सा.का.नि. 61(अ).—कें द्रीय सरकार, पर्यावरण (संरक्षण) नियम 1986 के नियम 5 के उपनियम (3) के साथ पठित, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 6, धारा 8 और धारा 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ई-अपशिष्ट (प्रबंधन) नियम, 2022 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ- (1) इन नियमों का संक्षिप्त नाम ई-अपशिष्ट (प्रबंधन) संशोधन नियम, 2023 है । (2) ये 1 अप्रैल, 2023 से प्रवृत्त होंगे ।
2. ई-अपशिष्ट (प्रबंधन) नियम, 2022 में –
(i) नियम 16 के उपनियम (5) में, "उत्पाद उपयोगकर्ता प्रलेखन में" शब्दों के स्थान पर "जैसे और जब कें द्रीय प्रदूषण नियंत्रण बोर्ड द्वारा अपेक्षित हो" शब्द रखे जाएंगे ।
(ii) अनसूची II में क्र. सं. 35 और उससे संबंधित प्रविष्टियों के पश्चात, निम्नलिखित क्र. सं. और प्रविष्टियाँ अंत :स्थापित की जाएगी, अर्थात्:-
"36. अनुसूची-I में यथा सूचीबद्ध, सोलर पैनल/सेल्स, सोलर फोटोवोल्टिक पैनल/सेल्स/मॉड्यूल में कै डमियम और सीसा" 37. अनुसूची-I में यथा सूचीबद्ध, चिकित्सा उपकरण (सभी प्रत्यारोपित और संक्रमित उत्पादों को छोड़कर) में सीसा ।" 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] टिप्पण : मूल नियम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i), में संख्यांक सा.का.नि. 801(अ), तारीख 2 नवम्बर, 2022 द्वारा प्रकाशित किए गए थे ।

NOTIFICATION
New Delhi, the 30th January, 2023
G.S.R. 61(E).—In exercise of powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following rules to amend the E-Waste (Management) Rules, 2022, namely: -
1. Short title and commencement. - (1) These rules may be called E-Waste (Management) Amendment Rules, 2023.
(2) They shall come into force from the 1st day of April, 2023.
2. In the E-Waste (Management) Rules, 2022, -
(i) in rule 16, in sub-rule (5), for the words ''in the product user documentation'', the words ''as and when required by the Central Pollution Control Board'' shall be substituted;
(ii) in Schedule - II, after Sl. No. 35 and entries relating thereto, the following Sl. Nos. and entries shall be inserted, namely: -
''36. Cadmium and lead in Solar panels/cells, solar Photovoltaic panels/cells/modules as listed in Schedule - I
37. Lead in Medical Devices (with the exception of all implanted and infected products) as listed in Schedule - I.''.
