का.आ. 5496(अ).—जबकि फॉमू र्लेशन (i) बुडेसोनाइड 100 एमसीजी (ii) बुडेसोनाइड 200 एमसीजी और (iii) फॉमोटेरोल 6 एमसीजी + बुडेसोनाइड 100 एमसीजी डीपीसीओ, 2013 की अनुसूची-I के तहत अनुसूचित फॉमू र्लेशन हैं और उनकी अधिकतम कीमतें तय हैं।
2. और जबकि राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण (जिसे आगे एनपीपीए के रूप में संर्दर्भत किया जाएगा) को (i) बुडेसोनाइड 100 एमसीजी -200 एमडीआई, (ii) बुडेसोनाइड 200 एमसीजी -200 एमडीआई, और (iii) फॉमोटेरोल 6 एमसीजी + बुडेसोनाइड 100 एमसीजी -120 एमडीआई के लिए 'सिंक्रोब्रीद इनहेलर उपकरण' की अलग कीमत हेतु मेसर्स सिप्ला लिमिटेड से आवेदन प्राप्त हुआ था।
3. और जबकि, मेसर्स सिप्ला लिमिटेड का आवेदन 25.09.2024 को आयोजित अपनी 62वीं बैठक में विशेषज्ञों की बहु- विषयक समिति के समक्ष रखा गया था। समिति ने नोट किया कि वृशििील नवाचार को बढ़ावा देने के लिए फॉमू र्लेशन की कीमत का 20% के दर से एक अलग मूल्य पर विचार किया जा सकता है। तदनुसार, समिति ने डीपीसीओ, 2013 के पैरा 8208 GI/2024
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 11(3) के तहत मेसर्स सिप्ला लिमिटेड के लिए उपरोक्त पैरा 2 में र्निर्दष्ट फॉमू र्लेशन के लिए "सिंक्रोब्रीद इनहेलर उपकरण" हेतु फॉमू र्लेशन की अधिकतम कीमत के 20% की दर से एक अलग मूल्य की सिफारिश की।
4. और जबकि, एनपीपीए ने 12.12.2024 को आयोजित अपनी 128वीं बैठक में मेसर्स सिप्ला लिमिटेड के आवेदन पर विचार-विमर्श किया और डीपीसीओ 2013 के पैरा 11(3) के तहत उपरोक्त पैरा 2 में उल्लिखित फॉमू र्लेशन के लिए मेसर्स सिप्ला लिमिटेड के लिए प्रचलित अधिकतम मूल्य के 20% की दर से "सिंक्रोब्रीथ इनहेलर उपकरण" के लिए अलग मूल्य प्रदान किए जाने हेतु विशेषज्ञों की बहु-विषयक समिति की सिफारिशों को स्वीकार कर लिया।
5. इसलिए, भारत सरकार के रसायन एवं उर्वरक मंत्रालय द्वारा जारी दिनांक 30 मई, 2013 की अधिसूचना सं. 1394(ई) के साथ पठित औषधि (मूल्य नियंत्रण) आदेश, 2013 के पैराग्राफ 11(3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एनपीपीए एतद्द्वारा, मेसर्स सिप्ला लिमिटेड के लिए कॉलम (3) में र्निर्दष्ट इकाई के साथ कॉलम (2) में र्निर्दष्ट फॉमू र्लेशन के लिए सिंक्रोब्रीद इनहेलर उपकरण के संबंध में नीचे दी गई तालिका के कॉलम (4) में र्निर्दष्ट मूल्य को वस्तु एवं सेवा कर, यदि कोई हो, के अतिरिक्त मूल्य के रूप में निर्धारित करता है;

टिप्पणियां:
(क) कॉलम (4) में र्निर्दष्ट उपकरण की कीमत मेसर्स सिप्ला लि. के लिए कॉलम (2) में र्निर्दष्ट फॉमू र्लेशन पर लागू होगी (ख) मेसर्स सिप्ला लिमिटेड उपरोक्त तालिका के कॉलम (4) में र्निर्दष्ट मूल्य को सिंक्रोब्रीथ इनहेलर उपकरण के लिए उपरोक्त तालिका के (3) में र्निर्दष्ट इकाई के साथ कॉलम (2) में र्निर्दष्ट फॉमू र्लेशन के लागू अधिकतम मूल्य में जोड़ सकता है।
(ग) मेसर्स सिप्ला लि. वस्तु एवं सेवा कर तभी जोड़ सकता है, जब उसने वास्तव में भुगतान किया हो या यह उपरोक्त सारणी के कॉलम (4) में उल्लिखित मूल्य पर सरकार को यह राशि देय हो। {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण
(घ) मेसर्स सिप्ला लि. डीपीसीओ, 2013 के पैराग्राफ 24 के अनुसार अधिसूचना की तिथि से प्रपत्र- V में आईपीडीएमएस के माध्यम से एनपीपीए को मूल्य सूची जारी करेगा और राज्य औषधि नियंत्रक और वितरकों को इसकी एक प्रति प्रस्तुत करेगा।
(ड़) उपयु र्क्त तालिका के कॉलम (2) में र्निर्दष्ट फॉमू र्लेशन के लिए कॉलम (4) में र्निर्दष्ट सिंक्रोब्रीथ इनहेलर उपकरण की कीमत डीपीसीओ, 2013 के पैरा 16 के अनुसार थोक मूल्य सूचकांक (डब्ल्यूपीआई) के आधार पर संशोधित की जा सकती है।
(च) डीपीसीओ 2013 के पैरा 24(4) के अनुसार, प्रत्येक खुदरा विक्रे ता और वितरक को निर्माता द्वारा प्रस्तुत मूल्य सूची और अनुपूरक मूल्य सूची, यदि कोई हो, को परिसर के एक विशिष्ट भाग पर प्रर्दर्शत करना होगा, जहां वह व्यवसाय करता है, ताकि उसे देखने के इच्छु क किसी भी व्यक्ति के लिए यह आसानी से उपलब्ध हो।
(छ) उपकरण की उपयु र्क्त कीमत के वल मेसर्स सिप्ला लिमिटेड पर लागू है और संबंधित निर्माता/विपणन कं पनियों द्वारा सक्षम प्राधिकारी यानी कें द्रीय/राज्य लाइसेंसिंग प्राधिकरण से विनिर्माण लाइसेंस की अनुमति सहित प्रासंगिक कानूनों/नियमों के तहत सरकार द्वारा निर्धारित सभी लागू वैधानिक आवश्यकताओं की र्पूर्त के अधीन है। (ज) मेसर्स सिप्ला लिमिटेड आईपीडीएमएस के माध्यम से डीपीसीओ, 2013 की अनुसूची-II के प्रपत्र-III में ऊपर बताए गए फॉमू र्लेशन के साथ उपकरण के उत्पादन/आयात और बिक्री के संबंध में एनपीपीए को तिमाही रिटर्न प्रस्तुत करेगा। कोई भी निर्माता जो उपयु र्क्त अनुसूचित फॉमू र्लेशन का उत्पादन बंद करना चाहता है, उसे अनुसूचित फॉमू र्लेशन के उत्पादन और/या आयात को बंद करने के संबंध में डीपीसीओ, 2013 की अनुसूची-II के प्रपत्र-IV में अभिप्रेत तिथि से कम से कम छह महीने पहले एनपीपीए को जानकारी प्रस्तुत करनी होगी।
(झ) यदि उपकरण की कीमतों का तत्काल मूल्य अधिसूचना और ऊपर र्निर्दष्ट नोटों के अनुसार अनुपालन नहीं किया जाता है, तो मेसर्स सिप्ला लिमिटेड को आवश्यक वस्तु अधिनियम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रावधानों के तहत ब्याज के साथ अधिप्रभारित राशि जमा करनी होगी।

ORDER
New Delhi, the 19th December, 2024
S.O. 5496(E).—Whereas formulations (i) Budesonide 100mcg (ii) Budesonide 200mcg and (iii) Formoterol 6mcg + Budesonide 100mcg are scheduled formulation under Schedule-I of DPCO 2013 and their ceiling prices are fixed.
2. And whereas National Pharmaceutical Pricing Authority (hereinafter referred as NPPA) had received application from M/s Cipla Ltd for separate price of 'Synchrobreathe Inhaler Device' for the formulation (i) Budesonide 100mcg- 200 MDI, (ii) Budesonide 200mcg-200 MDI, and (iii) Formoterol 6mcg + Budesonide 100mcg-120 MDI.
3. And whereas, the application of M/s Cipla Limited was placed before the Multidisciplinary Committee of Experts in its 62nd meeting held on 25.09.2024. The Committee noted that a separate price @20% of the price of the formulations could be considered to promote incremental innovation if the same is supported by published literature. Accordingly, it recommended a separate price for "Synchrobreathe Inhaler Device" for the formulations specified in Para 2 above for M/s Cipla Ltd under Para 11(3) of DPCO,2013 @20% of the prevailing ceiling price of the formulation.
4. And whereas, NPPA in its 128th meeting held on 12.12.2024 deliberated upon the application of M/s Cipla Limited and accepted the recommendations of the Multidisciplinary Committee of Experts to give separate price for4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] "Synchrobreathe Inhaler Device" @ 20% of the prevailing ceiling price for M/s Cipla Limited for the formulations mentioned in Para 2 above under para 11(3) of DPCO 2013.
5. Therefore, in exercise of powers, conferred by paragraph 11(3) of the Drugs (Prices Control) Order, 2013 read with S.O. No. 1394(E) dated the 30th May, 2013 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the NPPA, hereby fixes, the price as specified in column (4) of the table herein below as the price exclusive of goods and services tax, if any, in relation to the Synchrobreathe Inhaler Device for the formulation specified in column (2) with the unit as specified in column (3) for M/s Cipla Ltd;

Notes:
(a) The price of device as specified in column (4) would be applicable to formulation as specified in column (2) for M/s Cipla Ltd.
(b) M/s Cipla Ltd may add the price as specified in column (4) of the above table to the ceiling price, as applicable of the formulation as specified in column (2) with the unit as specified (3) of the above table for Synchrobreathe Inhaler Device.
(c) M/s Cipla Ltd may add goods and services tax only if they have paid actually or it is payable to the Government on the price mentioned in column (4) of the above said table.
(d) M/s Cipla Ltd shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers.
(e) The price of the Synchrobreathe Inhaler Device as specified in column (4) for the formulations as specified in column (2) of the above said table may be revised based on Wholesale Price Index (WPI) as per para 16 of DPCO, 2013.
(f) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same.
(g) The above-mentioned price of the device is applicable only to M/s Cipla Ltd and subject to fulfilment of all the applicable statutory requirements as laid down by the Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned manufacturer/marketing companies.
(h) M/s Cipla Ltd shall furnish quarterly return to the NPPA, in respect of production / import and sale of the device with the formulation as stated hereinabove in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.
(i) In case the price of the device is not complied as per the instant price notification and notes specified hereinabove, then M/s Cipla Ltd shall be liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO, 2013 read with the Essential Commodities Act, 1955.
