का.आ. 4982(अ).—जबकि मेसर्स पावरग्रिड भडला ट्रांसमिशन लिमिटेड, जिसका पंजीकृ त कार्यालय बी-9, क़ु तुब इंस्टीट्यूशनल एरिया, कटवारिया सराय,नई दिल्ली – 110016, भारत में स्थित है, ने "चरण-II पार्ट बी के तहत राजस्थान में सौर ऊर्जा क्षेत्रों (8.1GW) से बिजली की निकासी के लिए पारेषण प्रणाली को मजबूत करने की योजना" के तहत ओवरहेड ट्रांसमिशन लाइन बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत प्राधिकृ त करने हेतु आवेदन किया है।
और जबकि, कें द्रीय विद्युत प्राधिकरण (के .वि.प्रा.), विद्युत मंत्रालय, भारत सरकार ने अपने पत्र सं. CEA-PS- 11-21(25)/1/2018-PSPA-I Division-Part (2) दिनांकित 05.11.2020 के द्वारा "चरण-II पार्ट बी के तहत राजस्थान में सौर ऊर्जा क्षेत्रों (8.1GW) से बिजली की निकासी के लिए पारेषण प्रणाली को मजबूत करने की योजना" के अंतर्गत आने वाली ओवरहेड ट्रांसमिशन लाइनों के लिए विद्युत अधिनियम की धारा 68(1) के अंतर्गत पूर्व अनुमोदन प्रदान किया था। कें द्रीय विद्युत प्राधिकरण, विद्युत मंत्रालय, भारत सरकार ने अपने राजपत्र आई डी CG-DL-E-22022022- 233673 दिनांक 30.12.2021 के माध्यम से पावरग्रिड भडला ट्रांसमिशन लिमिटेड को विद्युत अधिनियम, 2003 की धारा 164 की मंजूरी दी गई एवं वे सभी शक्तियां प्रदान की गई, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की 7242 GI/2023
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं। माननीय उच्चतम न्यायालय का आई.ए. 85618/2020 डब्ल्यू.पी. (सिविल) 2019 की संख्या 838, में आदेश दिनांक 19.04.21 के अनुसरण में, पावरग्रिड भडला ट्रांसमिशन लिमिटेड ने ट्रांसमिशन लाईन के मार्ग की मंजूरी के लिए माननीय उच्चतम न्यायालय के आदेश द्वारा नामित समिति से सम्पर्क किया था । माननीय उच्चतम न्यायालय द्वारा नामित समिति ने पत्र दिनांक 18.07.2022 के माध्यम से मौजूदा मार्ग में कु छ संशोधनों के साथ लाईन के मार्ग को मंजूरी दे दी है । तदनुसार, उक्त लाईन का लगभग 36 कि.मी.
मार्ग परिवर्तित किया गया है ।
मेसर्स पावरग्रिड भडला ट्रांसमिशन लिमिटेड (पी.बी.टी.एल.) ने स्थानीय समाचार पत्रों टाइम्स बिज़नेस (अंग्रेजी में) दिनांक 30.05.2023, राजस्थान पत्रिका(हिंदी में) दिनांक 30.05.2023, और भारत के साप्ताहिक राजपत्र दिनांक 01.07.2023 में ट्रांसमिशन योजना के लिए प्रस्तावित परिवर्तित ट्रांसमिशन मार्ग पर प्रकाशन की तारीख से 2 महीने के भीतर आम जनता की टिप्पणियों / अभ्यावेदन की मांग करते हुए नोटिस प्रकाशित किया था । इसके पश्चात, मेसर्स पावरग्रिड भडला ट्रांसमिशन लिमिटेड ने 01.09.2023 दिनांकित एक हलफनामा प्रस्तुत किया, जिसमें घोषणा की गई है कि भारत सरकार के आधिकारिक राजपत्र एवं स्थानीय समाचार पत्रों में प्रकाशन की तारीख से 2 महीने के भीतर कोई टिप्पणी / अभ्यावेदन प्राप्त नहीं हुआ था।
और अब आवेदक ने विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत "चरण-II पार्ट बी के तहत राजस्थान में सौर ऊर्जा क्षेत्रों (8.1GW) से बिजली की निकासी के लिए पारेषण प्रणाली को मजबूत करने की योजना" के तहत ट्रांसमिशन लाइन बिछाने के लिए उसे वे सभी शक्तियां प्रदान करने का अनुरोध किया है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं।
योजना के अंतर्गत निम्नलिखित ओवरहेड ट्रांसमिशन लाइन हैं:
1. फतेहगढ़-II PS – भडला-II PS 765 के .वी. डी./सी. लाईन (2nd)
उपरोक्त योजना के अंतर्गत परिवर्तित मार्ग पर ओवरहेड ट्रांसमिशन लाइन राजस्थान प्रदेश के निम्नांकित गाँवों, कस्बों और शहरों से होकर, उन पर से, उनके आसपास से और बीच से होकर गुज़रेगी। इसे भारत के राजपत्र आईडी CG- DL-E 22022022-233673 दिनांक 30.12.2021 के साथ जोड़कर पढ़ा जायगाI

अब, सावधानीपूर्वक विचार करने के पश्चात, विद्युत मंत्रालय, भारत सरकार, मेसर्स पावरग्रिड भडला ट्रांसमिशन लिमिटेड को उपरोक्त ओवरहेड पुन: परिवर्तित ट्रांसमिशन लाइन को लगाने के लिए वे सभी शक्तियां निम्नलिखित निबंधनों एवं शर्तों के साथ प्रदान करता है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं- {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण
i. यह अनुमोदन 25 वर्षों के लिए प्रदान किया जाता है।
ii. आवेदक को प्रस्तावित लाइन की स्थापना से पूर्व संबंधित प्राधिकरणों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी।
iii. आवेदक को विद्युत अधिनियम, 2003 के तहत समुचित आयोग के द्वारा तैयार किए गए ट्रांसमिशन, ओ एंड एम, ओपन एक्सेस आदि के विनियमों/संहिताओं का पालन करना होगा।
iv. आवेदक कें द्र सरकार के विद्युत निरीक्षक/मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात ही लाइन का प्रचालन करेगा।
v. यह अनुमोदन आवेदक द्वारा विद्युत अधिनियम, 2003 के प्रावधानों और उसके तहत बनाए गए नियमों की अपेक्षाओं का अनुपालन किए जाने के अध्यधीन है।
vi. मेसर्स पावरग्रिड भडला ट्रांसमिशन लिमिटेड को विद्युत निरीक्षण के समय विमानन एवं रक्षा प्राधिकरणों इत्यादि, से अपेक्षित अनुमति को प्राप्त करने के बाद, इसे कें द्रीय विद्युत प्राधिकरण को विद्युत निरीक्षण के समय प्रस्तुत करना होगा।
vii. यदि उपरोक्त ओवरहेड लाइनों का मार्ग (या उपरोक्त ओवरहेड लाइन के मार्ग का कु छ भाग) मानचित्र में चिह्नित जीआईबी संभावित क्षेत्र (या प्राथमिकता क्षेत्र) में आता है जो माननीय सुप्रीम कोर्ट के जीआईबी (ग्रेट इंडियन बस्टर्ड) मामले के संबंध में 2019 की याचिका संख्या 838, आदेश दिनांक 19.04.2021 का हिस्सा है | आवेदक को उपरोक्त ओवरहेड ट्रांसमिशन के भूमिगत होने के संबंध या बर्ड डायवर्टर लगाने के लिये , जैसा भी मामला हो, माननीय उच्चतम न्यायालय के आदेश दिनांक 19.04.2021 के निर्देशों का और माननीय उच्चतम न्यायालय द्वारा गठित तकनीकी समिति के निर्देशों का पालन करना है ।

New Delhi, the 20th November, 2023
S.O. 4982(E).—Whereas M/s Powergrid Bhadla Transmission Limited, the applicant with its registered address at B-9, Qutub Institutional Area, Katwaria Sarai, New Delhi – 110016, India has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line on modified route under "Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase-II Part-B".
And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its letter CEA-PS-11-21(25)/1/2018-PSPA-I Division-Part (2) dated 05.11.2020 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under "Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase-II Part-B". CEA, Ministry of Power, Government of India vide it's Gazette ID CG-DL-E-22022022-233673 dated 30.12.2021 has granted approval of section 164 of the Electricity Act, 2003, conferring all the powers which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained by Government or to be established or maintained by M/s Powergrid Bhadla Transmission Limited for laying above overhead line. However, in pursuance to Hon'ble Supreme court order dated 19.04.21 in IA no. 85618/2020 in WP (Civil) No. 838 of 2019, M/s Powergrid Bhadla Transmission Limited had approached to the committee nominated by Hon'ble Supreme Court order for clearance of transmission line route related to GIB (Great Indian Bustard). Thereafter, nominated Committee by Hon'ble Supreme court vide letter dated 18.07.22 has cleared4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the route of the line with some modification in existing route. Accordingly, approximately 36 km of the route of the said line has been re-routed.
M/s Powergrid Bhadla Transmission Limited has published notice for modified route of the transmission scheme in local newspapers Times Business, Jaipur edition (in English) dated 30.05.2023, Rajasthan Patrika, Barmer edition (in Hindi) dated 30.05.2023 and in Weekly Gazette of India dated 01.07.2023 for the general public to make observations/representations on the proposed transmission route within Two Months from the date of publication. Subsequently, M/s Powergrid Bhadla Transmission Limited has submitted an affidavit dated 01.09.2023 declaring that no observation/representation was received within Two Months from the date of Publication in the official gazette of Government of India.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under "Transmission system strengthening scheme for evacuation of Power from Solar energy zone in Rajasthan (8.1 GW) under Phase-II Part-B" for re-routed portion.
The following overhead line is covered under this scheme:
1. Fatehgarh II PS-Bhadla II PS 765 kV D/C line (2nd)
The approved re-routed portion of transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan State. This is to be read in conjunction with The Gazette of India ID CG-DL-E-22022022-233673 dated 30.12.2021.

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Powergrid Bhadla Transmission Limited for laying above re-routed portion overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely:
i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line.
iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003.
iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.
vi. M/s Powergrid Bhadla Transmission Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.
vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential area (or priority area) marked in the map which is part of the order of the Hon'ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB case, the applicant has to comply with the directions of the Hon'ble Supreme Court, with regard to undergrounding of the above overhead transmission line and/or fixing of bird diverters, as the case may be as per the Hon'ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon'ble Supreme Court in this regard.
