का.आ. 5203(अ).— के न्रीय सरकार, रेल (संशोधन) अधिनियम, 2008 (2008 का 11वां) (जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है) की धारा 20 (क) की उपधारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण, भाग II, खण्ड 3, उप-खण्ड (ii), दिनांक 21 अक्टूबर, 2024 में प्रकाशित भारत सरकार के रेल मंत्रालय (उत्तर मध्य रेलवे निर्माण विभाग) की अधिसूचना संख्या का. आ. 4593(अ) दिनांक 09 अक्टूबर, 2024 (जिसे इसके पश्चात उक्त अधिसूचना कहा गया है) द्वारा उक्त अधिसूचना से उपाबद्ध अनूसूची में विर्निर्दष्ट भूमि को, उत्तर प्रदेश राज्य के बुलन्दशहर जिले के सिकन्राबाद एवं खुर्जा तहसील में विशेष रेल परियोजना, अर्थात् मौजूदा नई दिल्ली-हावडा (कानपुर-लखनऊ सहित), मार्ग पर गतिसीमा को 160 किमी० प्रति घण्टा/200 किमी० प्रति घण्टा करने के लिए सब-सेक्शनिंग व पैरललिगं पोस्ट (SSP) के डिजाईन, सप्लाई, इरेक्शन, टेस्टिंग एवं कमीशनिंग हेतु अपेक्षित है, ऐसी भूमि का अर्जन करने के अपने आशय की घोषणा की गई थी;
और उक्त अधिसूचना का सार अधिनियम की धारा 20 अ की उपधारा (4) के अधीन दैनिक समाचार पत्रों, अर्थात् "अमर उजाला" और "दि टाइम्स ऑफ इण्डिया" में तारीख 25 अक्टूबर, 2024 को प्रकाशित किया गया था; और, इस परियोजना में प्राप्त सभी अक्षेपों का निस्तारण सक्षम प्राधिकारी द्वारा कर दिया गया है और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 20ड की उपधारा (1) के अनुसरण में के न्रीय सरकार को अपनी रिपोर्ट सौंप दी है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब के न्रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा 20ड की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इसमें उपाबद्ध अनूसूची में विर्निर्दष्ट भूमि पूवोक्त प्रयोजन के लिए र्अर्जत की जाएगी ।
यह और के न्रीय सरकार उक्त अधिनियम की धारा 20ड की उपधारा (2) के अनुसरण में यह घोषणा करती है कि राजपत्र में इस अधिसूचना के प्रकाशित होने पर इसमें उपाबद्ध अनूसूची में विर्निर्दष्ट भूमि सभी विलंगमों से मुक्त होकर के न्रीय सरकार में आत्यांकित रूप से निहित हो जाएगी ।
और, यह कि के न्रीय सरकार उक्त अधिनियम की धारा 20 (च) की उपधारा (04) के अनुसरण में भूमि उर्पयुक्त र्वर्णत भूमि में सभी हितबद्ध व्यक्तियों को सूचित किया जाता है कि वे व्यक्तिगत रूप से या किसी अभिकर्ता या विधि व्यवसायी के माध्यम से सक्षम प्राधिकारी अर्थात्: अपर जिलाधिकारी (प्रशासन) बुलन्दशहर के समक्ष अपना दावा इस अधिसूचना के प्रकाशन के आगामी 20 दिवस में सक्षम प्राधिकारी के कार्यालय में प्रस्तुत कर सकते है।

NOTIFICATION
Prayagraj, the 30th November, 2024
S.O. 5203(E).— Whereas, by the notification of the Government of India, in the Ministry of Railway (North Central Railway, Construction department), Notification number, S.O. 4593 (E) dated the 09th October, 2024 published in Gazette of India, Extraordinary, Part-II, Section 3 Sub Section (ii), dated 21th October, 2024 (hereinafter referred to as the said notification) and issue under sub-section (1) of section 20A of the Railways (Amendment) Act. 2008 (11of 2008) (hereinafter referred to as the said Act), the Central Government declares its intention to acquire the land specified in the schedule annexed the said notification for the purpose of Design, Supply, Erection, Testing & Commissioning of Sub-Sectioning & Paralleling Post (SSP) of Special Railway Project, namely Special Railway Project of Raising of Speed to 160kmph/200kmph on existing New Delhi-Hawrah route (incl. Kanpur-Lucknow) in District Bulandshahr of the state of Uttar Pradesh.
And, whereas, the substance of the said notification was published in the daily newspapers "Hindustan" and "The Times of India" Dated 25th October, 2024 under sub-section (4) of section 20A of the said Act; And whereas, all the objections received in this project have been disposed of by the Competent Authority;
And, whereas, in pursuance of sub-section 20E of the said Act, the Competent Authority has submitted its report the Central Government;
Now, therefore, upon receipt of the report of the Competent Authority, and in exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose;
And, further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the Schedule annexed here to shall vest absolutely in the Central Government free from all encumbrances.
And, that all persons interested in the above mentioned land in pursuance of sub-section (04) of section 20(F) of the said Act by the Central Government are hereby informed that they may, personally or through an agent or legal practitioner, be notified by the competent authority Additional District Magistrate (E) Bulandshahr, can submit his claim in the next 20 days from the date of publication of this notification in the office of the Competent Authority.
