सा.का.नि. 22(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए खान मंत्रालय, भारतीय खान ब्यूरो, समूह 'क' और 'ख' पद (मुख्य खनन भूविज्ञानी, अधीक्षण खनन भूविज्ञानी, क्षेत्रीय खनन भूविज्ञानी, वरिष्ठ खनन भूविज्ञानी, कनिष्ठ खनन भूविज्ञानी और सहायक खनन भूविज्ञानी) भर्ती नियम, 2019 का संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्: -
1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम खान मंत्रालय, भारतीय खान ब्यूरो, समूह 'क' और 'ख' पद (मुख्य खनन भूविज्ञानी, अधीक्षण खनन भूविज्ञानी, क्षेत्रीय खनन भूविज्ञानी, वरिष्ठ खनन भूविज्ञानी, कनिष्ठ खनन भूविज्ञानी और सहायक खनन भूविज्ञानी) भर्ती (संशोधन) नियम,2023 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. खान मंत्रालय, भारतीय खान ब्यूरो, समूह 'क' और 'ख' पद (मुख्य खनन भूविज्ञानी, अधीक्षण खनन भूविज्ञानी, क्षेत्रीय खनन भूविज्ञानी, वरिष्ठ खनन भूविज्ञानी, कनिष्ठ खनन भूविज्ञानी और सहायक खनन भूविज्ञानी) भर्ती नियम, 2019 में, अनुसूची में, कनिष्ठ खनन भूविज्ञानी पद से संबंधित क्रम संख्या 5 के सामने,-

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) स्तंभ (6) में, "35 वर्ष" अंक और शब्द के स्थान पर, "35 वर्ष से अधिक नहीं" अंक और शब्द रखे जाएंगे;
(ख) स्तंभ (9) में, प्रविष्टि के स्थान पर निम्नलिखित रखे जाएंगे: -
"दो वर्ष (प्रोन्नत व्यक्तियों और सीधी भर्ती वालों के लिए) ।
टिप्पण: सीधी भर्ती वाले लोगों को परिवीक्षा पूरी करने के लिए, सक्षम प्राधिकारी द्वारा यथा विहित कम से कम दो सप्ताह की अवधि का आज्ञापक प्रवेश प्रशिक्षण सफलतापूर्वक पूरा करना होगा।";
(ग) स्तंभ (11) में, -
(i) उपशीर्षक "प्रोन्नति" के अधीन, "तीन वर्ष" शब्दों के स्थान पर, "पांच वर्ष" शब्द रखे जाएंगे;
(ii) उप-शीर्षक "प्रोन्नति" और उससे संबंधित प्रविष्टियों के पश्चात और टिप्पण से पूर्व, निम्नलिखित टिप्पण अंतः सत्यापित किया जाएगा, अर्थात्: -
"टिप्पण 1: खान मंत्रालय, भारतीय खान ब्यूरो, समूह 'क' और 'ख' पद (मुख्य खनन भूविज्ञानी, अधीक्षण खनन भूविज्ञानी, क्षेत्रीय खनन भूविज्ञानी, वरिष्ठ खनन भूविज्ञानी, कनिष्ठ खनन भूविज्ञानी और सहायक खनन भूविज्ञानी) भर्ती (संशोधन) नियम,2023 की अधिसूचना की तारीख को नियमित आधार पर वेतन मैट्रिक्स (44900-142400 रुपये) के स्तर 7 में सहायक खनन भूविज्ञानी के पोषक पद के संबंध में पात्रता सेवा तीन वर्ष जारी रहेगी।";
(iii) "टिप्पण" को "टिप्पण 2" के रूप में संख्यांकित किया जाएगा;
(iv) उप-शीर्षक "प्रतिनियुक्ति (अल्पकालिक संविदा सहित)" के अधीन, खंड (क) में, उप-खंड (ii) में, "वेतन मैट्रिक्स में या" शब्दों के पश्चात, "में चार वर्ष " शब्द रखे जाएंगे;
(v) उप-शीर्षक "प्रतिनियुक्ति (अल्पकालिक संविदा सहित)" और उससे संबंधित प्रविष्टियों के पश्चात, टिप्पण 2 में, "प्रतिनियुक्ति की अवधि" शब्दों के स्थान पर, "प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्ति की अवधि" शब्द रखे जाएंगे।

NOTIFICATION
New Delhi, the 1st January, 2024
G.S.R. 22(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Mines, Indian Bureau of Mines, Group 'A' and 'B' posts (Chief Mining Geologist, Superintending Mining Geologist, Regional Mining Geologist, Senior Mining Geologist, Junior Mining Geologist and Assistant Mining Geologist ) Recruitment Rules, 2019, namely:-—
1. Short title and commencement.—(1) These rules may be called the Ministry of Mines, Indian Bureau of Mines, Group 'A' and 'B' posts (Chief Mining Geologist, Superintending Mining Geologist, Regional Mining Geologist, Senior Mining Geologist, Junior Mining Geologist and Assistant Mining Geologist) Recruitment (Amendment) Rules, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Ministry of Mines, Indian Bureau of Mines, Group 'A' and 'B' posts (Chief Mining Geologist, Superintending Mining Geologist, Regional Mining Geologist, Senior Mining Geologist, Junior Mining Geologist and [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण
3 Assistant Mining Geologist) Recruitment Rules, 2019, in the Schedule, against serial number 5 relating to the post of Junior Mining Geologist, -
(a) in column (6), for the figures and word "35 years", the words and figures "Not exceeding 35 years" shall be substituted;
(b) in column (9), for the entry, the following shall be substituted, namely: -
"Two years (for promotees and direct recruits).
Note : Direct recruits shall be required to successfully complete a mandatory induction training of at least two weeks duration, as prescribed by the competent authority, for completion of probation.";
(c) in column (11), -
(i) under the sub-heading "Promotion", for the words "three years", the words "five years" shall be substituted;
(ii) after sub-heading "Promotion" and the entries relating thereto and before Note, the following Note shall be inserted, namely: -
"Note 1: The eligibility service shall continue to be three years in respect of incumbents holding the feeder post of Assistant Mining Geologist in level 7 in the pay matrix (Rs. 44900-142400) on regular basis on the date of notification of the Ministry of Mines, Indian Bureau of Mines, Group 'A' and 'B' posts (Chief Mining Geologist, Superintending Mining Geologist, Regional Mining Geologist, Senior Mining Geologist, Junior Mining Geologist and Assistant Mining Geologist) Recruitment (Amendment) Rules, 2023.";
(iii) the "Note" shall be numbered as "Note 2";
(iv) under the sub-heading "Deputation (including short term contract)", in clause (a), in sub-clause (ii), after the words "in the pay matrix or", the words "four years in" shall be substituted;
(v) after the sub-heading "Deputation (including short term contract)" and the entries relating thereto, in Note 2, for the words "Period of deputation", the words "The period of deputation including the period of deputation" shall be substituted.
