का.आ. 4988(अ).—केन्द्रीय सरकार ने, रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात्
उक्त अधिनियम कहा गया है) की धारा 20क की उपधारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण,
भाग II, खण्ड 3, उप-खण्ड (ii), तारीख 21 जुलाई, 2023 में प्रकाशित, भारत सरकार के रेल मंत्रालय (रेलवे
बोर्ड) की अधिसूचना संख्यांक का. आ. 3259 (अ), तारीख 20 जुलाई, 2023 (जिसे इसमें इसके पश्चात् उक्त
अधिसूचना कहा गया है), द्वारा
विशेष रेल परियोजना अर्थात्, ''वेस्टर्न डेडिकेटेड
फ्रेट कोरिडोर'' के निष्पादन के लिए उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को अर्जित करने के
अपने आशय की घोषणा की थी;
और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा 20क की उपधारा (4) के अधीन जनता से
आक्षेप आमंत्रित करने के लिए दैनिक समाचार पत्रों अर्थात्, ''टाईम्स आफ इंडिया'' और ''दिव्य भास्कर'' में तारीख
5 अगस्त, 2023 को प्रकाशित किया गया था;
और, विनिर्दिष्ट अवधि के भीतर उक्त अधिसूचना के संबंध में जनता से कोई आक्षेप प्राप्त नहीें हुए थे;
और, उक्त अधिनियम की धारा 20ङ की उपधारा (1) के अनुसरण में सक्षम प्राधिकारी ने अपनी रिपोर्ट
केन्द्रीय सरकार को प्रस्तुत कर दी है;

अतः अब केन्द्रीय सरकार उक्त अधिनियम की धारा 20ङ की उपधारा (1) द्वारा प्रदत्त शक्तियों का
प्रयोग करते हुए और उपधारा (2) के अनुसरण में,-
(i) सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में
विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी; और
(ii) यह घोषणा करती है कि राजपत्र में इस अधिसूचना के प्रकाशित होने पर इससे उपाबद्ध अनुसूची में
विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में आत्यंतिक रूप से निहित हो जाएगी।
विशेष रेल परियोजना अर्थात् ''वेस्टर्न डेडीकेटेड फ्रेट कोरीडोर'' के लिए संरचना
सहित या उसके बिना अर्जित की जाने वाली भूमि का विवरण।

NOTIFICATION
New Delhi, the 14th November, 2023
S.O. 4988(E).—WHEREAS by the notification of the Government of India in the Ministry of Railways (Railway Board), number S.O.3259 (E), dated 20th July, 2023 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated 21th July, 2023 (hereinafter referred to as the said notification) and {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण
issued under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for the purpose of execution of Special Railway Project, namely, "Western Dedicated Freight Corridor" in the District of Anand in the State of Gujarat;
AND WHEREAS, the substance of the said notification for inviting objections from public thereby was published in daily newspapers namely "The Times of India" and "Divya Bhaskar", dated 5th August, 2023 under sub-section (4) of section 20A of the said Act;
AND WHEREAS, no objections were received from the public in respect of the said notification within the specified period;
AND WHEREAS, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1), and in pursuance of sub-section (2), of section 20E of the said Act, the Central Government,—
(i) upon receipt of the said report of the competent authority, hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose; and
(ii) hereby declares that on publication of this notification, the lands specified in the Schedule annexed hereto shall vest absolutely upon it free from all encumbrances.
