का.आ. 5464(अ).— के न्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और तत्कालीन पर्यावरण और वन मंत्रालय की अधिसूचना सं. का.आ. 1533(अ), तारीख 14 सितंबर, 2006 (जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है) के अनुसरण में दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र के लिए पर्यावरण समाघात निर्धारण प्राधिकरण (जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है) का गठन करती है, जिसमें निम्नलिखित सदस्य होंगे, अर्थात् :-
(क) श्री मनमोहन सिंह नेगी,

2. प्राधिकरण के अध्यक्ष और सदस्य राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से तीन वर्ष की अवधि के लिए पद धारण करेंगे ।
3. प्राधिकरण ऐसी शक्तियों का प्रयोग करेगा और ऐसी प्रयििा का अनुसरण करेगा जो उक्त अधिसूचना में विर्निर्दष्ट हैं ।
4. प्राधिकरण, अपना विनिश्चय पैरा 6 के अधीन गठित संघ राज्यक्षेत्र स्तरीय विशेषज्ञ मूल्यांकन समिति की सिफारिशों के आधार पर करेगा ।
5. प्राधिकरण के सभी विनिश्चय बैठक में किए जाएंगे और साधारणतया एकमत होंगे :
परंतु बहुमत द्वारा लिए गए विनिश्चय की दशा में, इसके समर्थन में और इसके विरुद्ध दृष्टिकोणों के ब्यौरे कार्यवृत्त में स्पष्ट रूप से अभिलेखबद्ध किए जाएंगे तथा उसकी एक प्रति कें रीय सरकार को भेजी जाएगी ।
6. के न्रीय सरकार, प्राधिकरण की सहायता के प्रयोजन के लिए दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र के परामर्श से दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र स्तरीय विशेषज्ञ मूल्यांकन समिति (जिसे इसमें इसके पश्चात् समिति कहा गया है) का गठन करती है जिसमें निम्नलिखित व्यक्ति होंगे, अर्थात् :-- (क) श्री सुजीत कु मार मरियप्पा डोंगरे,

(ग) वन संरक्षक, दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र - सदस्य-सचिव । 7. समिति के अध्यक्ष और सदस्य इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से तीन वर्ष की अवधि के लिए पद धारण करेंगे ।
8. समिति ऐसी शक्तियों का प्रयोग करेगी और ऐसी प्रयििाओं का पालन करेगी, जो उक्त अधिसूचना में विर्निर्दष्ट हैं। 9. समिति सामूहिक उत्तरदायित्व के सिद्धांत पर काम करेगी और अध्यक्ष प्रत्येक मामले में सर्वसम्मति पर पहुंचने का प्रयास करेगा और यदि सर्वसम्मति पर नहीं पहुंचा जा सकता है तो बहुमत का मत अभिभावी होगा ।
10. हितों के टकराव से बचने के लिए-
(i) प्राधिकरण के अध्यक्ष और सदस्य और समिति के अध्यक्ष और सदस्य-
(क) यह घोषित करेंगे कि वे किस परामर्श संगठन और परियोजना के प्रस्तावक से जुड़े हैं ;

(ख) किसी परियोजना के लिए पर्यावरणीय समाघात निर्धारण और पर्यावरण प्रबंधन योजना की तैयारी के लिए कोई परामर्श नहीं देगें या सहयोग नहीं करेंगे, जो उनके कार्यकाल के दौरान प्राधिकरण द्वारा विनिश्चित या समिति द्वारा मूल्यांकित की जानी है ; तथा
(ii) यदि पिछले पांच वषों में, अध्यक्ष या प्राधिकरण और समिति के किसी भी सदस्य ने किसी परियोजना प्रस्तावक के लिए परामर्श सेवाएं प्रदान की हैं या पर्यावरणीय समाघात निर्धारण अध्ययन संचालित किया है, तो उस स्थिति में वे स्वयं को ऐसे प्रस्तावकों द्वारा प्रस्तावित किसी भी परियोजना के मूल्यांकन की प्रयििा में प्राधिकरण और समिति की बैठक से बचाव करेंगे ।
11. दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र प्रशासन, प्राधिकरण और समिति के लिए सचिवालय के रूप में कार्य करने के लिए किसी अभिकरण को विर्निर्दष्ट करेगा और सभी सचिवालय वित्तीय और संभार तंत्र संबंधी सहायता, जिसके अंतर्गत वास-सुविधा, परिवहन और उक्त अधिसूचना के अधीन उनके कृ त्यों के संबंध में ऐसी अन्य सुविधाएं भी हैं, उपलब्ध कराएगा ।
12. प्राधिकरण तथा समिति के अध्यक्ष और सदस्यों की बैठक की फीस, यात्रा भत्ता और मंहगाई भत्ता संघ राज्यक्षेत्र प्रशासन के सुसंगत नियमों के उपबंधों के अनुसार संदत्त किए जाएंगे ।

NOTIFICATION
New Delhi, the 18th December, 2024
S.O. 5464(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the Union territory Level Environment Impact Assessment Authority for the Union territory of Dadra and Nagar Haveli and Daman and Diu (hereinafter referred to as the Authority) comprising of the following Members, namely: -
(a) Shri Manmohan Singh Negi,
- Chairman;
Doon Officers Enclave,
Wildlife Institute Road, Chandrabani,
Post Office-Mohabbewala,
Dehradun, Uttarakhand-248002
(b) Dr. Panchagnula Venkata Subba Rao,
- Member;
H.No.58, Saket Bhusattva, Gowdavalli Village,

(c) Chief Conservator of Forest,
- Member Secretary.

2. The Chairman and Members of the Authority, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette.
3. The Authority shall exercise such powers and follow such procedures as specified in the said notification.
4. The Authority shall take its decision on the recommendations of the Union territory Level Expert Appraisal Committee constituted under paragraph 6.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous:
Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government.
6. The Central Government, in consultation with the Union territory of Dadra and Nagar Haveli and Daman and Diu, for the purpose of assisting the Authority, hereby constitutes the Union territory Level Expert Appraisal Committee for Union territory of Dadra and Nagar Haveli and Daman and Diu (hereinafter referred to as the Committee), comprising of the following Members, namely: -
(a) Shri Sujeetkumar Mariappa Dongre,
- Chairman;

7. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette.
8. The Committee shall exercise such powers and follow such procedures as specified in the said notification.
9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.
10. In order to avoid any conflict of interest,-
(i) the Chairman and Members of the Authority and the Chairman and Member of the Committee shall,⸺ (a) declare to which consulting organisation they have been associated with and also the project proponents; and (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and
(ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority or the Committee in the process of appraisal of any project proposed by such proponents.
11. The administration of Union territory of Dadra and Nagar Haveli and Daman and Diu shall specify an agency to act as Secretariat of the Authority and the Committee and the Secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification.
12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee, shall be paid in accordance with the provisions of relevant rules of the Union territory administration.
