का.आ. 5634(अ).— जबकि मेसर्स रिन्यू सूर्या विहान प्राइवेट लिमिटेड, आवेदक ने जिसका रजिस्टर्ड ऑफ़िस 138 अंसल चैम्बर-II, भीकाजी कामा प्लेस, दिल्ली-110066 पर स्थित है, ने जैसलमेर, राजस्थान में अपने 200 MW सोलर पावर प्लांट के लिए रिन्यू सूर्या विहान प्राइवेट लिमिटेड को कनेक्टिविटी प्रदान करने हेतु ट्रांसमिशन स्कीम में शामिल डेडिके टेड ओवरहेड ट्रांसमिशन लाइन बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत प्राधिकृ त करने हेतु आवेदन किया है।
और जबकि, कें द्रीय विद्युत प्राधिकरण (CEA) विद्युत मंत्रालय, भारत सरकार ने अपने फाइल नं. CEA-PS-11-21(25)/1/2020-PSPA-I Division/363-364 दिनांकित 05.09.2022 के अंतर्गत जैसलमेर, राजस्थान में अपने 200 MW सोलर पावर प्लांट के लिए रिन्यू सूर्या विहान प्राइवेट लिमिटेड को कनेक्टिविटी प्रदान करने हेतु ट्रांसमिशन स्कीम में शामिल डेडिके टेड ओवरहेड ट्रांसमिशन लाइन बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 68(1) के अंतर्गत पूर्व अनुमोदन प्रदान किया था।
मेसर्स रिन्यू सूर्या विहान प्राइवेट लिमिटेड ने प्रस्तावित ट्रांसमिशन मार्ग के बारे में स्थानीय अखबारों, द इंडियन एक्सप्रेस (अंग्रेजी में) दिनांक 18.11.2023 और दैनिक नवज्योति (हिन्दी में) दिनांक 18.10.2023, प्रभात 8465 GI/2024
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अभिनंदन (हिन्दी में) दिनांक 18.10.2023, तथा भारत के साप्ताहिक राजपत्र दिनांक 04.11.2023 में प्रकाशन की तारीख से दो महीनों के भीतर आम जनता से अवलोकन/प्रतिनिधित्व की मांग करते हुए नोटिस प्रकाशित किया था। इसके पश्चात, मेसर्स रिन्यू सूर्या विहान प्राइवेट लिमिटेड, ने दिनांकित 19.11.2024 को एक हलफनामा प्रस्तुत किया, जिसमें घोषणा की गई थी कि भारत के शासकीय राजपत्र में सार्वजनिक सूचना के प्रकाशन के दो महीनों के भीतर जनता से कोई अवलोकन/ प्रतिनिधित्व प्राप्त नहीं हुआ है।
और अब आवेदक ने विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत रिन्यू सूर्या विहान प्राइवेट लिमिटेड के लिए डेडिके टेड ओवरहेड ट्रांसमिशन लाइन बिछाने के लिए उन्हें वे सभी शक्तियां प्रदान करने का अनुरोध किया है, जो टेलीग्राफ लाइन्स के प्रयोजन के लिए सरकार द्वारा स्थापित टेलीग्राफ लाइन्स और खंबों या उनके रख-रखाव के लिए भारतीय टेलीग्राफ अधिनियम 1885 के अंतर्गत टेलिग्राफ प्राधिकरण के पास है। इस स्कीम के अंतर्गत निम्नलिखित ओवरहेड लाइन्स शामिल हैं:
• रिन्यू सूर्या विहान प्राइवेट लिमिटेड सोलर पावर प्लांट-फतेहगढ़- III PS 220 kV S/C लाइन।
इस योजना के अंतर्गत ओवरहेड पारेषण लाइनें राज्य के निम्नांकित गाँवों, कस्बों और शहरों से होकर, उन पर से, उनके आसपास से और बीच से होकर गुज़रेगी।

अब, सावधानीपूर्वक विचार करने के पश्चात, विद्युत मंत्रालय, भारत सरकार, विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत मेसर्स रिन्यू सूर्या विहान प्राइवेट लिमिटेड को उपरोक्त ओवरहेड ट्रांसमिशन लाइन को लगाने के लिए वे सभी शक्तियां निम्नलिखित निबंधनों एवं शतों के साथ प्रदान करता है, जो टेलीग्राफ के उद्देश्य के लिए सरकार द्वारा स्थापित टेलीग्राफ लाइनों और खंबों या उनके रख-रखाव के लिए भारतीय टेलीग्राफ अधिनियम, 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास है
यह अनुमोदन 25 वषों के लिए प्रदान किया जाता है।
i. आवेदक को प्रस्तावित लाइनों की स्थापना से पूर्व संबंधित प्राधिकारियों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी।
ii. आवेदक को विद्युत अधिनियम, 2003 के अंतर्गत समुचित आयोग के द्वारा तैयार किए गए पारेषण, ओ एंड एम, ओपन एक्सेस आदि के विनियमों/संहिताओं का पालन करना होगा।
iii. आवेदक कें द्र सरकार के विद्युत निरीक्षक/मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात ही लाइनों का प्रचालन करेगा।
iv. यह अनुमोदन आवेदक द्वारा विद्युत अधिनियम, 2003 के प्रावधानों और उसके अंतर्गत बनाए गए नियमों की अपेक्षाओं का अनुपालन किए जाने के अध्यधीन है।
v. मेसर्स रिन्यू सूर्या विहान प्राइवेट लिमिटेड को विद्युत निरीक्षण के समय विमानन एवं रक्षा प्राधिकरणों इत्यादि, से अपेक्षित अनुमति को प्राप्त करने के बाद, इसे कें द्रीय विद्युत प्राधिकरण को विद्युत निरीक्षण के समय प्रस्तुत करना होगा। {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण
vi. अगर उपरोक्त ओवरहेड लाइनों का मार्ग (या उपरोक्त ओवरहेड लाइन के मार्ग का कु छ हिस्सा) ग्रेट इंडियन बस्टर्ड (जीआईबी) क्षेत्र में आता है, तो आवेदक को ग्रेट इंडियन बस्टर्ड (जीआईबी) के मामले में याचिका सं. 2019 के नं. 838 में माननीय सवोच्च न्यायालय द्वारा दिए गए आदेशों तथा माननीय सवोच्च न्यायालय द्वारा इस बारे में गठित टेकििल/एक्सपर्ट कमेटी के निदेशों का पालन करना पड़ेगाI

New Delhi, the 30th December, 2024
S.O. 5634(E).— Whereas M/s Renew Surya Vihaan Private Limited, the applicant with its registered office at 138, Ansal Chambers-II, Bhikaji Cama Place, Delhi - 110066, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of dedicated overhead transmission line included in the transmission scheme for providing connectivity to M/s Renew Surya Vihaan Private Limited for its 200 MW Solar Power Plant in Jaisalmer, Rajasthan.
And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its File No. CEA-PS-11-21(25)/1/2020-PSPA-I Division/363-364 dated 05/09/2022 had granted prior approval under section 68(1) of the Electricity Act, 2003 for laying of dedicated overhead transmission line included in the transmission scheme for providing connectivity to Renew Surya Vihaan Private Limited for its 200 MW Solar Power Plant in Jaisalmer, Rajasthan.
M/s Renew Surya Vihaan Private Limited had published notice for transmission scheme in local newspapers The Indian Express (in English) dated 18/11/2023 & Dainik Navjyoti (in Hindi) dated 18/10/2023, Prabhat Abhinandan (in Hindi) dated 18/10/2023, and in Weekly Gazette of India dated 04/11/2023 for the general public to make observations/ representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Renew Surya Vihaan Private Limited has submitted an affidavit dated 19/11/2024 declaring that no observation/ representation was received within two months from the date of Publication in the official Gazette of Government of India.
And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of dedicated overhead transmission line for Renew Surya Vihaan Private Limited. The following overhead transmission line is covered under this scheme:
1. Renew Surya Vihaan Private Limited Solar Power Plant-Fatehgarh-III PS 220kV S/C Line.
The overhead transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Renew Surya Vihaan Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely:
i. The approval is granted for 25 years.
ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line.
iii. The Applicant shall have to follow regulations/ codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003.
iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government.
v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.
vi. M/s Renew Surya Vihaan Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.
vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) zone, the applicant has to comply with the orders of the Hon'ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon'ble Supreme Court in this regard.
