सा.का.नि. 928(अ).—जब कि कोरिया गणराज्य, जापान और सिंगापुर (इसमें इसके पश्चात जिन्हें विषयगत देशों से संर्दर्भत किया गया है) में मूलत: उत्पादित या वहां से निर्यातित और भारत में आयातित "इलेक्ट्रोगैल्वेनाइज्ड स्टील", (इसमें इसके पश्चात जिसे विषयगत वस्तुओं के रूप में संर्दर्भत किया गया है) जो कि सीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51) (इसमें इसके पश्चात जिसे उक्त सीमाशुल्क टैरिफ अधिनियम से संर्दर्भत किया गया है) की प्रथम अनुसूची के टैरिफ शीर्षक 7209, 7210, 7211, 7212, 7225 और 7226 के अंतर्गत आती हैं, के मामले में विर्निर्दष्ट प्राधिकारी ने अधिसूचना संख्या 6/7/2021-डीजीटीआर, दिनांक 27 जुलाई, 2022 जिसे दिनांक 27 जुलाई, 2022 को भारत के राजपत्र, असाधारण के भाग ।, खंड । में प्रकाशित किया गया था, में अपने अंतिम निष्कषों में विषयगत देशों में मूलतः उत्पादित या निर्यातित विषयगत वस्तुओं के आयातों पर प्रतिपाटन शुल्क लगाने की सिफारिश की है–

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] और जब कि, विर्निर्दष्ट प्राधिकारी के उक्त अन्तिम निष्कषों के आधार पर के न्र सरकार ने भारत सरकार, वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना सं. 29/2022-सीमाशुल्क (एडीडी), जिसे दिनांक 19 अक्टूबर, 2022 के सा.का.नि. सं. 782(अ) के तहत भारत के राजपत्र, असाधारण, भाग-।।, खण्ड-3, उप-खण्ड (i) में प्रकाशित किया गया था, के माध्यम से विषयगत माल पर प्रतिपाटन शुल्क लगाया था;
और जब कि, विर्निर्दष्ट प्राधिकारी ने संशोधन अधिसूचना सं. 7/10/2023-डीजीटीआर, जिसे दिनांक 9 नवम्बर, 2023 को भारत के राजपत्र, असाधारण, भाग-।, खण्ड-। में प्रकाशित किया गया था, के अनुसार 'डोंगकु क स्टील मिल कं पनी लिमिटेड' के अपना नाम बदलने के अनुरोध पर विचार किया और निष्कर्ष निकाला है कि नाम में परिवर्तन करने के लिए उत्पादन सुविधा, विनिर्माण प्रक्रिया, अंतिम उपयोग, ग्राहक आधार या कं पनी के प्रबंधन सरीखे कारकों में कोई बदलाव नहीं किया गया है और अपने अंतिम निष्कषों में अधिसूचना सं. 6/7/2021-डीजीटीआर, दिनांक 27 जुलाई, 2022 में यह सिफारिश की है कि उत्पादक का नाम 'डोंगकु क स्टील मिल कं पनी लिमिटेड' से बदलकर 'डोंगकक कोटेड मेटल कं पनी लिमिटेड' कर दिया जाए और यह सिफारिश की है कि अधिसूचना सं. 29/2022-सीमा शुल्क (एडीडी), दिनांक 19 अक्टूबर,2022 में आवश्यक संशोधन किया जाए;
अत: अब, सीमाशुल्क टैरिफ (पाटित वस्तुओं की पहचान, उनका आकलन और प्रतिपाटन शुल्क का संग्रहण और क्षतिर्पूर्त का निर्धारण) नियमावली, 1995 के नियम 18 और 20 के साथ पठित सीमाशुल्क टैरिफ अधिनियम की धारा 9क की उपधाराओं (1) और (5) में प्रदत्त शक्तियों का प्रयोग करते हुए, के न्र सरकार, अधिसूचना सं. 7/10/2023-डीजीटीआर, दिनांक 9 नवम्बर, 2023 में विर्निर्दष्ट प्राधिकारी की सिफारिश पर विचार करने के पश्चात्, एतदद्वारा, भारत सरकार, वित्त मंत्रालय (राजस्व विभाग) की अधिसूचना सं. 29/2022–सीमाशुल्क (एडीडी) दिनांक 19 अक्टूबर, 2022, जिसे सा.का.नि. संख्या 782(अ), दिनांक 19 अक्टूबर, 2022 के तहत भारत के राजपत्र, असाधारण भाग-।।, खण्ड-3, उप-खण्ड (i) में प्रकाशित किया गया था, में निम्नलिखित संशोधन करती है, यथा:-
उक्त अधिसूचना में, तालिका में, क्रम संख्या 2 के सामने, कॉलम (6) में प्रविष्टि के लिए, निम्नलिखित प्रविष्टि को प्रतिस्थापित किया जाएगा, यथा:-

NOTIFICATION

G.S.R. 928(E).—Whereas, in the matter concerning imports of "Electrogalvanized Steel" (hereinafter referred to as the subject goods) falling under tariff heading 7209, 7210, 7211, 7212, 7225 and 7226 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff Act) originating in or exported from Korea RP, Japan and Singapore (hereinafter referred to as the subject countries) and imported into India, the designated authority in its final findings, vide notification No. 6/7/2021-DGTR, dated the 27th July, 2022, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 27th July, 2022, has recommended the imposition of anti-dumping duty on imports of the subject goods originating in, or exported from the subject countries;
And whereas, on the basis of the aforesaid final findings of the designated authority, the Central Government had imposed the anti-dumping duty on the subject goods, vide notification of the Government of India, Ministry of Finance (Department of Revenue), No. 29/2022-Customs (ADD), published in the Gazette of India, Extraordinar, Part II, Section 3, Sub-section (i), vide number G.S.R. 782(E), dated the 19th October, 2022;
And whereas, the designated authority had, vide amendment notification No. 7/10/2023-DGTR, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 9th November 2023, considered the request of 'Dongkuk Steel Mill Co. Ltd.' to change its name and concluded that there is no change in factors such as production facility, manufacturing process, end-use, customer base, or management of the company and recommended change of name of the producer from 'Dongkuk Steel Mill Co. Ltd.' to 'Dongkuk Coated Metal Co. Ltd.'in its final findings notification No. 6/7/2021-DGTR, dated the 27th July, 2022 and recommended that necessary amendment may also be carried out in Notification No. 29/2022-Customs (ADD) dated 19th October, 2022.
Now, therefore, in exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act, read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti- dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government, after considering the recommendation of the designated authority in the notification No. 7/10/2023-DGTR, dated the 9h November 2023, of the designated authority, hereby makes the following amendments in the notification of the Government of India, Ministry of Finance(Department of Revenue), No. 29/2022-Customs (ADD) dated 19th October, 2022 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 782(E), dated the 19th October, 2022, namely:-
In the said notification, in the Table, against Serial Number 2, under Column (6) for the entry, the following entry shall be substituted, namely: -
"Dongkuk Coated Metal Co. Ltd".
