सा.का.नि. 877(अ).—के न्द्रीय सरकार का यह मत होने पर कि विमान प्रचालनों की सुरक्षा के लिए यह आवश्यक और व्यावहारिक है, वायुयान अधिनियम, 1934 (1934 का XXII) की धारा 9क के साथ पठित धारा 5 की उप-धारा (1) एवं उप-धारा (2) के खंड (ण) तथा (द) में प्रदत्त शक्तियों का प्रयोग करते हुए, एतदद्वारा नागर विमानन मंत्रालय (विमान प्रचालनों के रक्षोपाय के लिए ऊं चाई प्रतिबंध) नियमावली, 2015 में आगे निम्नलिखित और संशोधन करती है। 1. लघु शीर्ष और प्रारंभन- (1) इन नियमों का नाम, नागर विमानन मंत्रालय (विमान प्रचालनों के रक्षोपाय के लिए ऊं चाई प्रतिबंध) नियमावली, 2023 है।
(2) ये नियम शासकीय राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. नागर विमानन मंत्रालय (विमान प्रचालनों के रक्षोपाय के लिए ऊं चाई प्रतिबंध) नियमावली, 2015 में, नियम 9क के परन्तुक के स्थान पर, निम्नलिखित परन्तुक प्रतिस्थापित किया जाएगा, नामत: - 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "बशर्ते जिन मामलों में दिनांक 14 जनावरी, 2010 के सा.आ. 84 (अ) के अंतर्गत अनापत्ति प्रमाण-पत्र जारी किया जा चुका है, यदि उनके संबंध में भारतीय विमानपत्तन प्राधिकरण अथवा संगत रक्षा प्राधिकरणों को, इस संशोधित अधिसूचना के प्रकाशन की तारीख के नब्बे दिन के भीतर आवेदन किया जाता है, तो ऐसे अनापत्ति प्रमाणपत्र की वैधता अवधि 12 वर्ष तक के लिए बढाई जा सके गी।"

रुबीना अली, संयुक्त सचिव नोट─प्रधान नियम, दिनांक 30 सितम्बर, 2015 की अधिसूचना संख्या सा.का.नि.751(अ.) के अंतर्गत दिनांक 1 अक्तू बर, 2015 को भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में प्रकाशित किए गए थे तथा इनमें अंतिम संशोधन, दिनांक 13 सितम्बर, 2022 की सा.का.नि संख्या 702 (अ.) के अंतर्गत किया गया था।

NOTIFICATION
New Delhi, the 5th December, 2023
G.S.R 877(E).—The Central Government, being of opinion that it is necessary and expedient to do so for the safety of aircraft operations, in exercise of the powers conferred by sub-section (1) and clauses (o) and (r) of sub- section (2) of section 5, read with section 9A of the Aircraft Act, 1934 (XXII of 1934), hereby makes the following further amendments in the Ministry of Civil Aviation (Height Restrictions for Safeguarding of Aircraft Operations) Rules, 2015.
1. Short title and commencement.- (1) These rules may be called the Ministry of Civil Aviation (Height Restrictions for Safeguarding of Aircraft Operations) Second Amendment Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Ministry of Civil Aviation (Height Restrictions for Safeguarding of Aircraft Operations) Rules, 2015, in rule 9A for the provisos, the following proviso shall be substituted, namely:-
"Provided that where No Objection Certificate has been issued under vide number S.O.84(E), dated the 14th January, 2010 upon an application made to the Airports Authority of India or the relevant Defence Authorities, within a period of ninety days from date of publication of this amendment notification, the period of validity for such No Objection Certificate shall be extended for a period not exceeding twelve years."

Note.─ The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) dated the 1st day of October, 2015, vide notification number G.S.R.751(E), dated the 30th day of September, 2015 and was last amended vide notification GSR 702(E), dated the 13th day of September, 2022.
