सा.क़ा.नि. 907(अ).—उत्प्रवास अधिनियम, 1983 (1983 का 31) की धारा 43 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार ने एतद् द्वारा उत्प्रवास नियम, 1983 में अतिरिक्त संशोधन करने हेतु निम्नलिखित नियम बनाए हैं जो कि निम्न अनुसार हैं :-
1. (1) इन नियमों को उत्प्रवास (संशोधन) नियम, 2023 के नाम से जाना जाएगा।
(2) सरकारी राजपत्र में प्रकाशित होने की तिथि से ही इन्हें लागू किया जायेगा
2. उत्प्रवास नियम, 1983 में, नियम 8 हेतु अनुगामी नियम को निम्नलिखित अनुसार प्रतिस्थापित किया जाएगा:-
"8. जमा राशि -
(क) अधिनियम के खंड 11 के उपखण्ड (2) के अंतर्गत पंजीकरण प्राधिकरण द्वारा सूचित किए जाने पर आवेदक इस खंड के उपखण्ड (3) के तहत जमा राशि के रूप में पचास लाख रु.की राशि बैंक गारंटी / बीमा के रूप में साढ़े आठ साल की अवधि वाली वैधता के साथ प्रदान करेगा ।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) बशर्ते कि भर्ती एजेंट के रूप में पंजीकरण करने की इच्छु क कोई भी इकाई आठ लाख रुपये की कम जमा राशि के साथ भी ऐसा कर सकती है, ऐसी इकाई को उस अवधि के दौरान, के वल 100 कामगारों की भर्ती करने की अनुमति दी जाएगी, जिसके लिए पंजीकरण प्रदान किया गया है।
(ग)इसके अलावा, निर्दिष्ट संख्या की भर्ती पूरी होने की स्थिति में, प्रमाण-पत्र की समाप्ति से पूर्व, प्रमाण-पत्र धारक को पंजीकरण प्राधिकरणद्वारा, प्रति 100 अतिरिक्त कामगारों पर आठ लाख रुपये की अतिरिक्त जमा राशि जमा करने पर, प्रमाण-पत्र की समाप्ति की तारीख तक 100 कामगारों के समूहों में अतिरिक्त कामगारों की भर्ती जारी रखने की अनुमति दी जाएगी।

NOTIFICATION
New Delhi, the 20th December, 2023
G.S.R. 907(E).—In exercise of the powers conferred by section 43 of the Emigration Act, 1983 (31 of 1983), the Central Government hereby makes the following rules further to amend the Emigration Rules, 1983, namely:-
1. (1) These rules may be called the Emigration (Amendment) Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Emigration Rules, 1983, for rule 8, the following rule shall be substituted, namely:- "8. Amount of Security
(a) The applicant, on being informed by the registering authorityunder sub-section (2) of section 11 of the Act, shall provide a bank guarantee / insurance of eight and half years' validity for an amount of Rs. Fifty Lakh as security under sub-section (3) of that section.
(b) Provided that any entity desirous of registering as recruiting agent may do so with a reduced security of rupees eight lakh also, such entity shall be permitted to recruit only 100 workers during the period for which registration is granted.
(c) Provided further, that in the event of the recruitment of specified number getting completed, before the expiry of the certificate, the holder of the certificate may be permitted by the registering authority, to continue recruitment of additional workers in tranches of 100 workers upto the date of expiry of the certificate, on furnishing additional corresponding security of rupees eight lakh per 100 additional workers."
