का.आ. 148(अ).—जबकि, केन्द्रीय सरकार ने, विधि-विरूद्ध क्रियाकलाप (निवारण) अधिनियम, 1967 (1967 का 37) की धारा 3 की उप-धारा (1) और उप-धारा (3) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तारीख 31 दिसम्बर, 2023 की अधिसूचना संख्या का.आ. 5532(अ), जो कि भारत के राजपत्र, असाधारण, भाग-II, खंड-3, उप-खंड (ii) तारीख 31 दिसम्बर, 2023 को प्रकाशित की गई थी, द्वारा उक्त अधिनियम के अधीन तहरीक-ए-हुर्रियत, जम्मू और कश्मीर को विधि-विरूद्ध संगम घोषित किया है। अतः अब, केन्द्रीय सरकार, विधि-विरूद्ध क्रियाकलाप (निवारण) अधिनियम, 1967 की धारा 42 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निदेश देती है कि, उक्त अधिनियम की धारा 7 और धारा 8 के अधीन उपरोक्त विधि-विरूद्ध संगम से सम्बन्धित, उनके द्वारा प्रयोग की जाने वाली सभी शक्तियों का प्रयोग राज्य सरकारों और संघ राज्य क्षेत्रों के प्रशासनों द्वारा भी किया जाएगा।[फा. सं. 14017/1/2024-एनआई-एमएफओ] प्रवीण वशिष्ठ, अपर सचिव 243 GI/2024 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF HOME AFFAIRS NOTIFICATION

New Delhi, the 11th January, 2024

S.O. 148(E).—Whereas, in exercise of the powers conferred by sub-section (1) and proviso to sub-section (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government declared the Tehreek-e-Hurriyat, Jammu and Kashmir (TeH), to be an unlawful association vide notification number S.O. 5532(E), dated the 31st December, 2023, published in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (ii), dated the 31st day of December, 2023.

Now, therefore, in exercise of the powers conferred by section 42 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby directs that all powers exercisable by it under section 7 and section 8 of the said Act shall also be exercised by the State Governments and the Union Territory Administration in relation to the above said unlawful association.
