) I का.आ. ––जबकि, प्राधि—त अधिकारी अर्थात डीजीटीआर ने अपने अंतिम निष्कर्षों में, अधिसूचना दिनांक 28.05.2024 के साथ पठित अधिसूचना संख्या 22/4/2023-डीजीटीआर दिनांक 29.04. 2024 के माध्यम से जो भारत के राजपत्र, असाधारण, भाग I, खंड 1 में प्रकाशित हुई है, सुरक्षा उपाय (मात्रात्मक प्रतिबंध) नियम, 2012 के अंतर्गत सुरक्षा जांच के बाद विदेष व्यापार (विकास और विनियमन) अधिनियम, 1992 की धारा 9क(1) के अनुसार, एफटीडीआर अधिनियम के तहत निम्नलिखित उत्पाद के आयात पर देश-वार मात्रात्मक प्रतिबंध लगाने की सिफारिश की थीः

"कम राख मेटलर्जिकल कोक, अर्थात एचएस कोड 2704 के अंतर्गत 18% से कम राख की

मात्रा वाला मेटलर्जिकल कोक, जिसमें कोक फाइन्स/कोक ब्रीज और अल्ट्रा-लो फॉस्फोरस

मेटलर्जिकल कोक शामिल नहीं है, जिसमें फॉस्फोरस की मात्रा 0.030% तक है, जिसका आकार

30 मिमी तक है और जिसका फेरोएलॉय विनिर्माण में उपयोग हेतु 5% आकार सहनीय है"

2. तदनुसार, समय-समय पर यथा संशोधित विदेश व्यापार नीति, 2023 के पैरा 1.02 और 2.01 के साथ

पठित विदेष व्यापार विकास एवं विनियमन अधिनियम, 1992 की धारा 3 धारा 5 और धारा 9क द्वारा प्रदत्त

शक्तियों का प्रयोग करते हुए, केंद्र सरकार डीजीटीआर की दिनांक 29.04.2024 की उपर्युक्त अधिसूचना पर

विचार करने के बाद और संबंधित मंत्रालयों/विभागों और अन्य उद्योग जगत के हितधारकों के परामर्श से,

आईटीसी (एचएस), 2022, अनुसूची-I (आयात नीति) के अध्याय 27 की क्रम संख्या 8 पर एक नई नीतिगत

शर्त को षामिल करते हुए निम्नलिखित संशोधन करती हैः-

3. उक्त मद के लिए देश-वार मात्रात्मक प्रतिबंध (क्यूआर) निम्नानुसार होगाः

4. उक्त आयात निम्नलिखित शर्तों के अधीन होगाः

(i) आयात की अनुमति केवल ईडीआई पत्तनों के माध्यम से दी जाएगी, ताकि आवंटित कोटे की

इलेक्ट्रॉनिक/वास्तविक-समय पर निगरानी की जा सके;

(ii) क्यूआर की निगरानी तिमाही आधार पर की जाएगी;

(iii) किसी भी तिमाही में अनुमत कुल आयात उस तिमाही के कुल से अधिक नहीं होगा;

(iv) पहली तिमाही के लिए किसी भी अप्रयुक्त मात्रा को अगली तिमाही में जोड़ा जाएगा;

(v) यदि विशिष्ट मात्रा वाले देश अपने आवंटित क्यूआर को समाप्त कर देते हैं, तो ऐसे देश उपलब्ध

शेष मात्रा का उपयोग कर सकते हैं; और

(vi) यदि आवश्यक हो, तो संबंधित कानूनी प्रावधानों के अनुसार, ऐसे क्यूआर को अभिषासित करने

के लिए आगे के तौर-तरीकों को अलग से अधिसूचित किया जाएगा।

5. देश-वार मात्रात्मक प्रतिबंध केवल छह महीने की अवधि के लिए प्रभावी होंगे और 30.06.2025 को

स्वतः समाप्त हो जाएंगे। इसके अलावा, केंद्र सरकार किसी भी समय, जैसा उचित समझे, उक्त सुरक्षा उपायों

की समीक्षा करने और उनमें कोई भी बदलाव करने का अधिकार सुरक्षित रखती है।

6. यदि आवश्यक हो, तो डीजीएफटी से आयात प्राधिकार पत्र प्राप्त करने के संबंध में प्रक्रिया को अलग

से अधिसूचित किया जाएगा। प्रतिबंधित आयात प्राधिकार पत्र के लिए आवेदन डीजीएफटी वेबसाइट पर

प्रस्तुत किया जा सकता है।

डीजीटीआर के अंतिम निष्कर्षों में निहित सिफारिशों के आधार पर, अधिसूचना दिनांक

28.05.2024 के साथ पठित अधिसूचना संख्या 22/4/2023-डीजीटीआर दिनांक 29.04.2024 के अनुसार,

कम राख वाले मेटलर्जिकल कोक के आयात को देश-वार मात्रात्मक प्रतिबंधों (क्यूआर) के अनुसार छह महीने

की अवधि के लिए ''प्रतिबंध'' के तहत रखा गया है, जो 01.01.2025 से 30.06.2025 तक प्रभावी है।

इसे वाणिज्य एवं उद्योग मंत्री के अनुमोदन से जारी किया जाता है।

NOTIFICATION

Subject: Imposition of Quantitative Restriction on import of Low Ash Metallurgical Coke under

Chapter 27 of ITC (HS) 2022, Schedule – I (Import Policy).

S.O. 5651 (E)––Whereas, the Authorized Officer i.e. DGTR in its final findings, vide Notification No. 22/4/2023-DGTR dated 29.04.2024 read with Notification dated 28.05.2024, published in the Gazette of India, Extraordinary, Part I, Section 1, following a safeguard investigation under the Safeguard Measures (Quantitative Restrictions) Rules, 2012, had recommended in terms of Section 9A(1) of the Foreign Trade (Development and Regulation) Act, 1992, to impose country-wise quantitative restrictions on import of the following product, , under the FTDR Act :

"Low Ash Metallurgical Coke, that is, Metallurgical Coke having ash content below 18%

under the HS Code 2704 excluding coke fines / coke breeze and ultra-low phosphorous

metallurgical coke with phosphorous content up to 0.030% with size upto 30 mm with 5% size

tolerance for use in ferroalloy manufacturing"

2. Accordingly, in exercise of powers conferred by Section 3, Section 5 and Section 9A of FTDR Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2023, as amended from time to time, the Central Government after considering the aforesaid Notification dated 29.04.2024 of DGTR and in consultation with the concerned Ministries/Departments and other industry stakeholders, hereby makes the following amendments by inserting a new Policy Condition at Sl. No. 8 in Chapter 27 of ITC (HS), 2022, Schedule – I (Import Policy) :-

4. The said import shall be subject to the following conditions:

i. Imports would be permitted through EDI ports only to facilitate electronic/ real-time monitoring of the allocated quota;

ii. The QR would be monitored on quarterly basis; iii. Total imports allowed in any quarter shall not exceed the total of that quarter; iv. Any unutilised quantity for Quarter 1 shall be added to next Quarter; v. In case, the countries with specific quantity exhaust their allocated QR, such countries may use the available residual quantity; and

vi. If necessary, further modalities will be notified separately governing such QR, in accordance with relevant legal provisions.

5. The country-wise quantitative restrictions shall be effective for a period of six months only and will cease automatically on 30.06.2025. Further, the Central Government reserves the right to review and make any changes in the said safeguard measures at any point of time, as deemed fit.

6. If required, the procedure in regard to seeking import authorization from the DGFT shall be notified separately. The application for restricted import authorization may be filed on DGFT website.

Effect of the Notification:

Based on the recommendations contained in the final findings of DGTR, vide Notification No. 22/4/2023-DGTR dated 29.04.2024 read with Notification dated 28.05.2024, import of low ash metallurgical coke have been placed under "Restriction" as per the country-wise Quantitative Restrictions(QR) for a period of six months, effective from 01.01.2025 upto 30.06.2025.

This issues with the approval of Minister of Commerce & Industry.
