.—केन्द्रीय सरकार, रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है), की धारा 20क की उपधारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में प्रकाशित भारत सरकार के रेल मत्रांलय (रेल बोर्ड) की अधिसूचना संख्या का.आ. 2563(अ), तारीख 07 जून, 2023 (जिसे इसमें इसके पष्चात उक्त अधिसूचना कहा गया है) से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को, बिहार राज्य के जिला औरंगाबाद में ईस्टर्न डेडीकेटेड फ्रेट कोरीडोर के विषेष रेल परियोजना के निष्पादन, अनुरक्षण, प्रबन्ध और प्रचालन के लिए अर्जित करने के लिए लोक प्रयोजना के लिए अर्जित करने के अपने आशय की घोषणा की थी;
उक्त अधिसूचना का सारांश, उक्त अधिनियम की धारा 20क की उपधारा (4) के अधीन दैनिक समाचार पत्रों, अर्थात दैनिक जागरण एवं प्रभात खबर (हिन्दी), तारीख 20 जून, 2023 में प्रकाशित किया गया था;
और कोई आक्षेप प्राप्त नहीं हुए और सक्षम प्राधिकारी द्वारा उन पर विचार किया गया तथा अननुज्ञात किया गया और तदानुसार आदेष पारित किया गया;
उक्त अधिनियम की धारा 20(ड) की उप-धारा (1) द्वारा प्रदा शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वाक्त प्रयोजन के लिए अर्जित की जाएगी;
और यह कि केन्द्रीय सरकार उक्त अधिनियम की धारा 20(ड) की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशित होने पर इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि अनन्य रूप से सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में निहित हो जाएगी।

ECR-HQo/CONS(CORS)/338] MINISTRY OF RAILWAYS (Railway Board) NOTIFICATION New Delhi, the 16th November, 2023 S.O. 5168(E).—Whereas, by the notification of the Government of India in the Ministry of Railways (Railway Board), notification S.O. 2563(E), dated the 07 June, 2023 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), (hereinafter referred to as the said notification) under sub section (1) of section 20(A) of the Railway Act, 1989 (24 of 1989) (hereinafter referred to as the said act), the Central Government, declared its intention to acquire the land specified in the Schedule annexed to the said notification for execution, maintenance, management and operation of the Special Railway Project Eastern Dedicated Freight Corridor in the District of Aurangabad in the State of Bihar. And, whereas, the substance of the said notification has been published in the daily local newspapers, namely, Dainik Jagran and Prabhat Khabar (Hindi), dated the 20 June, 2023 under sub-section (4) of section 20A of the said Act; And, whereas, no objections were received and the same have been considered/disallowed by the competent authority accordingly orders have been passed; And, whereas, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government. ↩

Now, therefore, upon receipt of the report of the competent authority and in exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose.
And, further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
