सा.का.नि. 742(अ).––सिगरेट और अन्य तंबाकू उत्पाद (विज्ञापन का प्रतिषेध तथा व्यापार और वाणिज्य, उत्पादन, प्रदाय और वितरण का विनियमन) अधिनियम, 2003 (2003 का 34) की धारा 7 की उपधारा (1), धारा 8, धारा 9 की उपधारा (2), धारा 10 और धारा 31 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्रीय सरकार, एतदद्वारा, सिगरेट और अन्य तंबाकू उत्पाद (पैके जिंग और लेबलिंग) नियम 2008 में और संशोधित करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
1. (1) इन नियमों को सिगरेट और अन्य तंबाकू उत्पाद (पैके जिंग और लेबलिंग) संशोधन नियम, 2024 है। (2) वे आधिकारिक राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. सिगरेट और अन्य तंबाकू उत्पाद (पैके जिंग और लेबलिंग) नियम, 2008 (जिन्हें इसमें इसके पश्चात उक्त नियम कहा जाएगा) में, नियम 5 में, उप-नियम (3) के पश्चात, निम्नलिखित उप-नियम अंत:स्थापित किया जाएगा, अर्थात्:
"(3क) उप-नियम (1), (2) और (3) में किसी बात के होते हुए भी, दूसरे बारह महीनों के लिए र्निर्दष्ट स्वास्थ्य चेतावनियाँ तब तक लागू रहेंगी जब तक कि अनुसूची के पैराग्राफ 1 और 2 में प्रदान की गई र्निर्दष्ट स्वास्थ्य चेतावनियाँ संशोधित नहीं हो जातीं। "
3. उक्त नियमों में, अनुसूची में, 1 जून, 2025 से, -
(i) पैराग्राफ (1) में, खंड (i) के स्थान पर निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्: - "(i) पाठ्य स्वास्थ्य संबंधी चेतावनी - धूम्रपान और धूम्ररहित तम्बाकू उत्पादों के लिए, 'तम्बाकू से दर्दनाक मौत होती है' शब्द लाल पृष्ठभूमि पर सफे द रंग के अक्षरों में दिखाई देंगे। 'आज ही छोड़ें 1800-11-2356 पर कॉल करें' शब्द और आंकड़े काले रंग की पृष्ठभूमि पर सफे द रंग के अक्षरों में दिखाई देंगे। पाठ्य स्वास्थ्य संबंधी चेतावनी की पृष्ठभूमि में रंग की तीव्रता होगी: सफे द: सी:0%, एम:0%, वाई:0% के :0%, लाल: सी:0%, एम:100%, वाई:100% के : 0% और काला: सी:0%, एम:0%, वाई:0% के : 100%। पाठ्य स्वास्थ्य संबंधी चेतावनियाँ न्यूनतम 300 डीपीआई (डॉट्स प्रति इंच) के मुद्रण रिज़ॉल्यूशन के साथ चार रंगों में मुद्रित की जाएंगी। स्वास्थ्य संबंधी चेतावनी का फ़ॉन्ट का आकार और रंग बिल्कु ल वैसा ही होगा जैसा कि वेबसाइट www.mohfw.gov.in या https://ntcp.mohfw.gov.in/ पर अपलोड किया गया है।
(ii) पैराग्राफ 2 के स्थान पर निम्नलिखित पैराग्राफ प्रतिस्थापित किया जाएगा, अर्थात्: -
"2. र्निर्दष्ट स्वास्थ्य चेतावनियाँ निम्नलिखित अनुसार होंगी-
(क) छवि-1 जो इसके प्रारंभ होने के बाद बारह महीने की अवधि के लिए वैध होगी।
चित्र- 1 (ख) छवि-2 जो छवि-1 की र्निर्दष्ट स्वास्थ्य संबंधी चेतावनी के प्रारंभ होने की तारीख से बारह माह की समाप्ति के बाद प्रभावी होगा {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण

निखिल गजराज, संयुक्त सचिव नोट.- मूल नियम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-धारा (i) में संख्या सा.का.नि.182 (अ), दिनांक 15 मार्च, 2008 द्वारा प्रकाशित किए गए थे और अंतिम बार अधिसूचना संख्या सा.का.नि. 592 (ई), दिनांक 21 जुलाई, 2022 द्वारा संशोधित किए गए थे।

NOTIFICATION
New Delhi, the 2nd December, 2024
G.S.R. 742(E).—In exercise of the powers conferred by sub-section (1) of section 7, section 8, sub-section (2) of section 9, section 10 and section 31 of the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (34 of 2003), the Central Government hereby makes the following rules further to amend the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008, namely: -
1. (1) These rules may be called the Cigarettes and other Tobacco Products (Packaging and Labelling) Amendment Rules, 2024.
(2) They shall come into force from the date of their publication in the official gazette.
2. In the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008 (hereinafter referred to as the said rules), in rule 5, after sub-rule (3), the following sub-rule shall be inserted, namely:-
"(3A) Notwithstanding anything contained in sub-rules (1), (2) and (3), the specified health warnings for the second twelve months shall remain in force till the specified health warnings provided in paragraphs 1 and 2 of the Schedule are not amended. "
3. In the said rules, in the Schedule, with effect from the 1st day of June, 2025,-
(i) in paragraph (1), for clause (i), the following clause shall be substituted, namely: -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "(i) Textual Health Warning. - For smoking and smokeless forms of tobacco products, the words 'TOBACCO CAUSES PAINFUL DEATH' shall appear in white font colour on a red background. The words and figures 'QUIT TODAY CALL 1800-11-2356' shall appear in white font colour on a black background. The intensity of color in the background of the textual health warning shall be: White: C:0%, M:0%, Y:0% K:0%, Red: C:0%, M:100%, Y:100% K: 0% and Black: C:0%, M:0%, Y:0% K: 100%. The textual health warnings shall be printed with four colours with printing resolution of minimum 300 DPI (Dots per inch). The font type and colour of the health warning shall be exactly as uploaded on the website www.mohfw.gov.in or https://ntcp.mohfw.gov.in/"
(ii) For paragraph 2, the following paragraph shall be substituted, namely: -
"2. The specified health warnings shall be- (a) Image-1 which shall be valid for a period of twelve months following its commencement.
Image- 1 (b) Image-2 which shall come into effect following the end of twelve months from the date of commencement of specified health warning of Image-1.
Image- 2 Note. -The soft or printable version of the specified health warnings are available on the websites www.mohfw.nic.in and https://ntcp.mohfw.gov.in/
