का.आ. 5374(अ).—केन्द्रीय सरकार ने, रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात्‌

उक्त अधिनियम कहा गया है) की धारा 20क की उप-धारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण,

भाग 2, खण्ड 3, उप-खण्ड (ii), तारीख 22 मार्च, 2023 में प्रकाशित, भारत सरकार के रेल मंत्रालय (रेलवे बोर्ड)

की अधिसूचना संख्यांक का. आ. 1382 (अ), तारीख 21 मार्च, 2023 (जिसे इसमें इसके पश्चात्‌ उक्त अधिसूचना

कहा गया है), द्वारा पश्चिम बंगाल राज्य के पूर्व बर्धमान जिले में विशेष रेल परियोजना अर्थात्‌, ईस्टर्न डेडिकेटेड

फ्रेट कोरिडोर के निष्पादन के लिए उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को अर्जित करने के

अपने आशय की घोषणा की थी;

और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा 20क की उप-धारा (4) के अधीन जनता से

आक्षेप आमंत्रित करने के लिए दैनिक समाचार पत्रों अर्थात्‌, ''आनन्दबाजार पत्रिका'' और ''दि स््‌टेट्‌समैन'', तारीख 6

अप्रैल, 2023 को प्रकाशित किया गया था;

और, विनिर्दिष्ट अवधि के भीतर उक्त अधिसूचना के संबंध में जनता से कोई आक्षेप प्राप्त नहीें हुए थे;

और, उक्त अधिनियम की धारा 20ङ की उप-धारा (1) के अनुसरण में सक्षम प्राधिकारी ने अपनी रिपोर्ट

केन्द्रीय सरकार को प्रस्तुत कर दी है;

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब केन्द्रीय सरकार उक्त अधिनियम की धारा 20ङ की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उप-धारा (2) के अनुसरण में,-

(i) सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर यह घोषणा करती है कि उक्त अधिसूचना से

उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी; और

(ii) यह घोषणा करती है कि राजपत्र में इस अधिसूचना के प्रकाशित होने पर इससे उपाबद्ध अनुसूची

में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में आत्यंतिक रूप से निहित हो

जाएगी।

NOTIFICATION

New Delhi, the 18th December, 2023

S.O. 5374(E).—WHEREAS by the notification of the Government of India in the Ministry of Railways (Railway Board), vide number S.O.1382 (E), dated the 21th March, 2023, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 22nd March, 2023, (hereinafter referred to as the said notification) and issued under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for the purpose of execution of Special Railway Project, namely, Eastern Dedicated Freight Corridor in the District of Purba Bardhaman in the State of West Bengal;

AND WHEREAS, the substance of the said notification for inviting objections from public thereby was published in daily newspapers namely "Anandbazar Patrika" and "The Statesman", dated the 6th April, 2023 under sub-section (4) of section 20A of the said Act;

AND WHEREAS, no objections were received from the public in respect of the said notification within the specified period;

AND WHEREAS, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and in pursuance of sub-section (2) of section 20E of the said Act, the Central Government,-

(i) upon receipt of the said report of the competent authority, hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose; and

(ii) hereby declares that on publication of this notification, the lands specified in the Schedule annexed hereto shall vest absolutely upon it free from all encumbrances.

Description of the land to be acquired with or without structure for the Special Railway Project namely, the

Eastern Dedicated Freight Corridor in district Purba Bardhaman in the State of West Bengal.
