का.आ. 149(अ).—जबकि, के न्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 4201 (अ), दिनांकित 11 अक्टूबर, 2021 के द्वारा महाराष्ट्र में स्थित राष्ट्रीय राजमार्ग सं. 752जी के खंड [महाराष्ट्र सरकार की बीओटी परियोजना के तहत पिंपलनेर – सतना, देवला, चांदवाड़, मनमाड, येवला, कोपरगांव से शिरडी खंड के निकट रारा-160 के जंक्शन तक को छोड़कर] को महाराष्ट्र सरकार को सुपुर्द कर दिया है;

अत: अब, राष्ट्रीय राजमार्ग फीस (दरों का निर्धारण और संग्रहण) नियम, 2008 (जो इसके आगे 'नियम' के रूप में उल्लिखित है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्र सरकार, एतदद्वारा महाराष्ट्र में राष्ट्रीय राजमार्ग सं. 752जी के नंदुरबार (कोलडे) – प्रकाशा – शाहदा – खोतिया (म.प्र./महा. राज्य सीमा) खंड के डिजाइन किमी 50.200 से किमी 98.800 (मौजूदा किमी 50.260 से 99.220 तक) तक के 8.717 किमी की निवल सड़क खंड लंबाई और 1.580 किमी (0.158 किमी लंबाई वाली) की समतुल्य कु ल संरचना लंबाई (60 मीटर से अधिक लंबाई वाली) के लिए चार और उससे अधिक लेन खंड के उपयोग के लिए के लिए तालिका 1 के कॉलम (2) में विर्निर्दष्ट दर पर और 38.901 किमी की निवल सड़क खंड लंबाई और 8.240 किमी (0.824 किमी लंबाई वाली) की समतुल्य कु ल संरचना लंबाई (60 मीटर से अधिक लंबाई वाली) के लिए पेव्ड शोल्डर सहित दो लेन के खंड के उपयोग के लिए तालिका 1 के कॉलम (2) में विर्निर्दष्ट दर के साठ प्रतिशत दर पर नीचे दी गई तालिका 1 के कॉलम (1) में विर्निर्दष्ट वाहनों के प्रकार पर फीस उदगृहीत करती है तथा भारतीय राष्ट्रीय 247GI/2024

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के संग्रहण के लिए प्राधिकृ त करती है, अर्थात्:-

1. इसके अंतर्गत उदगृहीत और संगृहीत फीस ऐसे पथकर प्लाजाओं के अंतर्गत विर्निर्दष्ट दूरी हेतु निम्नलिखित पथकर प्लाजाओं में देय और संदेय होगी:-

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिर्वर्तत करके निम्नलिखित फीस भी देय और संदेय होगी:-

^60 मीटर से अधिक की लंबाई वाले संरचनाओं (2 लेन संरचना) के ब्यौरे निम्नानुसार हैं:-

3. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2023-24 के लिए 330 रु. (तीन सौ तीस रुपए मात्र) है और राष्ट्रीय राजमार्ग फीस (दरों का निर्धारण और संग्रहण) नियम, 2008 के नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के अध्यधीन है।

4. राजमार्ग खंड पर बहुल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

5. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई र्सर्वस रोड या वैकल्पिक सड़क उपलब्ध न हों।

6. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश लिए, उक्त नियमों के नियम 10 के उप-नियम 1ए में विर्निर्दष्ट फीस के समतुल्य फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता।

7. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि पूवोक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।

8. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रर्दर्शत करनी होंगी।

9. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा। 10. इस परियोजना की प्राक्कलित पू

ंजीगत लागत 509.18 करोड़ रु. है। चू

ंकि, भूमि अधिग्रहण, सार्वजनिक जन सुविधाओं के स्थानांतरण, पेड़ों को काटने, मूल्य समायोजन, जीएसटी इत्यादि कार्यकलापों को अभी पूरा किया जाना है, इसलिए, पू ंजीगत लागत परिवर्तन के अध्यधीन है। प्राप्त प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा रिकार्ड रखा जाएगा।

NOTIFICATION

New Delhi, the 8th January, 2024

S.O. 149(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 4201 (E) dated 11th October 2021, issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the National Highways No. 752G [excluding Pimpalner – Satana, Deola, Chandvad, Manmad, Yeola, Kopargaon to junction with NH-160 near Shirdi section under BOT project of State Govt. of Maharashtra] in the State of Maharashtra to the State Government of Maharashtra.

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "said Rules"), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 8.717 km & for equivalent structure length (having length more than 60m) of 1.580 km (having total length of 0.158 Km) for use of four or more lane section and at sixty per cent of the base for net road section length of 38.901 Km & for equivalent structure length (having length more than 60m) of 8.240 km (having total length of 0.824 Km) for use of two lane with paved shoulders on the type of vehicles specified in column (1) of Table 1 below of Nandurbar (Kolde) – Prakasha – Shahada -Khetia (MP/MH State border) Section from design kilometer 50.200 to kilometer 98.800 (existing km 50.260 to km 99.220) of National Highway Number 752G in the State of Maharashtra and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the following Fee Plaza for net road length specified for such Fee Plaza:

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60 m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalisation factor of 10:-

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs. 330.00 (Rupees Three Hundred Thirty only) for the year 2023-24 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency equal to the fee specified in sub-rule 1A of rule 10 of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

10. The estimated capital cost of the project is Rupees 509.18 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, price adjustments, GST etc. are yet to be completed. The National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised.
