h) any departure from the compliance of provisions of the Electricity Act, 2003 and rules made thereunder including provisions for cost reflective tariff, grant of subsidy under section 65 of the Electricity Act, 2003, implementation of Open Access, Renewable Purchase Obligation, rights of electricity consumers ; and (i) compliance of direction given by the Appropriate Government under provisions of the Electricity Act, 2003."
