फा. सं. एचक्यू-16016/1/2023-ईयू-I-एचक्यू(ई).—आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18) की धारा 54 की उप-धारा (1) और (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय विशिष्ट पहचान प्राधिकरण आधार (नामांकन और अद्यतन) विनियम, 2016 को और संशोधित करने के लिए एतद्द्वारा निम्नलिखित विनियम बनाता है, नामत: :—

1. संक्षिप्त नाम और प्रारंभ.—(1) इन विनियमों को आधार (नामांकन और अद्यतन) संशोधन विनियम, 2024 कहा जाएगा।

(2) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।

2. आधार (नामांकन और अद्यतन) विनियम, 2016 (जिसे इसमें इसके पश्चात् मूल विनियम कहा गया है), के विनियम 2 में, उप-विनियम (1) में,—

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) खंड (छक) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जाएगा, नामत: :—

'(छख) ''इलेक्ट्रॉनिक रूप'' से वही अर्थ है जो सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21) में है;'; और (ख) खंड (ड) में, "या जनसांख्यिकीय सूचना या बायोमेट्रिक सूचना का अद्यतीकरण" शब्दों का लोप किया जाएगा। 3. मूल विनियमों में, विनियम 11 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत: :—

"11. नामांकन कें द्र पर सूचना को संग्रहित करना.—(1) ऑपरेटर—

(क) नामांकन चाहने वाले व्यक्ति द्वारा अनुसूची-I में दिए हुए प्रपत्र में प्रस्तुत जनसांख्यिकीय सूचना; और (ख) प्राधिकरण द्वारा जो सॉफ्टवेयर प्रदत्त या अनुमोदित किया गया है के वल उसका उपयोग करते हुए बायोमेट्रिक सूचना,

को प्रग्रहित (कैप् चर) करेगा।

(2) विनियम 10 के उप-विनियम (1) के खंड (क) में निर्दिष्ट सबूतों को साक्ष्यित करने वाले एक या अधिक दस्तावेजों की प्रस्तुति पर, ऑपरेटर—

(क) प्रत्येक ऐसे दस्तावेज की इलेक्ट्रॉनिक रूप में प्रति बनाएगा;

(ख) नामांकन चाहने वाले व्यक्ति को उप-विनियम (1) के अंर्तगत प्रग्रहित (कैप् चर) की गई सूचना और खंड (क) में निर्दिष्ट प्रति की सटीकता की पड़ताल करने का अवसर देगा और, ऐसी पड़ताल के पश्चात्, ऐसी सूचना और प्रत◌ि को सीआईडीआर को अपलोड करेगा;

(ग) ऐसे किसी दस्तावेज की भौतिक या इलेक्ट्रॉनिक रूप में प्रति को बनाएगा या संग्रहित नहीं करेगा, सिवाय—

(i) खंड (ख); या

(ii) अधिनियम के अंतर्गत किन्हीं अन्य विनियमों या प्राधिकरण द्वारा जारी किसी नीति, प्रक्रिया,

दिशानिर्देश, आदेश, कार्यप्रणाली, मानक, विनिर्देशन या अन्य दस्तावेज में अंतर्विष्ट उपबंधों, के अनुसार;

(घ) ऐसे दस्तावेज वापस करेगा; और

(ङ) नामांकन चाहने वाले व्यक्ति को ईआईडी और अन्य नामांकन विवरण से युक्त एक पावती प्रदान करेगा। (3) नामांकन प्रक्रिया के दौरान अनुसरण की जाने वाली कार्यप्रणालियाँ, प्रक्रियाएं, मानक और दिशानिर्देश, और इसे संपादित करने के लिए प्रयुक्त किए जाने वाले प्रपत्र, खाके (टेम्पलेट्स) और जांच पड़ताल सूची (चेकलिस् ट्स),ऐसी होंगी जैसी प्राधिकरण इस संबंध में विनिर्दिष्ट करे।"।

4. मूल विनियमों में, विनियम 16क के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत: :—

"16क. दस्तावेज या सूचना को अद्यतित करना.—एक आधार नंबर धारक, उसे समनुदेशित आधार नंबर के सृजतन की तारीख से 10 वर्ष की प्रत्येक अवधि के पूरा होने पर, अनुसूची-I में दिए गए ऐसे प्रपत्र जो ऐसे आधार नंबर धारक को अनुप्रयोज्य हो या3 [भाग III—खण्ड ⁴] भारत का राजपत्र : असाधारण प्राधिकरण की वेबसाइट या मोबाइल ऐप्लिके शन पर प्रावधानित ऑनलाईन प्रपत्र में, विनियम 10 में निर्दिष्ट पहचान के सबूत और पते के सबूत को साक्ष्यित करने वाले दस्तावेजों या सूचना को प्रस्तुत करके और—

(क) अधिप्रमाणन करके और ऐसे दस्तावेजों को, मूल में, एक नामांकन कें द्र पर विनियम 10 के उप-विनियम (1) के खंड (क) के अंतर्गत दस्तावेजों के प्रस्तुतिकरण के संबंध में यथा उपबंधित के समान रीति से प्रस्तुत करके ;

(ख) प्राधिकरण की वेबसाइट या मोबाइल ऐप्लिके शन पर ऐसे दस्तावेजों की प्रतियां ऐसी वेबसाइट या ऐप्लिके शन, जैसी भी स्थिति हो, पर इस प्रयोजनार्थ उपबंधित रीति में इलेक्ट्रॉनिक तरीके से अपलोड करके ;

या

(ग) उक्त सबूतों को साक्ष्यित करने वाली सूचना को, ऐसी सूचना की तैयारी या अनुरक्षण के व्यवहारी प्राधिकारियों के डेटाबेसों से, इलेक्ट्रॉनिक तरीके से अभिप्राप्त करने के लिए उसकी सहमति दे करके , कम से कम एक बार अद्यतित कर सके गा, ताकि कें द्रीय पहचान आंकड़ा निक्षेपागार में उसकी सूचना की सतत शुद्धता सुनिश्चित करने में सहायता हो :

परंतु यह कि ऐसा प्रस्तुतिकरण, इलेक्ट्रॉनिक तरीके से अपलोडिंग या इलेक्ट्रॉनिक अभिप्राप्ति प्राधिकरण द्वारा अद्यतीकरण की प्रक्रिया को संपादित करने के लिए प्रदत्त या प्राधिकृ त सॉफ्टवेयर द्वारा इसे समर्थित किए जाने के अध्यधीन होगा।"।

5. मूल विनियमों में, विनियम 19 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत: :—

"19. आधार नंबर धारक की सूचना को अद्यतन करना.—(1) कोई आधार नंबर धारक जो सीआईडीआर में उसकी सूचना को एक नामांकन कें द्र पर अद्यतित करना चाहता है, अनुसूची-I में दिए गए ऐसे प्रपत्र जो ऐसे आधार नंबर धारक को अनुप्रयोज्य हो, में आवेदन प्रस्तुत करेगा, अधिप्रमाणन करेगा और—

(क) नामांकन कें द्र पर, मूल में, सत्यापन और स्कैन करने के लिए, पहचान का सबूत और पते का सबूत साक्ष्यित करने वाले एक या अधिक दस्तावेजों और, जहां अनुप्रयोज्य हो, जन्म तिथि का सबूत या संबंध का सबूत या दोनों, जैसी भी स्थिति हो, प्रस्तुत करेगा; या

(ख) खंड (क) में निर्दिष्ट सबूतों को साक्ष्यित करने वाली सूचना को, ऐसी सूचना की तैयारी या अनुरक्षण के व्यवहारी प्राधिकारियों के डेटाबेसों से, इलेक्ट्रॉनिक तरीके से अभिप्राप्त करने के लिए उसकी सहमति देगा :

परंतु यह कि ऐसा प्रस्तुतिकरण या सूचना की इलेक्ट्रॉनिक अभिप्राप्ति ऐसे अद्यतीकरण के लिए सूचना के संग्रहण के लिए प्राधिकरण द्वारा प्रदत्त या प्राधिकृ त सॉफ्टवेयर द्वारा समर्थित किए जाने के अध्यधीन होगा।

(2) एक आधार नंबर धारक जो प्राधिकरण की वेबसाइट या मोबाइल ऐप्लिके शन का उपयोग करके सीआईडीआर में उसकी सूचना को अद्यतित करना चाहता है—

(क) ऐसी वेबसाइट या ऐप्लिके शन, जैसी भी स्थिति हो, पर ऐसी सूचना प्रस्तुत करेगा जैसी ऐसे अद्यतीकरण के लिए वहाँ प्रावधानित ऑनलाइन प्रपत्र में भरना अपेक्षित हो; और

(ख) ऐसी वेबसाइट या ऐप्लिके शन पर, उप-विनियम (1) में निर्दिष्ट सबूतों को साक्ष्यित करने वाले एक या अधिक दस्तावेजों की प्रति को इलेक्ट्ऱॉनिक रूप में अपलोड करेगा, या ऐसे सबूतों को साक्ष्यित करने वाली सूचना को ऐसी सूचना की तैयारी या अनुरक्षण के डेटाबेसों के व्यवहारी प्राधिकारियों से इलेक्ट्रॉनिक तरीके से अभिप्राप्त करने के लिए उसकी सहमति देगा :

परन्तु यह कि ऐसा अपलोड करना या इलेक्ट्रॉनिक अभिप्राप्ति ऐसे अद्यतीकरण के लिए सूचना के संग्रहण के लिए प्राधिकरण द्वारा प्रदत्त या प्राधिकृ त सॉफ्टवेयर द्वारा समर्थित किए जाने के अध्यधीन होगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (3) उप-विनियम (1) या उप-विनियम (2) में अंतर्विष्ट किसी बात के होते हुए भी, यदि आधार नंबर धारक ने पूर्व में उसके संबंध में—

(क) जन्म तिथि की सूचना एक बार;

(ख) लिंग की सूचना एक बार; या

(ग) नाम की सूचना दो बार,

अद्यतित की है तो ऐसी सूचना का अद्यतीकरण के वल ऐसी प्रक्रिया के अनुसार किया जाएगा जो प्राधिकरण विनिर्दिष्ट करे। (4) उप-विनियम (1) या उप-विनियम (2) में निर्दिष्ट सबूतों को साक्ष्यित करने के लिए जो दस्तावेज प्रस्तुत किए जा सकते हैं उनकी एक सूची अनुसूची-II में है।

(5) अद्यतीकरण की प्रक्रिया के भाग के रूप में संग्रहित सूचना का सत्यापन अनुसूची-II में विनिर्दिष्ट दस्तावेजों या उप- विनियम (1) के खंड (ख) या उप-विनियम (2) के खंड (ख) में निर्दिष्ट सबूतों को साक्ष्यित करने वाली इलेक्ट्रॉनिक सूचना के आधार पर किया जाएगा :

परन्तु यह कि—

(क) कें द्रीय सरकार या एक राज्य सरकार के किसी मंत्रालय, विभाग या एजेंसी; या

(ख) ऐसी सूचना या दस्तावेजों की तैयारी या अनुरक्षण से संबंधित किसी प्राधिकरण,

की सहायता ऐसे सत्यापन के प्रयोजनार्थ ली जा सके गी।

(6) ऑपरेटर, नामांकन कें द्र पर अद्यतीकरण के लिए सूचना संग्रहित करते समय, विनियम 11 के अंतर्गत एक नामांकन कें द्र पर नामांकन के लिए सूचना के संग्रहण के लिए अनुप्रयोज्य अपेक्षाओं का, यथायोग्य परिवर्तनों सहित, पालन करेगा। (7) नामांकन कें द्र पर अद्यतीकरण के लिए सूचना के संग्रहण की प्रक्रिया पूर्ण होने पर, ऑपरेटर आधार नंबर धारक को एक ऐसे नंबर से युक्त अभिस्वीकृ ति देगा जो उसे संग्रहित सूचना के प्रसंस्करण की स्थिति ज्ञात करने में समर्थ बनाए।"। 6. मूल विनियमों में, अध्याय-VI में, उक्त अध्याय के शीर्षक के नीचे, निम्नलिखित विनियम अंतःस्थापित किया जाएगा, नामत: :—

"26क. निर्वचन—इस अध्याय और अनुसूची-VI में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, एक आधार नंबर के संबंध में, "रद्द करना" या "लोप करना" अभिव्यक्तियों का अर्थ ऐसे आधार नंबर का लोप होना होगा, और उनके व्याकरणिक रूपभेदों और सजातीय पदों के अर्थ तदनुसार लगाए जाएंगे।''।

7. मूल विनियमों में, विनियम 28क में, "समय-समय पर" शब्दों के स्थान पर, "समय-समय पर, विदेशियों का रजिस्ट्रीकरण अधिनियम, 1939 (1939 का 16) और उसके अंतर्गत बनाए गए आदेश और दिए गए निर्देश, या विदेशियों विषयक अधिनियम, 1946 (1946 का 31) और उसके अंतर्गत बनाए गए नियम" शब्द, कोष्ठक और अंक, अंत:स्थापित किए जाएंगे।

8. मूल विनियमों में, "अनुसूची-I", "अनुसूची-II" और "अनुसूची-VI" के लिए क्रमश:, निम्नलिखित अनुसूचियाँ प्रतिस्थापित की जाएंगी, नामत : :—

"अनुसूची-I

प्रपत्र 1: आधार नामांकन और अद्यतीकरण

(क) निवासी भारतीय, या (ख) भारत में पते के सबूत वाले अनिवासी भारतीय (18 वर्ष और अधिक आयु) के लिए कृपया इस प्रपत्र के नीचे दिए गए अनुदेशों का अनुसरण करें और केवल बड़े (ब्लॉक या कैपिटल) अक्षरों का प्रयोग करें। 1 प्रयोजन : नामांकन या अद्यतीकरण

2 निवास की स्थिति : निवासी भारतीय या अनिवासी भारतीय (एनआरआई) {इस प्रपत्र के नीचे घोषणा का पैरा 1(ग) देखें}

3 जनसांख्यिकीय सूचना (अद्यतीकरण के लिए केवल अद्यतीकृत की जाने वाली सूचना ही भरें) :

* आधार नामांकन (पांच वर्ष से अधिक) के लिए स्वीकार्य सहायक दस्तावेजों की सूची में पते का सबूत के रूप में दस्तावेज लागू होंगे। नोट: उपरोक्त सारणीबद्ध ब्यौरे में सूचीबद्ध कोई भी दस्तावेज के वल तभी स्वीकार्य होगा जब वह निम्नलिखित शर्तों को पूरा करता हो, नामत : —

(क) यह वतर्मान में वैध है (जब तक कि ऊपर स्पष्ट रूप से अन्यथा प्रावधानित न किया गया हो);

(ख) जिस व्यक्ति के संबंध में ऐसा दस्तावेज जारी किया गया है वह उसका हकदार है;

(ग) यदि दस्तावेज में अंतर्विष्ट सूचना सार्वजनिक रूप से प्रदर्शित है या यूआईडीएआई को अन्यथा ऑनलाइन प्राप्य है या डिजिटल साधनों से ऑफलाइन सत्यापनीय है, तो यदि ऐसे साधनों का उपयोग किया जाता है तो सूचना सत्यापित होती है; और (घ) पहचान, पते, जन्म तिथि या संबंध को साक्ष्यित करने के लिए प्रस्तुत दस्तावेज को जारी करने वाले प्राधिकारी ने ऐसी श्रेणी के दस्तावेज के संबंध में कोई घोषणा नहीं की है कि ऐसा दस्तावेज इसका सबूत नहीं है।

महत्वपूर्ण नोट :

(क) 1.10.2023 को और इसके बाद जन्म हुए निवासी भारतीय और अनिवासी भारतीय (एनआरआई) के लिए जन्म प्रमाण-पत्र अनिवार्य है।

(ख) पांच वर्ष से कम आयु के बालकों/बालिकाओं के लिए परिवार के मुखिया (एचओएफ) आधारित नामांकन अनिवार्य है (आश्रय गृहों या अनाथालयों में रहने वाले बालकों/बालिकाओं के अलावा) माता-पिता में से कोई या विधिक संरक्षक परिवार का मुखिया बन सकता है।

(ग) एचओएफ आधारित नामांकन करने से पूर्व एचओएफ के पास वैध आधार होना चाहिए।

(घ) एचओएफ आधारित नामांकन के लिए माता-पिता दोनों का आधार नंबर अपेक्षित है और माता-पिता में से किसी एक द्वारा बायोमेट्रिक प्रमाणीकरण अनिवार्य है।

(ङ) पीओआर दस्तावेज में बालक/बालिका और एचओएफ के नाम उल्लेख होना चाहिए।

(च) सहायक दस्तावेज में उल्लिखित व्यक्ति का नाम, व्यक्ति के आधार में उसी रूप में दोहराया जाएगा। माता-पिता/अभिभावक का पहला नाम, मध्य नाम और अंतिम नाम जैसी किसी अतिरिक्त सूचना पर विचार नहीं किया जाएगा ।

(छ) एचओएफ के आधार में उल्लिखित पते का उपयोग बालक/बालिका के आधार में किया जाएगा।31 [भाग III—खण्ड ⁴] भारत का राजपत्र : असाधारण (ज) निवासी विदेशी नागरिकों के लिए, जारी किया गया आधार के वल वीजा की वैधता अवधि तक ही मान्य होगा। हालांकि, नेपाल/भूटान के नागरिकों के मामले में, जारी किया गया आधार के वल दस साल की अवधि के लिए वैध होगा।

(झ) ओसीआई कार्ड धारकों के लिए, जारी किया गया आधार के वल दस वर्ष की अवधि के लिए वैध होगा।

(ञ) एलटीवी दस्तावेज धारकों के लिए, जारी किया गया आधार एलटीवी दस्तावेज की वैधता तक ही मान्य होगा I (ट) एचओएफ को बालक/बालिका के नाम पर जारी पहचान के सबूत (पीओआई) निम्न दस्तावेजों में से कोई भी प्रदान करने के लिए प्रोत्साहित किया गया है :-

नोट: उपरोक्त सारणीबद्ध ब्यौरे में सूचीबद्ध कोई भी दस्तावेज के वल तभी स्वीकार्य होगा जब वह निम्नलिखित शर्तों को पूरा करता हो, नामत : —

(क) यह वतर्मान में वैध है (जब तक कि ऊपर स्पष्ट रूप से अन्यथा प्रावधानित न किया गया हो);

(ख) जिस व्यक्ति के संबंध में ऐसा दस्तावेज जारी किया गया है वह उसका हकदार है;

(ग) यदि दस्तावेज में अंतर्विष्ट सूचना सार्वजनिक रूप से प्रदर्शित है या यूआईडीएआई को अन्यथा ऑनलाइन प्राप्य है या डिजिटल साधनों से ऑफलाइन सत्यापनीय है, तो यदि ऐसे साधनों का उपयोग किया जाता है तो सूचना सत्यापित होती है; और (घ) पहचान, पते, जन्म तिथि या संबंध को साक्ष्यित करने के लिए प्रस्तुत दस्तावेज को जारी करने वाले प्राधिकारी ने ऐसी श्रेणी के दस्तावेज के संबंध में कोई घोषणा नहीं की है कि ऐसा दस्तावेज इसका सबूत नहीं है।

महत्वपूर्ण लेख:

(क) 1.10.2023 को और इसके बाद जन्म हुए निवासी भारतीय और अनिवासी भारतीय (एनआरआई) के लिए जन्म प्रमाण-पत्र अनिवार्य है।

(ख) पांच वर्ष से कम आयु के बालकों/बालिकाओं के लिए परिवार के मुखिया (एचओएफ) आधारित नामांकन अनिवार्य है (आश्रय गृहों या अनाथालयों में रहने वाले बालकों/बालिकाओं के अलावा) माता-पिता में से कोई या विधिक संरक्षक परिवार का मुखिया बन सकता है।

(ग) एचओएफ आधारित नामांकन करने से पूर्व एचओएफ के पास वैध आधार होना चाहिए।

(घ) एचओएफ आधारित नामांकन के लिए माता-पिता दोनों का आधार नंबर अपेक्षित है और माता-पिता में से किसी एक द्वारा बायोमेट्रिक प्रमाणीकरण अनिवार्य है।

(ङ) पीओआर दस्तावेज में बालक/बालिका और एचओएफ के नाम उल्लेख होना चाहिए।

(च) सहायक दस्तावेज में उल्लिखित व्यक्ति का नाम, व्यक्ति के आधार में उसी रूप में दोहराया जाएगा। माता-पिता/अभिभावक का पहला नाम, मध्य नाम और अंतिम नाम जैसी किसी अतिरिक्त सूचना पर विचार नहीं किया जाएगा ।36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (छ) एचओएफ के आधार में उल्लिखित पते का उपयोग बालक/बालिका के आधार में किया जाएगा।

(ज) निवासी विदेशी नागरिकों के लिए, जारी किया गया आधार के वल वीजा की वैधता अवधि तक ही मान्य होगा। हालांकि, नेपाल/भूटान के नागरिकों के मामले में, जारी किया गया आधार के वल दस साल की अवधि के लिए वैध होगा।

(घ) एक दस्तावेज को पते के सबूत (पीओए ) दस्तावेज तभी स्वीकार किया जाएगा, जब उसमें व्यक्ति का नाम और पता शामिल होगा। (ङ) एक दस्तावेज को पहचान का सबूत (पीओआई) और पते का सबूत (पीओए) दस्तावेज दोनों में तभी स्वीकार किया जाएगा, जब उसमें व्यक्ति का नाम, फोटो और पता शामिल होगा।

(च) सहायक दस्तावेज में उल्लिखित व्यक्ति का नाम, व्यक्ति के आधार में उसी रूप में दोहराया जाएगा। माता-पिता/अभिभावक का पहला नाम, मध्य नाम और अंतिम नाम जैसी किसी अतिरिक्त सूचना पर विचार नहीं किया जाएगा ।

(छ) पीओआई, पीओएऔर पीडीबी दस्तावेज व्यक्ति के नाम पर होना चाहिए। परिवार के सदस्य/सदस्यों के नाम पर मौजूद दस्तावेजों पर परिवार के अन्य सदस्यों के नामांकन नहीं किए जा सकते है

(ज) पीओआईऔर पीओए दस्तावेज नहीं हैं तो परिवार के मुखिया (एचओएफ) आधारित नामांकन का उपयोग किया जाएगा। (झ) एचओएफ आधारित नामांकन करने से पहले एचओएफ के पास वैध आधार होना चाहिए। आधार प्रमाणीकरण के लिए नामांकन के दौरान एचओएफ को व्यक्ति के साथ मौजूद रहना होगा।

(ञ) एचओएफ के आधार में उल्लिखित पता परिवार के सदस्य के आधार में उपयोग किया जाएगा।

(ट) बालक/बालिका (0-5 वर्ष) के मामले में आधार में नाम "बेबी ऑफ..." है तो, पहली बार पूर्ण नाम अद्यतन के लिए जन्म और मृत्यु पंजीकरण अधिनियम, 1969 के अंतर्गत प्राधिकृ त प्राधिकारी द्वारा जारी किए गए जन्म प्रमाण-पत्र को प्रस्तुत करने की अनुमति दी जाएगी, जो उसके अंतर्गत बनाए गए नियमों के साथ पढ़ा जाएगा।

(ठ) निवासी विदेशी नागरिकों के लिए आधार अपडेट के वल आधार वयस्क नामांकन कें द्रों पर किया जाएगा।

(ड) निवासी विदेशी नागरिकों के लिए, जारी किया गया आधार के वल वीजा की वैधता तक मान्य होगा। हालाँकि, नेपाल/भूटान के नागरिकों के मामले में, जारी किया गया आधार दस साल की अवधि के लिए वैध होगा।

(ढ) ओसीआई कार्ड धारकों के लिए जारी किया गया आधार के वल दस साल की अवधि के लिए वैध होगा।

F. No. HQ-16016/1/2023-EU-I-HQ (E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to further amend the Aadhaar (Enrolment and Update) Regulations, 2016, namely:—

1. Short title and commencement.—(1) These regulations may be called the Aadhaar (Enrolment and Update) Amendment Regulations, 2024

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Aadhaar (Enrolment and Update) Regulations, 2016 (hereinafter referred to as principal regulations), in regulation 2, in sub-regulation (1),—

(a) after clause (fa), the following clauses shall be inserted, namely:—

'(fb) "electronic form" shall have the same meaning as is assigned to it in the Information Technology Act, 2000 (21 of 2000);'; and

(b) in clause (k), the words "or update of his demographic information or biometric information" shall be omitted.

3. In the principal regulations, for regulation 11, the following regulation shall be substituted, namely:—

"11. COLLECTION OF INFORMATION AT ENROLMENT CENTRE.—(1) THE OPERATOR SHALL CAPTURE—

A. THE DEMOGRAPHIC INFORMATION AS SUBMITTED BY THE INDIVIDUAL SEEKING TO ENROL IN THE APPLICATION FORM SET OUT IN SCHEDULE I; AND

B. THE BIOMETRIC INFORMATION USING ONLY SUCH SOFTWARE AS IS PROVIDED OR APPROVED BY THE AUTHORITY.

(2) UPON PRESENTATION OF ONE OR MORE DOCUMENTS EVIDENCING THE PROOFS REFERRED TO IN CLAUSE (A) OF SUB-REGULATION (1) OF REGULATION 10, THE OPERATOR SHALL—

(a) make a copy in electronic form of every such document;

(b) give the individual seeking to enrol an opportunity to check the accuracy of the information captured under sub-regulation (1) and the copy referred to in clause (a) and shall, after such checking, upload such information and copy to the CIDR;

(c) not make or store a copy of any such document in physical or electronic form, save in accordance with—

(i) clause (b); or

(ii) the provisions contained in any other regulations made under the Act or any policy, procedure, guideline, order, process, standard, specification or other document issued by the Authority;

(d) return such documents; and

(e) provide the individual seeking to enrol an acknowledgement containing the EID and other enrolment details.

(3) the procedures, processes, standards and guidelines to be followed during the enrolment process, and the forms, templates and checklists to be used for carrying out the same, shall be such as the authority may specify in this behalf.".

4. In the principal regulations, for regulation 16A, the following regulation shall be substituted, namely:—

"16A. Update of documents or information.—An Aadhaar number holder may, on completion of every period of 10 years from the date of generation of the Aadhaar number assigned to him, update the documents or the information evidencing proof of identity and proof of address as referred to in regulation 10, at least once, by submitting an application in such form set out in Schedule I as is applicable to such Aadhaar number holder or in the online form provided at the website or mobile application of the Authority and—

(a) undergoing authentication and presenting such documents, in original, at an enrolment centre in like manner as is provided in respect of presentation of documents under clause (a) of sub-regulation (1) of regulation 10;

(b) electronically uploading copies of such documents on the website or mobile application of the Authority, in the manner provided for this purpose on such website or application, as the case may be; or

(c) giving his consent for electronically obtaining the information evidencing the said proofs from the databases of the authorities dealing with the preparation or maintenance of such information, so as to help ensure the continued accuracy of his information in the Central Identities Data Repository:

Provided that such presentation, electronic uploading or electronic obtaining shall be subject to the software provided or authorised by the Authority for carrying out the process of update supporting the same.".

5. In the principal regulations, for regulation 19, the following regulation shall be substituted, namely:—

"19. Update of information of Aadhaar number holder.—(1) Any Aadhaar number holder who seeks to update his information in CIDR at an enrolment centre shall submit an application in such form set out in Schedule I as is applicable to such Aadhaar number holder, undergo authentication and—

(a) present at the enrolment centre, in original, for verification and scanning, one or more documents evidencing proof of identity and proof of address and, where applicable, proof of date of birth or proof of relationship or both, as the case may be; or

(b) give his consent for electronically obtaining the information evidencing the proofs referred to in clause (a) from the databases of the authorities dealing with the preparation or maintenance of such information:

Provided that such presentation or electronic obtaining of information shall be subject to the software provided or authorised by the Authority for collection of information for such update supporting the same.

(2) An Aadhaar number holder who seeks to update his information in CIDR using the website or mobile application of the Authority—

(a) shall submit on such website or application, as the case may be, such information as is required to be filled in the online form provided thereat for such update; and

(b) shall upload on such website or application, copy in electronic form of one or more documents evidencing the proofs referred to in sub-regulation (1), or give his consent for electronically obtaining the information evidencing such proofs from the databases of the authorities dealing with the preparation or maintenance of such information:

Provided that such uploading or electronic obtaining of information shall be subject to the software provided or authorised by the Authority for collection of information for such update supporting the same.

(3) Notwithstanding anything contained in sub-regulation (1) or sub-regulation (2), if the Aadhaar number holder has previously updated the information regarding his—

(a) date of birth once;

(b) gender once; or

(c) name twice,

update of such information shall be done only in accordance with such process as the Authority may specify.

(4) A list of documents that may be presented to evidence the proofs referred to in sub-regulation (1) or sub- regulation (2) is in Schedule II.

(5) Verification of the information collected as part of the process of update shall be done on the basis of documents specified in Schedule II or electronic information to evidence the proofs referred to in clause (b) of sub-regulation (1) or clause (b) of sub-regulation (2):

(a) any Ministry, Department or agency of the Central Government or a State Government; or (b) any authority dealing with the preparation or maintenance of such information or documents, may be taken for the purpose of such verification.

(6) The operator, while collecting information for update at the enrolment centre, shall adhere, mutatis mutandis, to the requirements applicable to collection of information for enrolment at an enrolment centre under regulation 11.

(7) On completion of the process for collection of information for update at the enrolment centre, the operator shall provide to the Aadhaar number holder an acknowledgement containing a number to enable him to track the status of processing of the information collected.".

6. In the principal regulations, in CHAPTER VI, below the heading of the said Chapter, the following regulation shall be inserted, namely:—

"26A. Interpretation.—In this Chapter and Schedule VI, unless the context otherwise requires, the expressions "cancel" or "omit", in relation to an Aadhaar number, shall mean the omission of such Aadhaar number, and their grammatical variations and cognate expressions shall be construed accordingly.".

7. In the principal regulations, in regulation 28A, for the words "from time to time", the words, brackets and figures "from time to time, the Registration of Foreigners Act, 1939 (16 of 1939) and the orders made and directions given thereunder, or the Foreigners Act, 1946 (31 of 1946) and the rules made thereunder" shall be substituted.

* Proof of Address documents as in the list of acceptable supporting documents for Aadhaar enrolment (above five years) will be applicable.

Note: Any document listed in the above tabular statement shall be acceptable only if it meets the following conditions, namely:—

(a) It is currently valid (unless otherwise expressly provided for above);

(b) The person in respect of whom such document is issued is entitled for the same;

(c) If the information contained in the document is publicly displayed or otherwise accessible to UIDAI online or is verifiable offline through digital means made available by the authority issuing the same, such information is verified if such means are used; and

(d) The authority issuing the document presented to evidence proof of identity, address, date of birth or relationship has not made any declaration in respect of such category of document that such document is not proof of the same.

Important Note:

(a) For resident Indian and non-resident Indian (NRI) born on and after 1.10.2023, birth certificate is mandatory.

(b) Head of Family (HoF) based enrolment is mandatory (except for children residing in shelter homes or orphanages and foreign national seeking enrolment) for children below five years of age. Any one of the parents or legal guardian can become HoF.

(c) HoF must have a valid Aadhaar before performing HoF based enrolment.

(d) Aadhaar number of both the parents is required for HoF based enrolment and biometric authentication by one of the parents is mandatory.

(e) Name of the child and HoF must be mentioned in the PoR document.

(f) Name of the individual as mentioned in the supporting document, will be replicated as such in the individual's Aadhaar. No additional information like parent/guardian first name, middle name and last name will be considered.

(g) The address mentioned in the HoF Aadhaar will be used in the child's Aadhaar.

(h) For foreign national seeking enrolment, the Aadhaar issued will be valid only till validity of the visa. However, in case of Nepal/Bhutan nationals, the Aadhaar issued will be valid for a period of ten years.

(i) For OCI card holders, the Aadhaar issued will be valid only for a period of ten years.

(j) For LTV document holders, the Aadhaar issued will be valid only till the validity of LTV document.

(k) HoF is encouraged to provide any of the following Proof of Identity (PoI) documents issued in the name of the child:

(i) Indian passport

(ii) Photo Identity Card/Certificate with photograph issued by Central Government /State Government, such as Domicile Certificate, Resident Certificate etc.

(iii) ST/ SC/ OBC Certificate issued by Central Government /State Government

(iv) Disability Identity Card/Certificate of Disability issued under the Rights of Persons with Disabilities Rules, 201766 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(f) All the PoI, PoA, DoB documents shall be issued on the name of the individual. Documents in the name of the family member/members cannot be considered for enrolment of the other family members.

(g) Head of Family (HoF) based enrolment shall be used in case individual does not have PoI and PoA documents. (h) HoF must have a valid Aadhaar before performing HoF based enrolment. HoF must accompany the individual during enrolment for his / her Aadhaar Authentication.

(i) The address mentioned in the HoF Aadhaar will be used in the family member's Aadhaar. (j) For foreign national seeking enrolment, the Aadhaar issued will be valid only till validity of the visa. However, in case of Nepal/Bhutan nationals, the Aadhaar issued will be valid for a period of ten years.

(k) In case of child (0-5 years) having name as "Baby of …." in Aadhaar, the first update request for full name change shall be allowed by submission of Birth certificate issued by Authorised Authority under the Registration of Births and Deaths Act, 1969, read with the rules made thereunder.

(l) Aadhaar update for foreigner national will be conducted at Aadhaar adult enrolment centres only. (m) For foreign national seeking enrolment, the Aadhaar issued will be valid only till validity of the visa. However, in case of Nepal/Bhutan nationals, the Aadhaar issued will be valid for a period of ten years.

(n) For OCI card holders, the Aadhaar issued will be valid only for a period of ten years. (o) For LTV document holders, the Aadhaar issued will be valid only till the validity of LTV document.
