का.आ. 5614(अ).—रेलवे अधिनियम, 1989 (1989 का 24) की धारा 20ए की उप-धारा (आई) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, संशोधन अध्यादेश 2008 (इसके बाद उक्त के रूप में संदर्भित किया गया है) अधिनियम), कें द्र सरकार, इस बात से संतुष्ट होने के बाद कि सार्वजनिक उद्देश्य के लिए, भूमि, जिसका संक्षिप्त विवरण यहां संलग्न अनुसूची में दिया गया है, विशेष रेलवे परियोजना, अर्थात् मियागाम कर्जन-लकोदरा के निष्पादन के लिए आवश्यक है। गुजरात राज्य के जिला वडोदरा में फ्लाईओवर कनेक्शन लाइन परियोजना, इसके द्वारा ऐसी भूमि का अधिग्रहण करने के अपने इरादे की घोषणा करती है;

उक्त भूमि में रुचि रखने वाला कोई भी व्यक्ति, आधिकारिक राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से तीस दिनों की अवधि के भीतर, उप-धारा (आई) के तहत उपरोक्त उद्देश्य के लिए ऐसी भूमि के अधिग्रहण और उपयोग पर आपत्ति उठा सकता है। उक्त अधिनियम की धारा 20डी;

ऐसी प्रत्येक आपत्ति सक्षम प्राधिकारी, अर्थात् सक्षम प्राधिकारी और प्रांत अधिकारी करजन, पहली मंजिल, तालुका सेवासदन करजन, एनएच -48 के पास, करजन, जिला वडोदरा को लिखित रूप में की जाएगी और उसके आधार 8390 GI/2024

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और सक्षम प्राधिकारी को निर्धारित किया जाएगा। आपत्तिकर्ता को व्यक्तिगत रूप से या कानूनी व्यवसायी द्वारा सुनवाई का अवसर दिया जाएगा और दिया जा सकता है। ऐसी सभी आपत्तियों को सुनने के बाद और ऐसी आगे की जांच करने के बाद, यदि कोई हो, सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा, या तो आपत्तियों को अनुमति दें या अस्वीकार करें;

उक्त अधिनियम की धारा 20(डी) की उपधारा (II) के तहत सक्षम प्राधिकारी द्वारा किया गया कोई भी आदेश अंतिम होगा;

इस अधिसूचना के अंतर्गत आने वाली भूमि की भूमि योजना और अन्य विवरण उपलब्ध हैं और इच्छु क व्यक्ति सक्षम प्राधिकारी के उपरोक्त कार्यालय में इसका निरीक्षण कर सकते हैं।

NOTIFICATION

Mumbai, the 27th December, 2024

S.O. 5614(E).—In exercise of the powers conferred by sub-section(I) of section 20A of the Railways Act, 1989 (24 of 1989) Amendment ordinance 2008 (herein after referred as the said act), the Central Government, after being satisfied that for the public purpose, the land, the brief description of which has given in the schedule annexed hereto, is required for execution of the Special Railway Project, namely, Miyagam Karjan-lakodara flyover connection line Project in District Vadodara in the State of Gujarat, hereby declares its intention to acquired such land ;

Any person interested in the said land may, within a period of thirty days from the date of publication of this notification in the Official Gazette, raise objection to the acquisition and use of such land for the aforesaid purpose under sub-section(I) of section 20D of the said Act;

Every such objection shall be made to the competent authority, namely, Competent authority and Prant Officer Karjan, 1st floor, Taluka Sevasadan Karjan, Near NH-48, Karjan, District Vadodara,in writing and shall set out the grounds thereof and the competent authority shall give the objector an opportunity of being heard, either in person or by legal practitioner and may. After hearing all such objections and after making such further enquiry, if any as the competent authority thinks necessary , by order, either allow or disallow the objections;

Any order made by the competent authority under sub-section(II) of section 20(D) of the said act shall be final;

The land plan and other details of the land covered under this notification are available and can be inspected by the interested person at the aforesaid office of the competent authority.
