सा.का.नि. 770(अ).— अमोनियम नाइट्रेट नियम, 2012 का संशोधन करने के लिए निम्नलिखित नियमों का प्रारूप, जिसे के न्रीय सरकार, विस्फोटक अधिनियम, 1884 (1884 का 4) की धारा 14 के साथ पठित विस्फोटक अधिनियम, 1884 की धारा 5 और 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है, ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, उक्त अधिनियम की धारा 18 की उप-धारा (1) की अपेक्षानुसार प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियम पर उस तारीख से तीस (30) दिन के पश्चात् विचार किया जाएगा जिस तारीख को इस अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं;
इन प्रारूप नियमों पर आपत्तियां अथवा सुझाव, यदि कोई हों, ऊपर र्निर्दष्ट अवधि के भीतर, निदेशक (विस्फोटक), उद्योग संवर्धन और आंतरिक व्यापार विभाग, वाणिज्य और उद्योग मंत्रालय को कक्ष संख्या 252-ए, उद्योग भवन, नई दिल्ली-110011 अथवा ई-मेल: [email protected]; पर भेजे जा सकते हैं;
उक्त प्रारूप नियमों के संबंध में किसी भी व्यक्ति से र्निर्दष्ट अवधि के भीतर प्राप्त होने वाली आपत्तियों या सुझावों पर कें र सरकार द्वारा विचार किया जाएगा।

प्रारूप नियम
1. संक्षिप्त नाम और प्रारंभ:-(1) इन नियमों को अमोनियम नाइट्रेट (संशोधन) नियम, 2024 कहा जाएगा। (2) ये आधिकारिक राजपत्र में इनके अंतिम प्रकाशन की तारीख को लागू होंगे।
2. अमोनियम नाइट्रेट, 2012 (जिसे इसके बाद उक्त नियम कहा जाएगा) के नियम 2 में,
क. खंड (ढ) के बाद, निम्नलिखित खंडों को अंत:स्थापित किया जाएगा, अर्थात्:-
"(ढ क) "सूक्ष्म और लघु उद्यम" से सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, 2006 की धारा 2 के खंड (ज) और खंड (ड) में परिभाषित उद्यम अभिप्रेत है।
(ढ ख) "सूक्ष्म और लघु स्टार्टअप" से उद्योग संवर्धन और आंतरिक व्यापार विभाग, वाणिज्य और उद्योग मंत्रालय में पंजीकृ त तथा सा.का.नि. 127(अ) दिनांक 19 फरवरी, 2019 की राजपत्रित अधिसूचना के पैराग्राफ 1 के खंड (क) में यथापरिभाषित निकाय अभिप्रेत है।"
ख. खंड (ध) के बाद, निम्नलिखित खंड को अंत:स्थापित किया जाएगा, अर्थात्:-
"(न) "महिला उद्यमी" से महिला के स्वामित्व और नियंत्रण वाला ऐसा उद्यम अभिप्रेत है जिसकी पू ंजी में उनका न्यूनतम 26 प्रतिशत वित्तीय हित शामिल है।"
3. उक्त नियमों के नियम 29 के उप-नियम (1) को, निम्नलिखित से प्रतिस्थापित किया जाएगा, अर्थात्:-
"(1) पूर्व अनुमोदन, अनुज्ञप्ति जारी करने और संशोधन के लिए निम्नलिखित शुल्क का भुगतान करना होगा, अर्थात्:-

| ग. | किसी भंडार गृह स अमोनियम े नाइट्रेट के विक्रय हेतु कब्जे में रखने [अथवा टैंक में गले हुए अमोनियम नाइट्रेट] के लिए अनुज्ञप्ति | 2000 प्रतिवर्ष | 1000 प्रतिवर्ष | 400 प्रतिवर्ष |
| घ. | किसी भंडार गृह स अमोनियम े नाइट्रेट के प्रयोग हेतु कब्जे में रखने (अथवा टैंक में गले हुए अमोनियम नाइट्रेट) के लिए अनुज्ञप्ति | 1000 प्रतिवर्ष | 500 प्रतिवर्ष | 200 प्रतिवर्ष |

(1क) उपयु र्क्त उप-नियम 1 में उल्लिखित शुल्क में छू ट का दावा करने के प्रयोजन हेतु, आवेदक को निम्नलिखित दस्तावेज प्रस्तुत करने होंगे, अर्थात्:-
क. सूक्ष्म और लघु उद्यम- सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय द्वारा जारी प्रमाण-पत्र।
बशते कि उपयु र्क्त उक्त छू ट, के वल सूक्ष्म और लघु उद्यम पर लागू होगी और यह मध्यम उद्यम पर लागू नहीं होगी।
(ख) सूक्ष्म और लघु स्टार्टअप-उद्योग संवर्धन और आंतरिक व्यापार विभाग, वाणिज्य और उद्योग मंत्रालय में पंजीकरण का दस्तावेजी साक्ष्य।
बशते कि उपयु र्क्त उक्त छू ट के वल सूक्ष्म और लघु स्टार्टअप पर लागू होगी और यह मध्यम स्टार्टअप पर लागू नहीं होगी।
(ग) महिला उद्यमी- फर्म या कं पनी के स्वामी अथवा निदेशक का दस्तावेजी साक्ष्य।
(1ख) ऐसे मामले में जहां, सूक्ष्म और लघु उद्यम या सूक्ष्म और लघु स्टार्टअप का स्वामित्व या नियंत्रण महिला द्वारा किया जाता है, तो जो भी शुल्क कम होगा, वह लागू होगा।
बशते कि यदि आवेदक द्वारा प्रस्तुत की गई जानकारी, किसी भी स्तर पर गलत या भ्रामक पायी जाती है, तो ऐसे अनुमोदन या अनुज्ञप्ति को निरस्त कर दिया जाएगा।

NOTIFICATION
New Delhi, the 11th December, 2024
G.S.R. 770(E).— The draft of the following rules to amend the Ammonium Nitrate Rules, 2012, which Central Government proposes to make in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 read with section 14 of the Explosives Act, 1884 (4 of 1884) is hereby published as required by sub-section (1) of section 18 of the said Act for information of all persons likely to be affected thereby, and notice is hereby given that the said draft shall be taken into consideration after the expiry of a period of thirty (30) days from the date on which the copies of the Gazette of India containing this notification are made available to the public.
Objections or suggestions if any, to these draft rules may be sent to the Director (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 252-A, Udyog Bhavan, New Delhi – 110011 or Email: [email protected]; within the period specified above.
The objections or suggestions which may be received from any person with respect to the said draft rules within the period above so specified will be taken into consideration by the Central Government.
DRAFT RULE
1. Short titled and commencement:-
(1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2024.

in the Official Gazette.
3. In rule 2 of the Ammonium Nitrate Rules, 2012 (herein after referred to as said rules),
a. after clause (n), the following clauses shall be inserted namely:-
"(na) "Micro and Small Enterprises" means an enterprise defined in clause (h) and clause (m) of
section 2 of the Micro, Small and Medium Enterprises Development Act, 2006.
(nb) "Micro & Small Startup" means an entity registered with Department for Promotion of
Industry and Internal Trade, Ministry of Commerce and Industry and as defined in clause (a) of
paragraph 1 of the Gazette Notification having G.S.R. 127(E) dated 19th February, 2019".
b. after clause (s), the following clause shall be inserted namely:-
"(t) "Women Entrepreneur" means an enterprise owned and controlled by a woman having a
minimum financial interest of 26% of the capital".
3. For sub-rule (1) of the rule 29 of the said rules, the following shall be substituted, namely:-
"(1) The following fee shall be payable for prior approval, issuance of licences and amendment, namely:-

(1A) For the purpose of claiming relaxation in fees as mentioned in sub-rule (1) above, the applicant shall submit the following documents, namely:-
(a) Micro and Small Enterprises - Certificate issued by Ministry of Micro, Small and Medium Enterprises.
Provided that, above said relaxation shall only be applicable to Micro and Small Enterprises and not for Medium Enterprises.
(b) Micro and Small Startup - Documentary evidence towards registration with Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry
Provided that, above said relaxation shall only be applicable to Micro and Small Startup and not for Medium Startup.
(c) Women Entrepreneur - Documentary evidence towards Proprietor or Director of the firm or company5 [भाग II—खण्ड 3(i)] भारत का राजपत्र : असाधारण (1B) In case where Micro and Small Enterprises or Micro and Small Startup owned and controlled by a woman, the fees whichever is lower shall be applicable.
Provided that if information submitted by the applicant, is found to be false or misleading at any stage, the approval or license shall be liable to be cancelled".
