का.आ. 5436(अ).—जबकि मेसर्स जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड (जेएनईपीएल) (पहले मेसर्स स्प्रंग निरजारा एनर्जी प्राइवेट लिमिटेड) , जिसका पंजीकृ त कार्यालय F-9, पहली मंजिल, मनीष प्लाजा 1 प्लॉट संख्या 7, MLU सेक्टर 10 द्वारका, नई दिल्ली -110075 ने योजना "राजस्थान के बीकानेर जिले में अपनी 50 मेगावाट सौर ऊर्जा परियोजना के लिए जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड को कनेक्टिविटी प्रदान करने के लिए ट्रांसमिशन सिस्टम में शामिल समर्पित शिरोपरि ट्रांसमिशन लाइन की स्थापना" के तहत शिरोपरि ट्रांसमिशन लाइन बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत प्राधिकृ त करने हेतु आवेदन किया है।
और जबकि, कें द्रीय विद्युत प्राधिकरण (के .वि.प्रा.), विद्युत मंत्रालय, भारत सरकार ने अपने पत्र सं. 25-17/14/2023-PG दिनांकित 10.08.2023 के द्वारा योजना "राजस्थान के बीकानेर जिले में अपनी 50 मेगावाट सौर ऊर्जा परियोजना के लिए जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड को कनेक्टिविटी प्रदान करने के लिए ट्रांसमिशन सिस्टम में शामिल समर्पित शिरोपरि ट्रांसमिशन लाइन की स्थापना" के अंतर्गत आने वाली शिरोपरि ट्रांसमिशन लाइनों के लिए विद्युत अधिनियम की धारा 68(1) के अंतर्गत पूर्व अनुमोदन प्रदान किया था।
मेसर्स जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड (जेएनईपीएल) ने स्थानीय समाचार पत्रों इंडियन एक्सप्रेस (अंग्रेजी में) दिनांक 17.08.2023 तथा दैनिक भास्कर (हिंदी में) दिनांक 17.08.2023 और भारत के साप्ताहिक राजपत्र दिनांक 02.09.2023 में ट्रांसमिशन योजना के लिए प्रस्तावित ट्रांसमिशन मार्ग पर प्रकाशन की तारीख से 2 महीने के भीतर आम जनता की टिप्पणियों / अभ्यावेदन की मांग करते हुए नोटिस प्रकाशित किया था । इसके पश्चात, मेसर्स जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड (जेएनईपीएल) ने 02.11.2023 दिनांकित एक हलफनामा प्रस्तुत किया, जिसमें घोषणा 7907 GI/2023
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] की गई है कि भारत सरकार के आधिकारिक राजपत्र एवं स्थानीय समाचार पत्रों में प्रकाशन की तारीख से 2 महीने के भीतर कोई टिप्पणी / अभ्यावेदन प्राप्त नहीं हुआ था।
और अब आवेदक ने विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत योजना "राजस्थान के बीकानेर जिले में अपनी 50 मेगावाट सौर ऊर्जा परियोजना के लिए जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड को कनेक्टिविटी प्रदान करने के लिए ट्रांसमिशन सिस्टम में शामिल समर्पित शिरोपरि ट्रांसमिशन लाइन की स्थापना" के तहत ट्रांसमिशन लाइन बिछाने के लिए उसे वे सभी शक्तियां प्रदान करने का अनुरोध किया है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं। योजना के अंतर्गत निम्नलिखित शिरोपरि ट्रांसमिशन लाइन हैं:
• जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड (सौर ऊर्जा परियोजना) - बीकानेर II (आईएसटीएस) पूलिंग स्टेशन 220 KV लाइन।
उपरोक्त योजना के अंतर्गत शिरोपरि ट्रांसमिशन लाइन राजस्थान प्रदेश के निम्नांकित गाँवों,कस्बों और शहरों से होकर, उन पर से, उनके आसपास से और बीच से होकर गुज़रेगी।

अब, सावधानीपूर्वक विचार करने के पश्चात, विद्युत मंत्रालय, भारत सरकार, मेसर्स जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड (जेएनईपीएल) को उपरोक्त शिरोपरि ट्रांसमिशन लाइन को लगाने के लिए वे सभी शक्तियां निम्नलिखित निबंधनों एवं शर्तों के साथ प्रदान करता है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं:
i. यह अनुमोदन 25 वर्षों के लिए प्रदान किया जाता है।
ii. आवेदक को प्रस्तावित लाइन की स्थापना से पूर्व संबंधित प्राधिकरणों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी।
iii. आवेदक को विद्युत अधिनियम, 2003 के तहत समुचित आयोग के द्वारा तैयार किए गए ट्रांसमिशन, ओ एंड एम, ओपन एक्सेस आदि के विनियमों/संहिताओं का पालन करना होगा।
iv. आवेदक कें द्र सरकार के विद्युत निरीक्षक/मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात ही लाइन का प्रचालन करेगा।
v. यह अनुमोदन आवेदक द्वारा विद्युत अधिनियम, 2003 के प्रावधानों और उसके तहत बनाए गए नियमों की अपेक्षाओं का अनुपालन किए जाने के अध्यधीन है।
vi. मेसर्स जुनिपर निरजारा एनर्जी प्राइवेट लिमिटेड (जेएनईपीएल) को विद्युत निरीक्षण के समय विमानन एवं रक्षा प्राधिकरणों इत्यादि, से अपेक्षित अनुमति को प्राप्त करने के बाद, इसे कें द्रीय विद्युत प्राधिकरण को विद्युत निरीक्षण के समय प्रस्तुत करना होगा।
vii. यदि उपरोक्त शिरोपरि लाइनों का मार्ग (या उपरोक्त शिरोपरि लाइन के मार्ग का कु छ भाग) मानचित्र में चिह्नित जीआईबी संभावित क्षेत्र (या प्राथमिकता क्षेत्र) में आता है जो माननीय सुप्रीम कोर्ट के जीआईबी (ग्रेट इंडियन बस्टर्ड) मामले के संबंध में 2019 की याचिका संख्या 838, आदेश दिनांक 19.04.2021 का हिस्सा है | आवेदक को उपरोक्त शिरोपरि ट्रांसमिशन के भूमिगत होने के संबंध या बर्ड डायवर्टर लगाने के लिये, जैसा भी मामला हो, माननीय उच्चतम न्यायालय के आदेश दिनांक 19.04.2021 के निर्देशों का और माननीय उच्चतम न्यायालय द्वारा गठित तकनीकी समिति के निर्देशों का पालन करना है

New Delhi, the 22nd December, 2023
S.O. 5436(E).— Whereas M/s Juniper Nirjara Energy Private Limited (JNEPL)(erstwhile M/s Spring Nirjara Energy Private Limited), the applicant with its registered address at F-9, First Floor, Manish Plaza-1, Plot No. 7 MLU, Sector-10, Dwarka New Delhi-110075has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under the scheme "Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to Juniper Nirjara Energy Private Limited for its 50 MW Solar Power Project in Bikaner District of Rajasthan".
And whereas, Ministry of Power, Government of India vide its letter No. 25-17/14/2023-PG dated 10.08.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the scheme "Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to Juniper Nirjara Energy Private Limited for its 50 MW Solar Power Project in Bikaner District of Rajasthan".
M/s Juniper Nirjara Energy Private Limited had published notice for transmission scheme in local newspapers Indian Express (in English) dated 17.08.2023, Dainik Bhaskar(in Hindi) dated 17.08.2023 and in Weekly Gazette of India dated 02.09.2023 for the general public to make observations/representations on the proposed transmission route within Two Months from the date of publication. Subsequently, M/s Juniper Nirjara Energy Private Limited has submitted an affidavit dated 02.11.2023 declaring that no observation/representation was received within Two Months from the date of publication in the official gazette of Government of India.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of transmission line underthe scheme"Installation of the dedicated overhead transmission line included in the transmission system for providing connectivity to Juniper Nirjara Energy Private Limited for its 50 MW Solar Power Project in Bikaner District of Rajasthan". The following overhead transmission line is covered under this scheme:
• Juniper Nirjara Energy Private Limited (Solar Power Project) – Bikaner II (ISTS) Pooling Station 220kV line The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Juniper Nirjara Energy Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely:
i. The approval is granted for 25 years.
ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line.
iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003.
iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.

M/s Juniper Nirjara Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.
vii. In case, the route of above overhead lines (or some portion of the route of above overhead line ) falls in the GIB potential zone (or priority zone) marked in the map which is part of the order of the Hon'ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB (Great Indian Bustard) case, the applicant has to comply with the directions of the Hon'ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon'ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon'ble Supreme Court in this regard.
