सा.का.नि. 921(अ).—कीटनाशी नियम, 1971 का और संशोधन करने के लिए कीटनाशी अधिनियम, 1968 (1968 का 46) की धारा 36 की अपेक्षानुसार प्रारुप नियम, कृ षि और किसान कल्याण मंत्रालय (कृ षि और किसान कल्याण विभाग) की अधिसूचना सा.का.नि. सं. 645 (अ), तारीख 01 सितंबर, 2023 द्वारा भारत के राजपत्र, असाधारण, भाग II, खंड 3 उपखंड (i) मे उन सभी व्यक्तियों से जिनसे उनके प्रभावित होने की संभावना थी, उस तारीख से तीस दिन की कालावधि के अवसान से पूर्व जिसको राजपत्र, जिसमें उक्त अधिसूचना प्रकाशित की गई थी की प्रतियां जनता को उपलब्ध कराई गई थी, आक्षेप और सुझाव आमंत्रित करते हुए प्रकाशित किए गए थे;

उक्त अधिसूचना की प्रतियां जनता को 01 सितंबर, 2023 को उपलब्ध कर दी गई थी;

उक्त प्रारुप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर कें द्रीय सरकार ने विचार कर लिया है;

अतः, अब, के न्द्रीय सरकार उक्त अधिनियम की धारा 36 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बोर्ड के साथ परामर्श के पश्चात् कीटनाशी नियम, 1971 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-

1. (1) इन नियमों का संक्षिप्त नाम कीटनाशी (सातवां संशोधन) नियम, 2023 है ।(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे। 7980 GI/2023 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2. कीटनाशी नियम, 1971 के नियम 10 के उपनियम (3 क) के खंड (iii) में पहले परंतुक के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :- "परंतु यह और कि उसने किसी मान्यताप्राप्त बोर्ड या विश्वविद्यालय से बारहवीं या उच्चतर माध्यमिक प्रमाणपत्र परीक्षा उत्तीर्ण की हो।"

आशीष कु मार श्रीवास्तव, संयुक्त सचिव टिप्पण: मूल नियम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (1) में सा.का.नि. सं. 1650 (अ) तारीख 19 अक्तू बर, 1971 द्वारा प्रकाशित किए गए थे और उनका अंतिम संशोधन सा.का.नि. सं. 827 (अ) तारीख 8 नवंबर, 2023 द्वारा किया गया था ।

NOTIFICATION

New Delhi, the 28th December, 2023

G.S.R. 921(E).—Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 645(E), dated the 1st September, 2023, in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public;

And whereas, copies of the said notification were made available to the public on 1st day of September, 2023;

And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 36 of the said Act, the Central Government after consultation with the Board hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:-

1. (1) These rules may be called the Insecticides (Seventh Amendment) Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Insecticides Rules, 1971, in rule 10, in sub-rule (3A), in clause (iii), after the first proviso, the following proviso shall be inserted, namely:—

"Provided further that he must have passed Class 12th or Higher Secondary Certificate Examination from a recognized Board or University."
