का.आ. 5366(अ).— यतः, के न्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का. आ. 465 (अ) दिनांक 26 अप्रैल, 2002 द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग-15 (नया एनएच-27) के राधनपुर से समाख्याली खंड के किमी. 140.00 से किमी 281.300 तक का भूखंड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् 'प्राधिकरण' संर्दर्भत किया गया है) को सौंपा हैं ;

और यतः, प्राधिकरण ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 14 प्रावधान के अनुसरण में, गुजरात में सामाखियाली से संतलपुर खंड के किमी 339+200 से किमी 430+100 तक एनएच-27 के पेव्ड शोल्डर सहित 6 लेन के उन्नयन के विकास के लिए 30/01/2023 (जिसे इसमें इसके पश्च्यात 'उक्त खंड' संर्दर्भत किया गया है) को मैसर्स सामाखियाली टोलवे प्राइवेट लिमिटेड का पंजीकृ त कार्यालय 11वीं मंजिल, 1101, हीरानंदानी नॉलेज पार्क , टेक्नोलॉजी स्ट्रीट, हिल साइड एवेन्यू, हीरानंदानी अस्पताल के सामने, पवई, मु ंबई, महाराष्ट्र- 400076 है (जिसे इसमें इसके पश्च्यात "रियायतग्राही" संर्दर्भत किया गया है), के पेव्ड शोल्डर सहित छह लेन मे डिजाइन, निर्माण, वित्त, प्रचालन और स्थानांतरण (डीबीएफओटी) आधार पर विकास करने हेतु 12.05.2023 (इसके बाद "उक्त करार" संर्दर्भत किया गया है) को करार किया है;

अतः अब, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और बोली की 7788 GI/2023

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नियत तारीख तक इसके बाद के संशोधन और अधिसूचना संख्या का. आ. 700 (अ) तारीख 26 मार्च 2010 का अधिक्रमण करते हुए के न्रीय सरकार, उक्त राष्ट्रीय राजमार्ग के उक्त खण्ड के निर्माण, अनुरक्षण, प्रबंध और प्रचालन में निहित व्यय, निवेशित पू ंजी पर ब्याज, युक्तियुक्त प्रत्यागम, यातायात के दबाव और प्राधिकरण तथा रियातग्राही के बीच के हुए उक्त करार की अवधि को ध्यान में रखते हुए, एतद्द्वारा यह अधिसूचित करती है कि 90.248 किमी की शुद्ध सड़क खंड लंबाई और निर्माण अवधि के दौरान 1.5184 किमी (0.15184 किमी की लंबाई वाली) की समकक्ष संरचना (60 मीटर से अधिक लंबाई के साथ) के लिए तालिका 1 के कॉलम (2) में र्निर्दष्ट आधार दर के 75% पर शुल्क लगाया और एकत्र किया जाएगा और 90.683 किमी की शुद्ध सड़क खंड लंबाई और चार या अधिक लेन खंडों के उपयोग के लिए छह लेन के पूरा होने के बाद 2.1684 किमी की लंबाई (0.21684 किमी की लंबाई वाली) के बराबर संरचना (60 मीटर से अधिक लंबाई के साथ) के लिए तालिका 1 के कॉलम (2) में र्निर्दष्ट आधार दर पर नीचे दी गई तालिका 1 के कॉलम (1) में र्निर्दष्ट वाहनों के प्रकार पर और उक्त रियायतग्राही को प्राधिकरण से वाणिज्यिक संचालन (सीओडी) की तारीख या इस अधिसूचना के राजपत्र में प्रकाशन पर, जो भी बाद में हो, करार में यथाविर्निर्दष्ट समापन की तारीख तक उक्त शुल्क को संग्रहीत और प्रतिधारित करने हेतु प्राधिकृ त करती हैं;

1. नीचे लिया जाने वाला एवं संग्रहीत किया जाने वाला शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा (प्लाजाओं) के लिए उल्लिखित सड़क की निवल लम्बाई हेतु देय और भुगतान होगाः

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित बुनियादी ढांचों , जिनकी लम्बाई 60 मीटर से अधिक है, के उपयोग के लिए ऐसी बुनियादी ढांचों की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिर्वर्तत करते हुए,3 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण निम्नलिखित शुल्क प्लाजा (प्लाजाओं) पर, निम्नलिखित शुल्क भी उपरोक्त सारणी 1 में उल्लिखित आधार दर पर शोध्य और संदेय होगा:

^60 मी से अधिक लंबाई की संरचनाओं का ब्यौरा निम्नलिखित है :

3. पूरा होने की निर्धारित तिथि (नियत तिथि से 730 दिन) और परियोजना के वास्तविक पूरा होने की तारीख के बीच विलंबित अवधि के लिए कोई प्रयोक्ता शुल्क नहीं लगाया जाएगा, यदि इसमें देरी होती है। इस नियम के प्रयोजनों के लिए, परियोजना के किसी भी अनंतिम समापन को परियोजना के पूरा होने के रूप में नहीं माना जाएगा। 4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता/रहती हो, उसके लिए वर्ष 2023-24 के लिए मासिक पास की दर 330.00 रूपए (तीन सौ तीस रूपये मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा। 5 . राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

6. जिस जिले में शुल्क प्लाजा स्थित है उसमें पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई र्सर्वस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो।

7. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसे शुल्क प्लाजा पार करने के लिए राष्ट्रीय राजमार्ग का उपयोग करने की अनुमति नहीं दी जाएगी जब तक कि ऐसे यांत्रिक वाहन से अतिरिक्त भार हटा नहीं दिया जाता है। यांत्रिक वाहन के चालक अथवा मालिक अथवा प्रभारी व्यक्ति को अपनी श्रेणी के लिए र्निर्दष्ट अनुमेय भार से अधिक लोड के लिए ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को उक्त नियमों में लागू प्रावधान के बराबर शुल्क का भुगतान करना होगा। 8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।

9. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और छू ट की गणना प्राधिकरण द्वारा की जायेगी। उसे प्राधिकरण द्वारा रियायतग्राही के माध्यम से अंग्रेजी और स्थानीय भाषा के कम-से-कम एक समाचार पत्र में प्रकाशित करवाया जाएगा और तत्पश्चात उक् त नियमों के नियम 5 के अनुसार उसमें र्वार्षक तौर पर संशोधन किया जाएगा और प्रकाशित किया जाएगा; हालाँकि, बशते कि ऐसा संशोधन शुल्क के पूर्ववर्ती संशोधन की तारीख से 6 (छह) महीने की अवधि तक प्रभावी नहीं होगा।

NOTIFICATION

New Delhi, the 18th December, 2023

S.O. 5366(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways, number S.O. 465(E) dated 26th April, 2002, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from Km. 140.00 to Km. 281.300 of Radhanpur to Samakhyali Section of NH-15 (New NH-27) in the State of GUJRAT to the National Highways Authority of India (hereinafter referred to as the "Authority");

And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement on 12/05/2023 (here in after referred to as "said agreement") with M/s. Samakhiyali Tollway Private Limited having its registered office 11th floor, 1101, Hiranandani Knowledge Park, Technology Street, Hill Side Avenue, Opp. Hiranandani Hospital, Powai, Mumbai, Maharashtra-400076) (hereinafter referred to as the "Concessionaire"), the successful bidder for bids submitted on 30/01/2023 for the development of Upgradation to 6 Lane with paved Shoulder of NH-27 from Samakhiyali to Santalpur section from km. 339+200 to km. 430+100 in the State of Gujarat on BOT (Toll) Mode (hereinafter referred to as the "said section") to Six Laning with Paved Shoulder) on Design, Build, Finance, Operate and Transfer (DBFOT) basis;

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules. 2008 and its subsequent amendments up to the bid due date and in the supersession of the notification bearing S.O. 700(E) dated 26th March 2010, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees at 75 % of the base rate specified in column (2) of the Table I for net road section length of 90.248 km and for equivalent structure (with length more than 60 m) length of 1.5184 Km (having length of 0.15184 Km) during construction period and at the base rate specified in column (2) of the Table I for net road section length of 90.683 km and for equivalent structure (with length more than 60 m) length of 2.1684 Km (having length of 0.21684 Km) after completion of six laning for use of four or more lane sections on the type of vehicles specified in column (1) of the Table I below and authorises the said Concessionaire to collect and retain the fee on and from the date of Commercial Operation (COD) from the Authority or publication of this Notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement. This fee notification shall be effective from the Appointed Date of the aforesaid agreement:

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza, at the base rate mentioned in Table 1 above, for the distance specified for such Fee Plaza(s), namely: -

2. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60 m at the following Fee plaza(s), by converting the length of structures into an equipment length of highway by multiplying the length of such structures by an equalisation factor of 10, at the base rate mentioned in Table 1 above: -6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

3. No user fee shall be levied for the delayed period between the scheduled date of completion (730 days from the Appointed Date) and the date of actual completion of the project, if it is delayed. For the purposes of this rule, any provisional completion of the project shall not be treated as completion of the project.

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the fee plaza is Rs. 330/- (Three Hundred Thirty Rupees) for the year 2023-24 and is subject to revision every year as per the provisions of the said rules.

5. For multiple journey on the highway section, passes shall be issued at the following rates, namely: -

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. A mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules, shall not be permitted to use the National Highway for crossing the fee plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge of a mechanical vehicle which is7 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency as per the applicable provision in the said rules.

8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee.
