का.आ. 159(अ).—केन्द्रीय सरकार ने, रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 20क की उपधारा (1) के अधीन जारी, और भारत के राजपत्र, असाधारण, भाग II, खण्ड 3, उपखण्ड (ii), तारीख 25 अप्रैल, 2023 में प्रकाशित, भारत सरकार के रेल मंत्रालय (रेलवे बोर्ड) की अधिसूचना संख्यांक का. आ. 1889 (अ), तारीख 17 अप्रैल, 2023 (जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है), द्वारा उत्तर प्रदेश राज्य के प्रयागराज जिले में विशेष रेल परियोजना अर्थात्, ईस्टर्न डेडिकेटेड फ्रेट कोरिडोर के निष्पादन के प्रयोजन के लिए उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को अर्जित करने के अपने आशय की घोषणा की थी;
और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा 20क की उपधारा (4) के अधीन दैनिक समाचार पत्रों अर्थात्, ''दि टाईम्स ऑफ इण्डिया'' और ''दैनिक जागरण'' में तारीख 16 जून, 2023 को प्रकाशित किया गया था;
और, विनिर्दिष्ट अवधि के भीतर उक्त अधिसूचना के संबंध में जनता से कोई आक्षेप प्राप्त नहीें हुए थे;
और, उक्त अधिनियम की धारा 20ङ की उपधारा (1) के अनुसरण में, सक्षम प्राधिकारी ने अपनी रिपोर्ट केन्द्रीय सरकार को प्रस्तुत कर दी है;

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 20ङ की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उपधारा (2) के अनुसरण में,-
(i) सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने पर, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी; और
(ii) यह घोषणा करती है कि इस अधिसूचना के प्रकाशन पर, इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में आत्यंतिक रूप से निहित हो जाएगी। उत्तर प्रदेश राज्य के प्रयागराज जिले में विशेष रेल परियोजना अर्थात् ईस्टर्न डेडीकेटेड फ्रेट कोरीडोर के लिए संरचना सहित या उसके बिना अर्जित की जाने वाली भूमि का संक्षिप्त विवरण।

NOTIFICATION
New Delhi, the 10th January, 2024
S.O. 159(E).—WHEREAS by the notification of the Government of India in the Ministry of Railways (Railway Board), number S.O.1889 (E), dated the 17th April, 2023, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 25th April, 2023, (hereinafter referred to as the said notification) and issued under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for the purpose of execution of Special Railway Project, namely, Eastern Dedicated Freight Corridor in the District of Prayagraj in the State of Uttar Pradesh;
AND WHEREAS, the substance of the said notification was published in daily newspapers namely "The Times of India" and "Dainik Jagran", dated the 16th June, 2023 under sub-section (4) of section 20A of the said Act;
AND WHEREAS, no objections were received from the public in respect of the said notification within the specified period;

AND WHEREAS, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1), and in pursuance of sub- section (2), of section 20E of the said Act, the Central Government,-
(i) upon receipt of the said report of the competent authority, hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose; and (ii) hereby declares that on publication of this notification, the lands specified in the Schedule annexed hereto shall vest absolutely upon it free from all encumbrances.
