का.आ. 5444(अ).—रेलवे अधिनियम, 1989 (1989 का 24), की धारा 20ए की उप-धारा (I) द्वारा प्रद्त्त शक्ति का प्रयोग करते हुए (इसके बाद उक्त अधिनियम के रूप में संदर्भित), कें द्र सरकार इस बात से संतुष्ट होने के बाद कि सार्वजनिक उद्देश्य के लिए भूमि, जिसका संक्षिप्त विवरण इसके साथ संलग्न अनुसूची में दिया गया है, विशेष रेलवे परियोजना अर्थात् महाराष्ट्र राज्य के नासिक जिले में अंकाई बायपास लाइन के निष्पादन के लिए आवश्यक है, एतदद्वारा ऐसी भूमि का अधिग्रहण करने की अपनी इच्छा की घोषणा करता है:
र्क्त उक्त भूमि में हितप्रद्ध कोई भी व्यक्ति, उपयु र्क्त अधिनियम की धारा 20डी की उप-धार(I) के अंतर्गत उपयु उद्देश्य के लिए ऐसी भूमि के अधिग्रहण और उपयोग के संबंध में सरकारी राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से तीस दिनों की अवधी के भीतर भू-अर्जन में अपनी आपत्ति दर्ज करा सकता है.
ऐसी प्रत्येक आपत्ति, सक्षम प्राधिकारी, अर्थात् उप-विभागीय अधिकारी, येवला, नासिक जिला को लिखित रूप में दी जाएगी और उसके आधारों को निर्धारित की जाएगी तथा सक्षम प्राधिकारी उप-विभागीय अधिकारी, येवला, नासिक जिला आपत्तिकर्ता को व्यक्तिगत रूप से या कानूनी व्यवसायी द्वारा सुनवाई का अवसर देगा और ऐसी सभी आपत्तियों को सुनने के बाद तथा आगे ऐसी जांच करने के बाद, यदि सक्षम प्राधिकारी यह आवश्यक समझता है तो वह किसी आदेश द्वारा आपत्तियों को स्वीकार या अस्वीकार कर सकता है.

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उक्त अधिनियम की धारा 20डी की उप-धारा (II) के अंतर्गत सक्षम प्राधिकारी का कोई भी आदेश अंतिम होगा.
इस अधिसूचना में शामिल की गई भूमि की भू-योजनाएं और अन्य विवरण उपलब्ध है तथा इच्छु क व्यक्ति द्वारा सक्षम प्राधिकारी के उक्त कार्यालय में इनका निरीक्षण किया जा सकता है.

विशेष रेलवे परियोजना अर्थात् महाराष्ट्र राज्य में अंकाई बायपास लाइन के लिए संरचना संहित या उसके रहित अर्जित की जाने वाली भूमि का संक्षिप्त विवरण.

NOTIFICATION
Secunderabad, the 16th December, 2024
S.O. 5444(E).—In exercise of the powers conferred by sub-section (I) of section 20A of the Railways Act, 1989 (24 of 1989) (hereafter referred as in as the said Act), central government after being satisfied that for the public purpose, the land, the brief description of which is given in the schedule annexed hereto, is required for execution of the special railway project, Ankai Bypass line in Nashik district in the state of Maharashtra, hereby declares its intention to acquire such land:
Any person interested in the said land may, within a period of thirty days from the date of publication of this notification in the official gazette, raise objection to the acquisition and use of such land for the aforesaid purpose under sub- section (1) of section 20D of the said act:
Every such objection shall be made to the competent authority, namely Sub Divisional Officer, Yeola, Nashik district in writing and shall be set out the grounds there of and the competent authority Sub Divisional Officer, Yeola, Nashik district shall give the objector an opportunity of being heard, either in person or by legal practitioner and may , after hearing all such objections and after making such further enquiry, if any as the competent authority thinks necessary, by, order, either allow or disallow the objections
Any order made by the competent authority under sub section (II) of section 20(D) of the said act shall be final.
