का.आ. 5063(अ).—के न्द्रीय सरकार, कोयला धारक क्षेत्र (अर्जन और विकास) अधिनियम,1957 (1957 का 20) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 7 की उप-धारा (1) के अधीन जारी, भारत के राजपत्र, भाग II, खंड 3 उपखंड (ii), तारीख 10 मई, 2023 में प्रकाशित, भारत सरकार के कोयला मंत्रालय की अधिसूचना संख्यांक का.आ. 2152(अ), तारीख 9 मई, 2023 द्वारा से संलग्न अनुसूची में विनिर्दिष्ट 105.153 हेक्टेयर (लगभग) अथवा 259.835 एकड़ (लगभग) परिक्षेत्र की माप वाली भूमि और ऐसी भूमि के या उससे संबंधित सभी अधिकारों के अर्जन करने के अपने आशय की सूचना दी थी ;

और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 8 के अनुसरण में के न्द्रीय सरकार को अपनी रिपोर्ट दे दी है;

और, के न्द्रीय सरकार का उपयु र्क्त रिपोर्ट पर विचार करने के पश्चात् और झारखंड सरकार से परामर्श करने के पश्चात्, यह समाधान हो गया है कि इसे संलग्न अनुसूची में यथावर्णित 82.602 हेक्टेयर (लगभग) या 204.109 एकड़ (लगभग) माप वाली भूमि और ऐसी भूमि के या उससे संबंधित सभी अधिकारों का अर्जन किया जाना चाहिए;

अतः, अब, के न्द्रीय सरकार, उक्त अधिनियम की धारा 9 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करती है कि इससे संलग्न अनुसूची में विनिर्दिष्ट 82.602 हेक्टेयर (लगभग) या 204.109 एकड़ (लगभग) माप वाली भूमि और ऐसी भूमि के या उससे संबंधित सभी अधिकार अर्जित किए जाते हैं l

New Delhi, the 28th November,2023

S.O. 5063(E ).—Whereas by the notification of the Government of India in the Ministry ofCoal number S.O. 2152(E), dated the 9th May, 2023, issued under sub-section (1) of section 7 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 10th May, 2023, the Central Government gave notice of its intention to acquire the lands measuring 105.153 hectares (approximately) or 259.835 acres (approximately) and all rights in or over such lands specified in the Schedule appended to that notification;

And whereas, the competent authority in pursuance of section 8 of the said Act has made his report to the Central Government;

And whereas, the Central Government after considering the report aforesaid and after consulting the Government of Jharkhand, is satisfied that the lands measuring 82.602 hectares (approximately) or 204.109 acres (approximately) and all rights in or over such lands as described in Schedule appended hereto should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 9 of the said Act, the Central Government hereby declares that the land measuring 82.602 hectares (approximately) or 204.109 acres (approximately) and all rights in or over such lands as described in Schedule are hereby acquired.

The plan bearing number APMDC/BCM/LA-CBA/2023-24/01, dated the 27th September, 2023 of the area covered by this notification may be inspected at the office of the Deputy Commissioner/ District Collector, Giridih District, Jharkhand or at the office of the Coal Controller, Scope Minar, 5th Floor, Core-II, Laxmi Nagar, Delhi-. 110092 or at the office of the Vice Chairman and Managing Director, The Andhra Pradesh Mineral Development Corporation Limited, Corporate Office: 294/1D, 100 Feet Road, Tadigadapa to Enikepadu, Kanuru, Vijayawada – 521137, Andhra Pradesh.

H – I - J : Line starts from point 'H', passes in South direction and meets at point 'I' in village Chunjka and then passes in South-East direction and meets the common village boundary of Chunjka and Tikodih at point 'J'.

J – K – L : Line starts from point 'J', passes in South-East direction through point 'K' in Tikodih village and meets the common village boundary of Tikodih and Biswasdih at point 'L'.

L – M – N - O : Line starts from point 'L', passes in South-East direction and meets at point 'M' in Bishwasdih village and then passes in North-East direction and meets at point 'N' in Biswasdih village. Further passes in North-West direction and meets the common village boundary of Biswasdih, Budhiadih and Bhorandiha at point 'O'.

O – P – Q – R : Line starts from point 'O', passes in North direction along the common village boundary of Budhiadih and Bhorandiha villages and meets at point 'P', then passes in West direction and meets at point 'Q' and then passes in North direction and meets the common village boundary of Budhiadih and Bhorandiha at point 'R'.

R – S – T – U : Line starts from point 'R', passes in North-East direction along the common village boundary of Budhiadih and Bhorandiha villages and meets at point 'S', then passes in West direction and meets at point 'T' and then passes in East-North-East direction and meets the common village boundary of Budhiadih and Bhorandiha at point 'U'.

U – V – W – X : Line starts from point 'U', passes in North direction along the common village boundary of Budhiadih and Bhorandiha villages and meets at point 'V', then passes in South-West direction and meets at point 'W' and then passes in West direction and meets the common village boundary of Budhiadih and Bhorandiha at point 'X'.

X–Y–Z–ZA-A : Line starts from point 'X', passes in North-West direction along the common village boundary of Budhiadih and Bhorandiha villages and meets at point 'Y', then passes in North-East direction and meets the common village boundary of Budhiadih and Bhorandiha at point 'Z' and then passes in North-West direction through Budhiadih village and meets at point 'ZA' in village Budhiadih and passes in west direction and ends at point 'A' ultimately.
