का.आ. 05(अ).— यतः, मै. फीनिक्स टेक ज़ोन प्राइवेट लिमिटेड (पूर्व में मै. फीनिक्स एम्बसी टेक ज़ोन प्राइवेट लिमिटेड) ने तेलंगाना राज्य के नानकरामगुडा गांव, सेरिलिंगमपल्ली मंडल, रंगा रेड्डी जिला में सूचना प्रौद्योगिकी और सूचना प्रौद्योगिकी सर्मर्थत सेवाओं के लिए एक विशिष्ट विशेष र्आर्थक जोन की स्थापना हेतु विशेष र्आर्थक जोन अधिनियम, 2005 (2005 का 28), (जिसे एतद्पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 के अंतर्गत प्रस्ताव किया था;

और, यतः के न्र सरकार ने, विशेष र्आर्थक जोन नियमावली, 2006 के नियम 8 के साथ पठित उक्त अधिनियम की धारा 4 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, वाणिज्य एवं उद्योग मंत्रालय की अधिसूचना संख्याओं का.आ. 687(अ) दिनांक 22 फ़रवरी, 2017, का.आ. 2179(अ) दिनांक 4 जुलाई, 2017 एवं का.आ. 1186(अ) 13 GI/2025

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] दिनांक 15 मार्च, 2022 द्वारा उपयु र्क्त विशेष र्आर्थक जोन में क्रमशः 3.95 हेक्टेयर, 2.30 हेक्टेयर के दो क्षेत्रों को अधिसूचित एवं 0.469 हेक्टेयर के एक क्षेत्र को अनधिसूचित किया था;

और यतः, मै. फीनिक्स टेक ज़ोन प्राइवेट लिमिटेड ने अब उपरोक्त विशेष र्आर्थक क्षेत्र से 3.167 हेक्टेयर के क्षेत्र को अनधिसूचित करने का प्रस्ताव किया है

और, यतः तेलंगाना राज्य सरकार ने उनके पत्र नंबर 1325/आईटीई&सी/प्रोम/2016 दिनांक 28 अक्टूबर, 2024 के अनुसार प्रस्ताव को मंजूरी दे दी है। अनधिसूचना के बाद, भूमि पार्सल का उपयोग बुनियादी ढांचे के निर्माण के लिए किया जाएगा, जो मूल रूप से परिकल्पित एसईजेड के उद्देश्य को पूरा करेगा और ऐसा विमुरीकृ त क्षेत्र संबंधित राज्य सरकार के भूमि उपयोग दिशानिदेशों/मास्टर प्लान की पुष्टि करेगा;

और यतः विकास आयुक्त, विशाखापत्तनम विशेष र्आर्थक जोन ने विशेष र्आर्थक जोन के 3.167 हेक्टेयर के क्षेत्र को अनधिसूचित करने के प्रस्ताव की संस्तुति की है;

और यतः, के न्र सरकार इस बात से संतुष्ट है कि अधिनियम की धारा 3 की उप-धारा (8) के अंतर्गत अपेक्षाओं तथा अन्य सम्बंधित अपेक्षाओं को पूरा कर लिया गया है;

अतः अब, विशेष र्आर्थक जोन अधिनियम, 2005 की धारा 4 की उप-धारा (1) के प्रथम परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष र्आर्थक जोन अधिनियम, 2006 के नियम 8 के अनुसरण में के न्र सरकार एतद्द्वारा 3.167 हेक्टेयर के क्षेत्र को उक्त विशेष र्आर्थक जोन के भाग से अनधिसूचित करती है, जिसके परिमाणतः कु ल क्षेत्रफल 2.614 हेक्टेयर हो जाएगा। अनधिसूचना के लिए सवेक्षण संख्या और क्षेत्रफल नीचे तालिका में दिए गए हैं:-

NOTIFICATION

New Delhi, the 24th December, 2024

S.O. 05(E).— Whereas, M/s. Phoenix Tech Zone Private Limited (formerly M/s. Phoenix Embassy Tech Zone Private Limited), had proposed under section 3 of the Special Economic Zones Act, 2005 (28 of 2005), (hereinafter referred to as the said Act) to set up a Special Economic Zone for Information Technology and {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

Information Technology Enabled Services at Nanakramguda Village, Serilingampally Mandal, Ranga Reddy District in the State of Telangana;

And, whereas, the Central Government, in the exercise of the powers conferred by sub-section (1) of section 4 of the said Act read with rule 8 of the Special Economic Zones Rules 2006, notified two areas of 3.95 hectares, 2.30 hectares, and de-notified an area 0.469 hectares at above Special Economic Zone vide Ministry of Commerce and Industry Notification Numbers S.O. 687(E) dated 22nd February, 2017, S.O. 2179(E) Dated 4th July, 2017 and S.O. 1186(E) Dated 15th March, 2022, respectively;

AND, WHEREAS, M/s. Phoenix Tech Zone Private Limited has now proposed for de-notification of 3.167 hectares from the above Special Economic Zone;

AND, WHEREAS, the State Government of Telangana has given its approval to the proposal vide letter No.1325/ITE&C/Prom/2016 dated 28th October, 2024. Further, after de-notification, the land parcels would be utilized for the creation of infrastructure which would sub-serve the objective of the SEZ as originally envisaged and such de-notified area will confirm to Land Use Guidelines/master plans of the respective State Government. AND, WHEREAS, the Development Commissioner, Visakhapatnam Special Economic Zone has recommended the proposal for de-notification of an area of 3.167 hectares of the Special Economic Zone;

NOW, WHEREAS, the Central Government is satisfied that the requirements under sub-section (8) of section 3 of the said Act and other related requirements are fulfilled;

NOW, THEREFORE, in the exercise of the powers conferred by the first proviso to sub-section (1) of section 4 of the Special Economic Zones Act, 2005, and in pursuance of rule 8 of the Special Economic Zones Rules, 2006, the Central Government hereby de-notifies an area of 3.167 hectares, thereby making the resultant area as 2.614 hectares. The survey numbers and the area for de-notification are given below in the table, namely:-
