का.आ. 5491(अ).—विधिविरुद्ध यििा-कलाप (निवारण) अधिनियम, 1967 (1967 का 37) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) को व्यष्टियों और संगमों के कतिपय विधिविरुद्ध यििा-कलापों के अधिक प्रभावी निवारण करने तथा आतंकवादी यििाकलापों से निपटने के लिए और संबद्ध विषयों का उपबन्ध करने हेतु अधिनियमित किया गया है ;
और, उक्त अधिनियम की धारा 35 की उपधारा (1) का खंड (क) और उपधारा (2), के न्रीय सरकार को उक्त अधिनियम की चौथी अनुसूची में किसी व्यष्टि के नाम को जोड़ने के लिए सशक्त करती है, यदि उसका यह विश्वास है कि वह आंतकवाद में सम्मिलित है ;
और, लखबीर सिंह उर्फ लांडा, पुत्र निरजंन सिंह और परमिंदर कौर, जिसका जन्म 24.08.1989 को हुआ है और जिसका स्थाई पता ग्राम व डाकघर हरिके , जिला तरनतारन, पंजाब है और जो इस समय एडमंटन, अल्बरटा, कनाडा मे◌ं रह रहा है, बब्बर खालसा इंटरनेशनल से संबंधित है ;

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, बब्बर खालसा इंटरनेशनल उक्त अधिनियम की पहली अनुसूची की मि संख्या एक पर आंतकवादी संगठन के रूप मे◌ं सूचीबद्ध है ;
और, उक्त लखबीर सिंह उर्फ लांडा को, सीमा पार के अभिकरण द्वारा समर्थन दिया जा रहा है, वह कन्धे पर रखकर चलाए जाने वाले राके ट नोदित ग्रनेड द्वारा मोहाली स्थित पंजाब राज्य आसूचना मुख्यालय के भवन पर आतंकवादी हमले में सम्मिलित था ;
और, उक्त लखबीर सिंह उर्फ लांडा पंजाब राज्य, भारत में आतंकवादी यििाकलापों को करने के लिए सीमा पार से परिष्कृ त विस्फोटक युक्तियों (आईईडी), शस्त्रों, उन्नत हथियारों, विस्फोटकों की विभिन्न माडयूलों को पूर्ती में सम्मिलित रहा है ;
और, उक्त लखबीर सिंह उर्फ लांडा, आतंकवादी मोड्यूलों को तैयार करने, फिरौती, हत्याओं, आईईडी लगाने, हथियारों और मादक पदाथााों की तस्करी तथा उनसे प्राप्त निधियों या आगतों का पंजाब राज्य और देश के अन्य भागों में आतंकवादी कार्यकलापों में उपयोग करने से संबन्धित आपराधिक मामलों में भी सम्मिलित रहा है ;
और, उक्त लखबीर सिंह उर्फ लांडा तथा उसके सहयोगी, लयियत हत्याएं, फिरौती तथा भारत के विभिन्न भागों में अन्य राष्ट्र विरोधी कार्यकलाप करके पंजाब राज्य में शांति, विधि तथा व्यवस्था को भंग करने के लिए षडयंत्र कर रहे हैं ;
और, उक्त लखबीर सिंह उर्फ लांडा के विरूद्ध एक बिना समाप्ति तारीख का वारंट जारी किया गया है और उक्त लखबीर सिंह उर्फ लांडा तारीख 09.06.2021 के निगरानी (लुक आउट) परिपत्र संख्या 2144306 के भी अधीन है;
और, के न्रीय सरकार का यह विश्वास है कि लखबीर सिंह उर्फ लांडा, आंतकवाद मे◌ं सम्मिलित है और लखबीर सिंह उर्फ लांडा, को उक्त अधिनियम की चौथी अनुसूची के अधीन एक आंतकवादी के रूप मे◌ं जोड़ा जाना है ;
अतः अब, के न्रीय सरकार, विधिविरुद्ध यििा-कलाप (निवारण) अधिनियम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की चौथी अनुसूची में निम्नलिखित संशोधन करती है, अर्थात्:-
विधिविरुद्ध यििा-कलाप (निवारण) अधिनियम, 1967 की चौथी अनुसूची में .ि संख्यांक 54 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित मि संख्यांक और प्रविष्टियां अंत:स्थापित की जाएंगी, अर्थात् :-
"55. लखबीर सिंह उर्फ लांडा"।

NOTIFICATION
New Delhi, the 29th December, 2023.
S.O. 5491(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith;

And whereas, clause (a) of sub-section (1) and sub-section (2) of section 35 of the said Act empowers the Central Government to add the name of an individual in the Fourth Schedule to the said Act, if it believes that he is involved in terrorism;
And whereas, Lakhbir Singh @ Landa son of Niranjan Singh and Parminder Kaur, born on 24.08.1989, having permanent residence at VPO Harike, District Tarn Taran, Punjab and presently residing in Edmonton, Alberta, Canada belongs to Babbar Khalsa International;
And whereas, Babbar Khalsa International is listed as a terrorist organisation at serial number 1 of the First Schedule to the said Act;
And whereas, the said Lakhbir Singh @ Landa backed by cross border agency was involved in the terror attack through shoulder mounted Rocket Propelled Grenade on the building of Punjab State Intelligence Headquarter at Mohali;
And whereas, the said Lakhbir Singh @ Landa has been involed in supply of Improvised Explosive Devices (IEDs), arms, sophisticated weapons, explosives from across the border to various modules for carrying out terrorist activities in the State of Punjab, India;
And whereas, the said Lakhbir Singh @ Landa has also been involved in various criminal cases related to raising of terror modules, extortion, killings, planting IEDs, smuggling of weapons and narcotics and using funds or proceeds thereof for terrorist acts in the State of Punjab and other parts of the Country;
And whereas, the said Lakhbir Singh @ Landa and his associates have been conspiring to disrupt the peace, law and order in the State of Punjab by carrying out targeted killings, extortions and other anti-national activities in different parts of India;
And whereas, an open ended warrant has been issued against the said Lakhbir Singh @ Landa and the said Lakhbir Singh @ Landa is a subject of Look Out Circular No. 2144306 dated 09.06.2021;
And whereas, the Central Government believes that Lakhbir Singh @ Landa is involved in terrorism and the said Lakhbir Singh @ Landa is to be added as a terrorist in the Fourth Schedule to the said Act;
Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following amendment in the Fourth Schedule to the said Act, namely:-
In the Unlawful Activities (Prevention) Act, 1967, in the Fourth Schedule, after serial number 54 and entries relating thereto, the following serial number and entries shall be inserted, namely:-
"55. Lakhbir Singh @ Landa".

Note : The Fourth Schedule to the Unlawful Activities (Prevention) Act, 1967 was last amended vide the notification number S.O. 709(E), dated the 17th February, 2023.
