सा.का.नि. 14(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, खान मंत्रालय, भारतीय खान ब्यूरो, क्षेत्रीय खान नियंत्रक, उप खान नियंत्रक, वरिष्ठ सहायक खान नियंत्रक, सहायक खान नियंत्रक और सहायक खनन अभियंता (समूह 'क' और 'ख' पद) भर्ती नियम, 2019 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:--
1. संक्षिप्त नाम और प्रारभ.-(1) इन नियमों का संक्षिप्त नाम खान मंत्रालय, भारतीय खान ब्यूरो, क्षेत्रीय खान नियंत्रक, उप खान नियंत्रक, वरिष्ठ सहायक खान नियंत्रक, सहायक खान नियंत्रक और सहायक खनन अभियंता (समूह 'क' और 'ख' पद) भर्ती (संशोधन) नियम, 2023 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. खान मंत्रालय में, भारतीय खान ब्यूरो, क्षेत्रीय खान नियंत्रक, उप खान नियंत्रक, वरिष्ठ सहायक खान नियंत्रक, सहायक खान नियंत्रक और सहायक खनन अभियंता (समूह 'क' और 'ख' पद) भर्ती नियम, 2019, अनुसूची में, सहायक खान नियंत्रक के पद से संबंधित क्रम संख्या 4 के सामने, -
(क) स्तम्भ (9) में, प्रविष्टियों के स्थान पर, निम्नलिखित रखा जाएगा, अर्थात्: -
"दो वर्ष।

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] टिप्पण: सीधे भर्ती किए गए लोगों को परिवीक्षा अवधि पूरी करने के लिए सक्षम प्राधिकारी द्वारा यथा विहित, कम से कम दो सप्ताह की अवधि का आज्ञापक प्रवेश प्रशिक्षण सफलतापूर्वक पूरा करना होगा'';
(ख) स्तम्भ (11) में, -
(i) "प्रोन्नति" उप-शीर्षक के अधीन, "तीन वर्ष" शब्द के स्थान पर, "पांच वर्ष" शब्द रखे जाएंगे;
(ii) "प्रोन्नति" उप-शीर्षक और उससे संबंधित प्रविष्टियों के पश्चात और टिप्पण से पूर्व, निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा, अर्थात्: -
"टिप्पण 1: खान मंत्रालय, भारतीय खान ब्यूरो, क्षेत्रीय खान नियंत्रक, उप खान नियंत्रक, वरिष्ठ सहायक खान नियंत्रक, सहायक खान नियंत्रक और सहायक खनन अभियंता (समूह 'क' और 'ख' पद) भर्ती (संशोधन) नियम, 2023 की अधिसूचना की तारीख को नियमित आधार पर वेतन मैट्रिक्स के स्तर 7 (44900-142400 रुपये) में सहायक खनन अभियंता के फीडर पद के संबंध में पात्रता सेवा तीन वर्ष जारी रहेगी।";
(iii) "टिप्पण" को "टिप्पण 2" के रूप में संख्याकित किया जाएगा;
(iv) "टिप्पण 1" को "टिप्पण 3" के रूप में पुनः संख्याकित किया जाएगा।

संजय लोहिया, अपर सचिव टिप्पण : मूल नियमों को भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में की अधिसूचना संख्या सा.का.नि. 951(अ) तारिख 20 दिसंबर, 2019 द्वारा प्रकाशित किया गया था और तत्पश्चात में अधिसूचना संख्या सा.का.नि. 117(अ.) तारिख 15 फरवरी, 2022 की और अधिसूचना संख्या सा.का.नि. 118(अ.) 15 फरवरी, 2022 द्वारा संशोधित किया गया था।

NOTIFICATION
New Delhi, the 1st January, 2024
G.S.R. 14(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Ministry of Mines, Indian Bureau of Mines, Regional Controller of Mines, Deputy Controller of Mines, Senior Assistant Controller of Mines, Assistant Controller of Mines and Assistant Mining Engineer (Group „A" and „B" Posts) Recruitment Rules, 2019, namely:-—
1. Short title and commencement.- (1) These rules may be called the Ministry of Mines, Indian Bureau of Mines, Regional Controller of Mines, Deputy Controller of Mines, Senior Assistant Controller of Mines, Assistant Controller of Mines and Assistant Mining Engineer (Group „A" and „B" Posts) Recruitment (Amendment) Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Ministry of Mines, Indian Bureau of Mines, Regional Controller of Mines, Deputy Controller of Mines, Senior Assistant Controller of Mines, Assistant Controller of Mines and Assistant Mining Engineer (Group „A" and „B" Posts) Recruitment Rules, 2019, in the Schedule, against serial number 4 relating to the post of Assistant Controller of Mines, -
(a) in column (9), for the entries, the following shall be substituted, namely: -
"Two years.
Note: Direct recruits shall be required to successfully complete a mandatory induction training of at least two weeks duration, as prescribed by the competent authority, for completion of probation.";
(b) in column (11), -
(i) under the sub-heading "Promotion", for the words "three years", the words "five years" shall be substituted;
(ii) after sub-heading "Promotion" and the entries relating thereto and before Note, the following note shall be inserted, namely: - {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण
"Note 1: The eligibility service shall continue to be three years in respect of incumbents holding the feeder post of Assistant Mining Engineer in level 7 in the pay matrix (Rs. 44900-142400) on regular basis on the date of notification of the Ministry of Mines, Indian Bureau of Mines, Regional Controller of Mines, Deputy Controller of Mines, Senior Assistant Controller of Mines, Assistant Controller of Mines and Assistant Mining Engineer (Group „A" and „B" Posts) Recruitment (Amendment) Rules, 2023.";
(iii) the "Note" shall be numbered as "Note 2";
(iv) "Note 1" shall be renumbered as "Note 3".

Note : The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide notification number G.S.R 951(E), dated the 20th December, 2019 and subsequently amended, vide notification numbers G.S.R. 117(E), dated the 15th February, 2022 and G.S.R. 118(E), dated the 15th February, 2022.
