प्रत्याहार आदेश

फा.सं. 18-18/9993.-आईएनसी-समय-समय पर यथासंशोधित भारतीय उपचर्या परिषद् अधिनियम, 1947 (1947 का XLVIII) की धारा 14 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय उपचर्या परिषद् एतद्द्वारा निम्नलिखित आदेश जारी करती है :-
जबकि, स्वामी विवेकानन्द स्कूल ऑफ नर्सिंग, चौबे कॉलोनी, छतरपुर, जिला छतरपुर-47100 (मध्य प्रदेश) मध्य प्रदेश राज्य सरकार तथा मध्य प्रदेश नर्स पंजीकरण परिषद् द्वारा एएनएम, जीएनएम तथा बी.एससी. (नर्सिंग) पाठ्यक्रम संचालित करने के लिए मान्यता प्राप्त है।
वहीं, भारतीय उपचर्या परिषद् अधिनियम, 1947 की धारा 14 के तहत मान्यता रद्द करने के लिए प्रधान सचिव, स्वास्थ्य एवं परिवार कल्याण विभाग, मध्य प्रदेश राज्य सरकार, कमरा संख्या 241, मंत्रालय (वल्लभ भवन) एरेरा हिल्स, भोपाल-462004, मध्य प्रदेश को संबोधित नोटिस संख्या 18-18/9993-आईएनसी (52873) दिनांक 26.02.2024 को जारी किया गया था। दिनांक 26.02.2024 को जारी नोटिस की एक प्रति स्वामी विवेकानन्द स्कूल ऑफ नर्सिंग, चौबे कॉलोनी, छतरपुर, जिला छतरपुर-47100 (मध्य प्रदेश) को भी भेजी गई थी। जारी किए गए नोटिस में राज्य सरकार से नर्सिंग संस्थान की उपयुक्तता के संबंध में परिषद् को अपनी सिफारिशें प्रस्तुत करने का अनुरोध किया गया था। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] चूंकि, स्वामी विवेकानन्द स्कूल ऑफ नर्सिंग के संबंध में परिषद् को राज्य सरकार से कोई अनुशंसा प्राप्त नहीं हुई है। यहां तक कि संस्था यानी स्वामी विवेकानन्द स्कूल ऑफ नर्सिंग ने भी जारी किए गए नोटिस का कोई जवाब नहीं दिया है।
वहीं, परिषद् द्वारा इस मामले पर समग्र विचार किया गया है। दिनांक 14.04.2023 की निरीक्षण रिपोर्ट के अवलोकन से पता चलता है कि संस्थान में कई मामलों में कमी है, विशेष रूप से वे कमियां जो नैदानिक और शिक्षण सुविधाओं से संबंधित हैं। ये गंभीर कमियां हैं जिसका मतलब है कि संस्थान एएनएम, जीएनएम तथा बी.एससी. (नर्सिंग) पाठ्यक्रमों का संचालन करने में असमर्थ है।
अतः, धारा 14(3)(बी) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए परिषद् यह घोषणा करती है कि दिनांक 21.05.2024 से स्वामी विवेकानन्द स्कूल ऑफ नर्सिंग, चौबे कॉलोनी, छतरपुर, जिला छतरपुर-47100 (मध्य प्रदेश) से एएनएम, जीएनएम तथा बी.एससी. (नर्सिंग) मान्यता प्राप्त योग्यता धारक प्रत्येक व्यक्ति केवल मध्य प्रदेश राज्य में पंजीकृत होने का हकदार होगा।

INDIAN NURSING COUNCIL
WITHDRAWAL ORDER
New Delhi, the 19th November, 2024
F.No. 18-18/9993-INC.—In exercise of the powers conferred under Section 14 of Indian Nursing Council Act, 1947 (XLVIII of 1947), the Indian Nursing Council hereby issues the following order:—
Whereas, Swami Vivekanand School of Nursing situated at Choubey Colony, Chhatarpur, Distt. Chhatarpur 471001 Madhya Pradesh is recognized by State Government of Madhya Pradesh and Madhya Pradesh Nurses Registration Council to conduct ANM, GNM and B.Sc(N) Course.
Whereas, a notice no. 18-18/9993-INC (52873) dated 26/02/2024 for withdrawal of Recognition under section 14 of Indian Nursing Council Act, 1947 addressed to the principal Secretary, Department of Health and Family Welfare, Government of Madhya Pradesh Room No. 241, Mantralaya (VallabhBhawan) Area Hills, Distt. Bhopal 462004 Madhya Pradesh was issued. Copy of the notice dated 26/02/2024 was also enclosed to, Swami Vivekanand School of Nursing situated at Choubey Colony, Chhatarpur, Distt. Chhatarpur 471001 Madhya Pradesh. In the notice issued, the State Government was requested to submit their recommendations to the Council as respects Suitability of the nursing institution.
Whereas, the Council has not received any recommendation from the State Government as respects the case of Swami Vivekanand School of Nursing Even the institution Swami Vivekanand School of Nursing has not responded to the notices issued.
Whereas, the Council has considered the matter in its entirety. Perusal of the inspection report dated 12/04/2023 would show that the institution is deficient in many respects especially those relating to deficiencies i.e., clinical and teaching facilities. These are serious deficiencies which constitute that the institution is unable to run ANM, GNM and B.Sc.(N) Course.
Now therefore, the Council exercising powers under section 14(3) (b) declares that with effect from 21/05/2024 any person holding a recognized qualification of ANM, GNM and B.Sc(N) from Swami Vivekanand School of Nursing situated at Choubey Colony, Chhatarpur, Distt. Chhatarpur 471001 Madhya Pradesh shall be entitled to be registered only in the State of Madhya Pradesh.
