का.आ. 416(अ).—जबकि, भारत सरकार ने 22 अगस्त, 2022 को भारत में आपदा रोधी अवसंरचना हेतु गठबंधन (इसके पश्चात सीडीआरआई के रूप में उल्लिखित) की स्थापना हेतु मुख्यालय संबंधी करार पर हस्ताक्षर किए थे;
और जबकि, मुख्यालय संबंधी करार के अनुच्छेद-X में आपदा रोधी अवसंरचना हेतु गठबंधन, इसके प्रतिनिधियों और अधिकारियों के विशेषाधिकारों और उन्मुक्तियों के संबंध में प्रावधान किए गए हैं;
और जबकि, कें द्र सरकार आपदा रोधी अवसंरचना हेतु गठबंधन के लिए संयुक्त राष्ट्र (विशेषाधिकार एवं उन्मुक्ति) अधिनियम, 1947 (1947 का 46) के तहत प्रदत्त आवश्यक विशेषाधिकारों और उन्मुक्तियों को, इसके प्रतिनिधियों और अधिकारियों को प्रदान करना समीचीन समझती है;
अतः अब संयुक्त राष्ट्र (विशेषाधिकार एवं उन्मुक्ति) अधिनियम, 1947 (1947 का 46) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार एतद्द्वारा यह घोषणा करती है कि उक्त अधिनियम की अनुसूची के अनुच्छेद I की धारा 1, अनुच्छेद II की धारा 2,3,4,5,6,7 और धारा 8, अनुच्छेद III की धारा 9और अनुच्छेद Vकी धारा 18 के खंड (क), (ख), (ग), (घ) और (ङ) और धारा 20 तथा अनुच्छेद VI की धारा 22 के खंड (क), (ख), (ग), (घ), (ङ) और (च) और धारा 23 के प्रावधान, यथोचित परिवर्तनों के साथ, आपदा रोधी अवसंरचना हेतु गठबंधन के प्रतिनिधियों और अधिकारियों पर लागू होंगे।

New Delhi, the11th January, 2024
S.O. 416(E).—Whereas, the Government of India signed the HeadquartersAgreement for establishing the Coalition for Disaster Resilient Infrastructure (hereinafter referred to as CDRI) in India on 22ndAugust, 2022;\ And whereas, Article X of the Headquarters Agreement provides for privileges and immunities to CDRI, its representatives and officials;
And whereas, the Central Government considers it expedient to extend the necessary privileges and immunities provided under the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947) to CDRI, its representatives and officials;
Now, therefore, in exercise of the powers conferred by section 3 of the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947), the Central Government hereby declares that the provisions of section 1 of Article I, sections 2,3,4,5,6,7 and section 8 of Article II, section 9 of Article III and clauses (a), (b), (c), (d) and (e) of section 18 and section 20 of Article V and clauses (a), (b), (c), (d), (e) and (f) of section 22 and section 23 of Article VI of the Schedule to the said Act shall apply, mutatis mutandis, to CDRI, its representatives and officials.
