का.आ. 299(अ).—जबकि के न्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का. आ. 2533 (अ), दिनांक 17 सितंबर, 2015 के द्वारा पंजाब में नई राष्ट्रीय राजमार्ग सं. 148बी को पंजाब सरकार को सुपुर्द किया गया है। अत: अब, राष्ट्रीय राजमार्ग फीस (दरों का निर्धारण और संग्रहण) नियमावली, 2008 के नियम 3 के साथ पठित (जो इसके आगे ''नियम'' के रूप में उल्लिखित है) राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, के न्रीय सरकार, एतदद्वारा पंजाब में राष्ट्रीय राजमार्ग सं. 148बी के डिजाइन किमी 236.600 से किमी 239.480 (मौजूदा किमी 236.600 से किमी 239.400 तक) और किमी 244.540 से किमी 287.548 (मौजूदा किमी 244.750 से किमी 287.710 तक) के मूनक-जखाल-बुढलाडा-भिखि खंड के उपयोग के लिए नीचे दी गई तालिका 1 के कॉलम (1) में विर्निर्दष्ट वाहनों के प्रकार पर चार लेन खंड के 8.868 किमी लंबाई की निवल सड़क खंड और 0.70 किमी (0.070 किमी की लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अधिक की लंबाई वाली) और पेव्ड शोल्डर के साथ दो लेन खंड के 36.530 किमी लंबाई की निवल सड़क खंड और 4.90 किमी (0.490 किमी की लंबाई वाली) की समतुल्य संरचना लंबाई (60 मीटर से अधिक की लंबाई वाली) के उपयोग के लिए आधार दर का साठ प्रतिशत पर तालिका 1 के कॉलम (2) में विर्निर्दष्ट दर से फीस उदगृहीत करती है तथा भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को उसके अधिकारियों अथवा किसी ठेके दार के माध्यम से उक्त फीस के संग्रहण के लिए प्राधिकृ त करती है, अर्थात्:-

1. इसके अंतर्गत उद्गृहीत और संगृहीत फीस ऐसे पथकर प्लाजाओं के अंतर्गत विर्निर्दष्ट निवल सड़क लंबाई हेतु निम्नलिखित पथकर प्लाजाओं में देय और संदेय होगी:-

3. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2023-24 के लिए 330.00 रु. (तीन सौ तीस रुपए मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के अध्यधीन है।
4. राजमार्ग खंड पर बहुल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

5. फीस प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए फीस उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई र्सर्वस रोड या वैकल्पिक सड़क उपलब्ध न हों।
6. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश लिए, कथित नियमों के नियम 10 के उप-नियम 1ए के अनुसार अनुप्रयोज्य फीस के समतुल्य दस गुणा फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता ।
7. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि पूवोक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी ।
8. फीस की दरें उक्त नियमों के नियम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रर्दर्शत करनी होंगी ।
9. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा ।
10. परियोजना की प्राक्कलित पू ंजीगत लागत 367.17 करोड़ रु. है। पू ंजीगत लागत अलग हो सकती है, क्योंकि भूमि अधिग्रहण, उपयोगिता सुविधाओं के स्थानांतरण, पेड़ कटाई आदि कार्य-कलापों को अभी पूरा किया जाना है। भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का रिकॉर्ड रखा जाएगा।

NOTIFICATION
New Delhi, the 19th January, 2024
S.O. 299(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O 2533 (E) dated 17th September, 2015 issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the New National Highway No. 148 B in the State of Punjab to the State Government of Punjab.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length of 8.868 Km & for equivalent structure length (having length more 60 m) of 0.70 Km (having length of 0.070 Km) for the use of four lane section and at sixty percent of the base rate for net road section length of 36.530 Km & for equivalent structure length (having length more than 60 m) of 4.90 Km (having length of 0.490 Km) for use of two lane with paved shoulders on the type of vehicles specified in column4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (1) of the Table 1 below of Moonak – Jakhal – Budhlada – Bhikhi section from design kilometer 236.600 to kilometer 239.480 (existing Km 236.600 to Km 239.400) & kilometer 244.540 to kilometer 287.548 (existing Km 244.750 to Km 287.710) of National Highway No. 148B in the State of Punjab and authorises the National Highways Authority of India to collect, either through its officials or through a contractor, the said fee, namely:-

2. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60 m at the following fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:-

3.The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs 330.00 (Rupees Three Hundred and Thirty only) for the year 2023-24 and is subject to revision every year as per the provisions of the said rules.
4.For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee as below for entering the overloaded vehicle on the National Highway to the fee collecting agency equal to the fee specified in sub rule 1-A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.
9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highways Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
10.The estimated capital cost of the project is Rs. 367.17 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. National Highways Authority of India shall maintain a record of the recovery of capital cost through user fee realised.
