—समय-समय पर यथा संषोधित विदेश व्यापार नीति, 2023 के पैरा 1.02 और 2.01 के साथ पठित, विदेश व्यापार (विकास एवं विनियमन) अधिनियम, 1992 की धारा 3 और धारा 5 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्‌द्वारा विदेष व्यापार नीति, 2023 के पैरा 2.31 में निम्नानुसार संशोधन करती है और पैरा 2.31 [I (ड.)] शामिल करती है।


I (ड.)	उपयोग की गई आईटी परिसंपत्तियां (लैपटॉप्स, डेस्कटॉप्स, मॉनिटर्स, प्रिंटर्स)- विशेष आर्थिक क्षेत्र (एसईजेड) से घरेलू प्रषुल्क क्षेत्र (डीटीए) में आयात	प्रतिबंधित	तथापि, आयात नीति निम्नलिखित शर्ताें के अधीन मुक्त होगीः 1. उपयोग की गई आईटी परिसंपत्तियों को केवल उनके डीटीए परिचालन में आगे के उपयोग के प्रयोजन से प्रतिबंधित आयातों के लिए लाइसेंस के बिना एसईजेड से डीटीए में स्थानांतरित किया जा

			सकता है, बषर्ते कि एसईजेड में कम से कम 2 वर्ष का उपयोग हो और वस्तुएं विनिर्माण की तारीख से 5 वर्ष से अधिक पुरानी न हों। 2. ऐसे मामलों में जहाँ एक इकाई एसईजेड में अपना परिचालन बंद कर रही है और डीटीए में स्थानांतरित हो रही है, एसईजेड से डीटीए में उपयोग की गई आईटी परिसंत्तियों के आयात को प्रतिबंधित आयात के लिए लाइसेंस के बिना अनुमति दी जाती है बषर्ते कि वस्तुएँ विनिर्माण की तारीख से 5 वर्ष से अधिक पुरानी न हों। तथापि, आईटी परिसंपत्तियां जो पुरानी/उपयोग की गई/ पुरानी स्थ्तिि में एसईजेड क्षेत्र में दाखिल हुयी हैं और जिनका उपयोग एसईजेड क्षेत्र में 2 वर्ष से कम समय के लिए किया गया है, उन्हें शामिल नहीं किया गया है। 3. उपरोक्त शर्त 1 एवं 2 के तहत, एसईजेड से डीटीए में आयात के लिए छूट लागू होगी, बषर्ते कि उपयोग की गई आईटी परिसंत्तियों के आयात के समय एसईजेड में किसी भी नियामक आवश्यकताओं (अर्थात, सीआरओ, डब्ल्यूपीसी, आरओएचएस) से कोई छूट नहीं ली गई थी। 4. किसी भी उपयोग की गई आईटी परिसंपत्तियों का आयात जो उपर्युक्त मानदंडों को पूरा नहीं करता, प्रतिबंधित आयात हेतु एक लाइसेंस के अध्यधीन होगा।

उपयोग की गई आईटी परिसंपत्तियों (लैपटॉप्स, डेस्कटॉप्स, मॉनिटर्स, प्रिंटर्स) की एसईजेड से डीटीए में आयात की आयात नीति को विदेष व्यापार नीति, 2023 के पैरा 2.31 के अन्तर्गत अधिसूचित किया गया है।

इसे वाणिज्य एवं उद्योग मंत्री के अनुमोदन से जारी किया जाता है।

Subject: Amendment in Para 2.31 of the Foreign Trade Policy, 2023 - reg.

S.O. 22(E)—In exercise of powers conferred by Section 3 and Section 5 of Foreign Trade (Development &Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2023, as amended from time to time, the Central Government hereby amends Para 2.31 of Foreign Trade Policy, 2023 and inserts Para 2.31 [I (e)] as under:

	Import from Special Economic Zone (SEZ) to Domestic Tariff Area(DTA)	Restricted	1. Used IT Assets may be moved from SEZ to DTA without a Licence for Restricted Imports for the purpose of further use in their DTA operations only; given that there is a minimum usage of 2 years in the SEZ area and that the goods are not older than 5 years from the date of manufacturing. 2. In cases where a unit is closing down its operations in SEZ, and re-locating to the DTA, the import of Used IT Assets from SEZ into DTA is allowed without a Licence for Restricted Imports, given that the goods are not older than 5 years from the date of manufacturing. However IT assets that have entered the SEZ area in second hand/used/old condition and have been used in the SEZ area for less than 2 years are not covered. 3. The relaxation for import from SEZ to DTA, under condition 1 & 2 above, shall be applicable given that no exemption from any regulatory requirements (i.e., CRO, WPC, RoHS) was availed at the time of import of the Used IT Assets into the SEZ. 4. Import of any Used IT Assets which do not fulfill the above-mentioned criteria shall be subject to a Licence for Restricted Import.

Effect of the Notification: Import policy of Used IT Assets (laptops, desktops, monitors, Printers) from SEZ to DTA has been notified under Para 2.31 of the Foreign Trade Policy, 2023.

This issues with the approval of Minister of Commerce & Industry.
