नं. स्थाIII/आरआरआर.एनआरआरजी/5/2024-स्था.III.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पूर्वोत्तर इंदिरा गांधी क्षेत्रीय स्वास्थ्य एवं आयुर्विज्ञान संस्थान, शिलांग में सह प्राध्यापक, कॉलेज ऑफ नर्सिंग के पद पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं-
1. संक्षिप्त नाम और प्रारम्भ – (1) इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्रालय, पूर्वोत्तर इंदिरा गांधी क्षेत्रीय स्वास्थ्य एवं आयुर्विज्ञान संस्थान, शिलांग नर्सिंग शिक्षण संकाय (ग्रुप 'ए') पद भर्ती संशोधन नियम, 2024 इसकी प्रस्तावना के साथ है।
(2) वे राजपत्र में उनके प्रकाशन की तारीख से लागू होंगे।
2. पद की संख्या, वर्गीकरण व वेतन मैट्रिक्स में स्तर - उक्त पद की संख्या, उसका वर्गीकरण और वेतन मैट्रिक्स में स्तर वह होगा जो इन नियमों की उपबंध अनुसूची के कॉलम 2 से 4 में विनिर्दिष्ट हैं।
3. भर्ती की पद्धति, आयु-सीमा, अन्य अर्हताएँ आदि - भर्ती की पद्धति, आयु-सीमा, अर्हताएँ और संबन्धित अन्य बातें वे होंगी जो कि उक्त अनुसूची के स्तम्भ (5) से स्तम्भ (13) में विनिर्दिष्ट हैं।
4. निरर्हता – वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति, जिसका पति या जिसकी पत्नी जीवित है, से विवाह किया है या विवाह की संविदा की है, या

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, उक्त पद पर नियुक्ति का पात्र नहीं होगा।
परंतु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
5. शिथिल करने की शक्ति - जहाँ कें द्र सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा स्वास्थ्य और परिवार कल्याण मंत्रालय से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्ति या पद की बाबत, आदेश द्वारा शिथिल कर सकती है। 6. व्यावृत्ति– इन नियमों की कोई बात ऐसे आरक्षण, आयु सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जंजातियों, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिकों और अन्य विशेष वर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।
प्रस्तावना
| 1. | स ंक्षिप्त नाम और प्रारम्भ | क | स ंस्थान के नियमों के नियम 6 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए नर्सिंग शिक्षण संकाय पदों से संबंधित पदों को कें द्र सरकार की मंजूरी से शासी परिषद निम्नलिखित नियम बनाती है जिन्हें पूर्वोत्तर इंदिरा गांधी क्षेत्रीय स्वास्थ्य एवं आयुर्विज्ञान संस्थान, शिलांग के भर्ती संशोधन नियम – 2024 कहा जा सकता है। व े राजपत्र अधिसूचना जारी होने की तारीख से प्रभावी होंगे। |
| 2. | उद्देश्य | शिक्षण के मानक को बनाए रखने हेतु न्यूनतम योग्यता और अनुभव वाले सह प्राध्यापक,कॉलेज ऑफ नर्सिंग की नियुक्ति एक अहम आवश्यकता है। | |
| 3. | परिभाषा | क | तदर्थ (अल्पकालिक) नियुक्ति: अल्पावधि अवधि के लिए की गई नियुक्ति जहाँ नियमित चयन में विलंब की परिकल्पना की गई है और पद को तत्काल भरने की आवश्यकता है। |
| ख | नर्सिंग शिक्षण संकाय पद: इन नियमों की अनुसूची में शामिल पद। | ||
| ग | नियुक्ति/सक्षम प्राधिकारी: किसी पद पर नियुक्ति करने हेतु सक्षम प्राधिकारी। | ||
| घ | अनुबंध अधिकारी: व्यक्ति जिसे अनुबंध के आधार पर नियुक्त किया गया हो। | ||
| ङ | क ै डर: किसी सेवा या सेवा के एक हिस्से की क्षमता को एक अलग इकाई के रूप में मंजूरी दी गई है। | ||
| च | भर्ती का तरीका: भर्ती निम्नलिखित तरीकों से की जाएगी; "सीधी भर्ती द्वारा, अन्यथा प्रतिनियुक्ति द्वारा (अल्पकालिक अनुबंध सहित) य े पद सीधी भर्ती से भरे जाएंगे और ऐसा न कर पाने की स्थिति में प्रतिनियुक्ति या अल्पावधि अनुबंध से भरे जाएंगे। सीधी भर्ती के मामले में, योग्य विभागीय उम्मीदवारों को भी प्रतिस्पर्धा करने की अनुमति दी जाएगी। हालाँकि, ट्यूटर के पद के संबंध में, भर्ती की पद्धति के वल सीधी भर्ती द्वारा की जाएगी। | ||
| छ | कार्यवाहक नियुक्ति: किसी रिक्त पद पर कार्य करने हेतु संस्थान के कर्मचारी की नियुक्ति। | ||
| ज | परिवीक्षा: स ंस्थान में स्थायी सेवा/पद पर कर्मचारी की उपयुक्तता का मूल्यांकन करने | ||
| हेतु ट्राइल बेसिस पर नियुक्ति। यदि संस्थान की राय में अधिकारी स्थायी नियुक्ति के लिए उपयुक्त नहीं पाया जाता है, तो उसे सेवामुक्त किया जा सकता है या सेवा में उसके द्वारा धारित पिछले पद पर वापस भेजा जा सकता है या परिवीक्षा की अवधि बढ़ा दी जा सकती है। यह अस्थायी पद पर तथा प्रतिनियुक्ति/संविदा नियुक्ति पर भी लागू नहीं होगा। परिवीक्षा की अवधि अनुसूची में कॉलम संख्या 9 में उल्लिखित है। | |||
| झ | स्थायी पद: एक निश्चित वेतन दर वाला पद जिसे बिना किसी निश्चित समय सीमा के स्वीकृ त किया जाता है। | ||
| ञ | स्नातकोत्तर योग्यता: स्नातकोत्तर योग्यता का मतलब भारतीय नर्सिंग काउं सिल अधिनियम के अनुसार मान्यता प्राप्त स्नातकोत्तर योग्यता है। | ||
| ट | योग्यता: इन नियमों की अनुसूची के अनुसार प्रत्येक पद के लिए अनुभव सहित शैक्षणिक और व्यावसायिक योग्यताएं निर्धारित की गई हैं। | ||
| ठ | चयन का तरीका: निम्नलिखित में से एक या अधिक तरीकों के माध्यम से नियुक्ति के लिए चयन किया जा सकता हैं- (i) साक्षात्कार, (ii) लिखित और/या व्यावहारिक परीक्षण (iii) मूल्यांकन या उपयुक्तता की कोई अन्य मान्यता प्राप्त विधि द्वारा। | ||
| ड | व ेतनमान: जो किसी विशेष पद से जुड़े न्यूनतम से आवधिक वेतन वृद्धि द्वारा बढ़ता है। | ||
| ढ़ | स्थायी चयन समिति: नीग्रिम्स, शिलांग के ग्रुप ए संकाय पदों के लिए स्थायी चयन समिति की स ंरचना के अनुसार चयन समिति का वतर्मान गठन निमन्वत हुआ है: 1. अध्यक्ष (शासी परिषद द्वारा नामित) 2. सचिव (एच एंड एफडब्ल्यू) का नामांकित व्यक्ति या उसका नामांकित व्यक्ति (संयुक्त सचिव के पद से नीचे का नहीं) 3. डीजीएचएस या उसका नामांकित व्यक्ति (अपर डीजीएचएस के पद स नीचे नहीं) े 4. निदेशक, एम्स, नई दिल्ली या उनके नामांकित व्यक्ति। 5. निदेशक, पीजीआईएमईआर या उनके नामांकित व्यक्ति। 6. कु लपति, नॉर्थ ईस्टर्न हिल यूनिवर्सिटी (नेहु),शिलांग के नामांकित व्यक्ति। 7. सदस्य, शासी परिषद। 8. सदस्य, शासी परिषद। 9. स्पेशलिटी/सुपर स्पेशलिटी के क्षेत्र में दो विशेषज्ञ। 10. नीग्रिम्स या किसी अन्य संगठन में उपयुक्त उपयुक्त पद पर काम करने वाला अनुसूचित जाति/अनुसूचित जनजाति का एक प्रतिनिधि। 11. नीग्रिम्स या किसी अन्य संगठन में कार्यरत अल्पसंख्यकों और उपयुक्त पद का एक प्रतिनिधि। 12. निदेशक, नीग्रिम्स– सदस्य सचिव। | ||
| 4 | भर्ती करने की प्रक्रिया | क | विभिन्न श्रेणियों के पदों पर भर्ती के लिए अपनाई जाने वाली प्रक्रिया वही होगी जो प्रत्येक श्रेणी के लिए नियुक्ति प्राधिकारी द्वारा निर्धारित की जाएगी। नियुक्ति प्राधिकारी उम्मीदवारों की उपयुक्तता का आकलन करने हेतु अपनाई जाने वाली प्रक्रिया निर्धारित कर सकता है, जिसमें लिखित परीक्षा, |
| व्यावहारिक परीक्षा, व्यक्तिगत साक्षात्कार आयोजित करना आदि शामिल हो सकते हैं। इसके अतिरिक्त दिए गए विवरणों एवं आवेदन और रेफरल से प्राप्त रिपोर्ट(यदि कोई हो) आदि के आधार पर भी उम्मीदवारों पर विचार कर सकता है। आवश्यक होने पर नियुक्ति प्राधिकारी संस्थान के हित में किसी विशेष पद के लिए कोई विशेष योग्यता/आवश्यकताएं निर्धारित कर सकता है। | |||
| ख | समूह 'ए' पदों पर चयन पूर्वोत्तर इंदिरा गांधी क्षेत्रीय स्वास्थ्य एवं आयुर्विज्ञान संस्थान, शिलांग के नियम 9 द्वारा गठित स्थायी चयन समिति की सिफारिशों पर किया जाएगा। किसी पद पर कोई नियुक्ति तब तक नहीं की जाएगी जब तक कि पद पूर्वोत्तर इंदिरा गांधी क्षेत्रीय स्वास्थ्य एवं आयुर्विज्ञान संस्थान, शिलांग के नियम 15 और 16 के अनुसार सृजित न किया गया हो और पद विशेष की नियुक्ति के लिए सक्षम प्राधिकारी की मंजूरी प्राप्त न कर ली गई हो। | ||
| 5 | प्रतिनियुक्ति/संविदा पर नियुक्ति | य े पद के वल 'तत्काल अवशोषण आधार' क्लॉज़ की छू ट के साथ 5 वर्ष की अवधि के लिए प्रतिनियुक्ति पद्धति से भरे जाएंगे। समान पदों पर या एक स्तर नीचे के पदों पर काम करने वाले व्यक्ति विचार के पात्र होंगे, बशर्ते कि व े सीधी भर्ती हेतु पद के लिए निर्धारित अपेक्षित योग्यता और अनुभव को पूरा करते हों। प्रतिनियुक्ति की अवधि सामान्यतः एक समय में 5 वर्ष से अधिक नहीं होगी। अनुबंध पर भरे जाने वाले पदों के मामले में, अपेक्षित योग्यता और अनुभव रखने वाले और 65 वर्ष की आयु सीमा पार न करने वाले व्यक्ति विचार के पात्र होंगे। | |
| 6 | विशेषज्ञों की नियुक्ति | राष्ट्रपति के अनुमोदन से निदेशक विशेषज्ञों को आमंत्रित कर सकते हैं जिनमें स ंस्थान के संकाय के सदस्य और बाहर से ऐसे अन्य लोग शामिल हो सकते हैं जो संस्थान में शिक्षण पद/पदों और ऐसे अन्य पद/पदों पर उपयुक्त उम्मीदवारों का चयन करने में चयन समिति की सहायता कर सके । | |
| 7 | नियुक्ति की शर्तें | क | स ंस्थान में विभिन्न पदों पर नियुक्ति के लिए वेतनमान, भर्ती का तरीका, प्रवेश के समय ऊपरी आयु सीमा, योग्यताएं आदि इन नियमों की अनुसूची क े अनुसार होंगी। |
| ख | उन पदों के लिए जो अनुसूची में उपलब्ध नहीं हैं, लेकिन सक्षम प्राधिकारी क े अनुमोदन से बनाए और स्वीकृ त किए गए हैं, योग्यता, अनुभव, प्रवेश के समय ऊपरी आयु, सीमा, भर्ती के तरीके आदि नियुक्ति प्राधिकारी द्वारा निर्धारित किया जा सकता है और उसे इन नियमों की अनुसूची में शामिल किया माना जाएगा। | ||
| ग | इन नियमों की अनुसूची में सक्षम प्राधिकारी द्वारा किसी भी प्रविष्टि के स ंबंध में किए गए किसी भी संशोधन/संशोधन/परिवर्तन को अनुसूची में शामिल किया गया माना जाएगा। ठीक इसी प्रकार सक्षम प्राधिकारी के आदेश द्वारा समाप्त किये गये पद इन नियमों की अनुसूची से हटाये गये माने जायेंगे। | ||
| 8. | स्क्रीनिंग समिति | सह प्राध्यापक, कॉलेज ऑफ नर्सिंग पदों के सभी आवेदनों की जांच निदेशक द्वारा गठित एक स्क्रीनिंग समिति द्वारा की जाएगी। | |
| 9. | शैक्षणिक योग्यता/अनुभव | सह प्राध्यापक, कॉलेज ऑफ नर्सिंग पदों के संबंध में शैक्षणिक योग्यता और अनुभव चयन समिति के विवेकाधीन है ताकि चयन समिति शिथिल शैक्षणिक योग्यता और अनुभवी उम्मीदवारों का साक्षात्कार ले सके । | |
| 10. | अनुभव | अपेक्षित अनुभव पूरे किए जाने तक की प्रभावी तिथि आवेदन जमा करने की अंतिम तिथि के अनुसार मानी जाएगी। | |
| 11. | कार्य आवश्यकता | विशिष्ट विशेषज्ञता की जहां आवश्यकता हो, उन पदों के समक्ष विशिष्ट कार्य आवश्यकताओं को दर्शाया जाना चाहिए। | |

NOTIFICATION

No. ESTIII-RRR0NRRG/5/2024-Estt.III.—In exercise of the powers conferred by proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Associate Professor, College of Nursing in North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong:-
1. Short title and commencement – (1) These rules may be called the Ministry of Health and Family Welfare, North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong Nursing Teaching Faculty posts (Group 'A') Recruitment amendment Rules, 2024 along with its preamble.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in Pay Matrix – The number of the said post, its classification and level in the Pay Matrix attached thereto shall be specified in columns 2 to 4 of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, other qualifications, etc. – The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification – No person,
(a) Who has entered into or contracted a marriage with a person having a spouse living: or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

Power to Relax – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Ministry of Health & Family Welfare, relax any of the provisions of these rules with respect to any class or category of persons or posts.
6. Saving – Nothing in these rules shall affect reservation relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen, Persons with Disabilities and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
PREAMBLE
| 1. | Short Tile and application | a. | In exercise of the powers conferred under Rule 6 of the Rules of the Institute, the Governing Council with sanctioned of the Central Government in so far as they relate to the Nursing Teaching Faculty posts only, hereby makes the following rules which may be called the North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences Recruitment Amendment Rules – 2024. I t shall come into effect from the date of issue of the Gazette Notification. |
| 2. | Objectives | Appointment of Associate Professor, College of Nursing with minimum qualification and experience are a necessary requirement to maintain a standard of teaching. | |
| 3. | Definition | a. | Ad-hoc (short term) appointment: Appointment made for a short-term period where delay in regular selection is envisaged and the post is required to be filled up urgently. |
| b. | Nursing Teaching Faculty posts: Posts included in Schedule of these Rules. | ||
| c. | Appointment/Competent Authority: The Competent Authority to make appointment to a post. | ||
| d. | Contract Officer: A person appointed on contract basis. | ||
| e. | Cadre: The strength of a service or a part of service sanctioned as a separate unit. | ||
| f. | Mode of Recruitment: The recruitment will be carried out in the following manners; "By direct recruitment failing which by deputation (including short term contract) These posts shall be filled up by direct recruitment failing which by deputation or short term contract. | 4 | Procedure for making recruitments: | a. | The procedure to be followed for making recruitment to various categories of posts shall be as may be prescribed by the appointing authority for each category. T he appointing authority may determine the procedure to follow for assessing the suitability of the candidates in making selection/s, which may include written test, practical test, holding of personal interview etc. It may also consider candidates on the basis of the particulars furnished in the application and the reports received from the referees, if any. The appointing authority may where necessary, prescribe any special qualification/requirements for any particular post in the interest of the Institute. |
| b. | Selection to Group 'A' posts shall be made on the recommendations of the Standing Selection Committee constituted by the Institute Rule 9 of the Rules of the North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong. No appointment to a post shall be made unless the post is created in accordance with Rule 15 & 16 of the Rules of the North Eastern Indira Gandhi Regional Institute of Health & Medical Sciences, Shillong and approval of the Competent Authority has been obtained for the particular appointment. | ||
| 5 | Appointment on Deputation/Contract | The posts will be filled up by the method of deputation for a period of 5 years only in exemption of the clause on 'Immediate Absorption Basis'. Persons working in the analogous posts or in posts one level below shall be eligible for consideration provided they fulfil the requisite qualification and experience prescribed for the post as for a direct recruit. The period of deputation shall ordinarily not exceed 5 years at a time. In case of posts to be filled up on contract, persons having requisite qualifications and experience and who have not crossed the age of 65 years will be eligible for consideration. | |

| c. | Any modifications/amendments/changes made in respect of any entries in Schedule to these Rules by the competent authority, shall be deemed to have been incorporated in the Schedule. Similarly posts abolished by the order of the competent authority shall be deemed to have been deleted from the Schedule of these Rules. | ||
| 8. | Screening Committee | All applications for the post of Associate Professor, College of Nursing will be scrutinized by a Screening Committee constituted by the Director. | |
| 9. | Academic Qualification / Experience | The academic qualification and experience in respect of the post of Associate Professor, College of Nursing are relaxable at the discretion of the Selection Committee in order to enable the Selection Committee to interview the candidates with relaxed academic qualification & experience. | |
| 10. | Experience | The effective date upto which the requisite experience must be completed would be reckoned as on the last date of submission of application(s) | |
