का.आ. 5329(अ).—कें द्रीय सरकार का यह समाधान हो जाने पर कि लोकहित में ऐसा करना अपेक्षित है कि बैंककारी उद्योग में लगी हुई सेवाएं, जो औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की पहली अनुसूची की मद 2 के अधीन आती हैं, उक्त अधिनियम के प्रयोजनों के लिए लोक उपयोगी सेवा है;
और, के न्द्रीय सरकार ने भारत सरकार के श्रम और रोजगार मंत्रालय में भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखण्ड (ii) में प्रकाशित अधिसूचना संख्यांक का.आ. 2432(अ), तारीख 5 जून, 2023 द्वारा अंतिम रूप से, तारीख 15 जून, 2023 से छह मास तक की अवधि के लिए उक्त उद्योग को उक्त अधिनियम के प्रयोजनों के लिए, लोक उपयोगी सेवा घोषित किया था;
और कें द्रीय सरकार की यह राय है कि लोकहित में छह मास की और अवधि के लिए उक्त उद्योग की लोक उपयोगिता सेवा प्रास्थिति का विस्तार करने की अपेक्षा करता है;
अत:, अब, कें द्रीय सरकार, औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की धारा 2 के खंड (ढ) के उपखंड (vi) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बैंककारी उद्योग में लगी हुई सेवाओं को 15 दिसंबर, 2023 से छह मास की अवधि के लिए उक्त अधिनियम के प्रयोजनों हेतु लोक उपयोगी सेवा के रूप में घोषित करती है।

New Delhi, the 14th December, 2023
S.O. 5329(E).—Whereas the Central Government is satisfied that public interest so requires that the services engaged in the 'Banking', which is covered under item 2 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility service for the purposes of the said Act;
And whereas the Central Government had declared the said industry to be public utility service for the purposes of the said Act for a period of six months with effect from the 15th June, 2023 vide notification of the Government of India in the Ministry of Labour and Employment published in the gazette of India, part-II, section 3, sub-section (ii) vide number S.O. 2432 (E), dated the 5th June, 2023;
And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industry for a further period of six months;
Now, therefore, in exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government hereby declares the services engaged in the Banking industry to be a public utility service for the purposes of the said Act for a period of six months with effect from the 15th December, 2023.
