का.आ. 5247(अ).—यतः, के न्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 3335 (अ), दिनांक 27 अक्टूबर, 2016 द्वारा कर्नाटक राज्य में राष्ट्रीय राजमार्ग संख्या 209(नया एनएच - 948) के किमी 266.530 से किमी 461.550 (तमिलनाडु/कर्नाटक सीमा खंड से बैंगलोर तक) के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके पश्चात् 'प्राधिकरण' कहा गया है) को सौंपा है;
अतः, अब, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 (जिसे इसके बाद "नियम" कहा गया है) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कें र सरकार एतदद्वारा कर्नाटक राज्य में राष्ट्रीय राजमार्ग संख्या 209 के बीआरटी टाइगर रिजर्व सीमा से बेंगलुरू खण्ड पर डिजाइन चेनेज कि.मी. 287.500 से कि.मी. 458.420 तक (मौजूदा चेनेज किमी 287.520 से 461.550 तक) खण्ड के पेव्ड शोल्डर्स सहित दो लेन खण्ड के 103.272 कि.मी. निविल खंड की लंबाई (सारणी-2) और समतुल्य संरचना लंबाई (60 मीटर से अधिक लंबाई वाली) वाले 12.90 कि.मी. (1.29 किमी लंबाई वाली, सारणी-4) खंड के लिए तालिका 1 के कॉलम (2) में र्निर्दष्ट दर का 60% पर और दस करोड़ रुपये या उससे अधिक की लागत वाले 32.858 कि.मी. लंबाई वाले बाईपास (सारणी-3) के लिए आधार दर के 90% पर और चार लेन खण्ड के 25.32 कि.मी. की शुद्ध सड़क लंबाई (सारणी-2) के लिए तालिका-1 के कॉलम (2) में र्निर्दष्ट दरों के 100% पर और दस करोड़ रुपये या उससे अधिक लागत वाले 8.18 कि.मी. लंबे बाईपास के लिए (सारणी-3) आधार दर के डेढ़ गुना पर नीचे दी गई 7893 GI/2024

4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त हुआ हो और वह शुल्क प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता/रहती हो, उसके लिए वर्ष 2024-25 के लिए मासिक पास की दर 340.000/- रूपए (तीन सौ तीस रूपए मात्र) होगी और उक्त नियमों के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा। 5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

6. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए विर्निर्दष्ट शुल्क का 50% होगा बशते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई र्सर्वस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।
7. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को उक्त नियमों के नियम 10 के उप नियम 1 ए में विर्निर्दष्ट शुल्क का भुगतान करना होगा और उसे6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा नहीं दिया जाए।
8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छू ट-प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुसार होंगी ।
9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा। 10 ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा खंडों की पूरी कर ली गई लम्बाई के आधार पर की जाएगी और तदनुसार उसमें उक्त नियमों के नियम 5 के अनुसार र्वार्षक तौर पर संशोधन किया जाएगा तथा इसे अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा । 11. परियोजना की अनुमानित पू ंजीगत लागत 3041.90 करोड़ रुपए है। पू ंजी लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन-उपयोगिता सेवाओं का स्थान बदलने, पेड़ों की कटाई आदि जैसे यििाकलाप अभी पूरे किए जाने हैं। प्राधिकरण द्वारा वसूल किए गए प्रयोक्ता शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकॉर्ड रखा जाएगा। [फा. सं. एनएचएआई/13013/547/सीओ/19-20/सीबी/टीएन-के एनटीबीडीआर-बीएनजी/ई-184261]

S.O. 5247(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O.3335(E) dated.27th October, 2016 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 266.530 to kilometer 461.550 (Tamil Nadu/Karnataka Border Section to Bangalore) of National Highway No.209 (New NH-948), in the State of Karnataka to the National Highways Authority of India (hereinafter referred to as the "Authority");
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at 60% of the rate specified in column (2) of the Table 1 for net road section length of 103.272 km. (Table-2) and for equivalent structure length (having length more than 60m) of 12.90 km. (having length of 1.29 km., Table-4) and at 90% of base rate for bypasses having length of 32.858 km. (Table-3) costing rupees ten crores or more for two lane with paved shoulders and at 100% of the rates specified in column (2) of the Table-1 for the net road length of 25.32 km (Table-2) and at one and half times of base rate for the bypasses having length of 8.18 km. costing (Table-3) rupees ten crore or more for four lane section on the type of vehicles specified in column (1) of the Table 1 below for BRT Tiger Reserve Boundary to Bangalore section of National Highway no.209 form Design chainage Km. 287.500 to Km. 458.420 (Existing Chainage from Km. 287.520 to 461.550) in the State of Karnataka and authorises the Authority to collect, either through its officials or through contractor, the said fee, namely:-

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.340 (Rupees Three Hundred and Forty Only) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: -

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
11. The estimated capital cost of the project is Rupees. 3041.90 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
