का.आ. 48(अ).—आयकर अधिनियम, 1961 (1961 का 43) की धारा 10 के खंड (46) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार, एतद्द्वारा उक्त खंड के प्रयोजनों के लिए 'रबीन्द्र सेतु के आयुक्त, कोलकाता' (पैन AABTT2734P), हावड़ा सेतु (संशोधन) अधिनियम, 1965 (1965 का पमिि बंगाल अधिनियम XII) के अन्तर्गत गठित एक निकाय को उद्भूत होने वाली निम्नलिखित विर्निर्दष्ट आय के संबंध में अधिसूचित करती है, अर्थात्:
(क) नगर पालिकाओं/नगर निगमों तथा रेलवे के करों से प्राप्त आय,
(ख) विविध आय जैसे किराया तथा रख-रखाव शुल्क, ऑप्टिकल फाइबर के बल बिछाने के लिए आय, मार्ग अनुमति किराया, वसूली योग्य क्षति लागत; तथा
(ग) बैंक जमा पर र्अर्जत ब्याज। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) किसी भी व्यावसायिक गतिविधि में शामिल नहीं होगा; (ख) इसकी गतिविधियां और र्निर्दष्ट आय की प्रकृ ति पूरे वित्तीय वर्ष में अपरिर्वर्तत रहेंगी; और
(ग) आयकर अधिनियम, 1961 की धारा 139 की उप-धारा (4 ग) के खंड (छ) के उपबंध के अनुसार आय की विवरणी दाखिल करेगा।
3. यह अधिसूचना वित्तीय वषों क्रमशः 2018-2019 से 2022-2023 के लिए प्रासंगिक निर्धारण वषों 2019-2020 से 2023-2024 के लिए लागू मानी जाएगी।

NOTIFICATION
New Delhi, the 3rd January, 2025
S.O. 48(E).—In exercise of the powers conferred by clause (46) of section 10 of the Income-tax Act, 1961 (43 of 1961), the Central Government hereby notifies for the purposes of the said clause, 'The Commissioners for the Rabindra Setu, Kolkata' (PAN AABTT2734P), a body established under the Howrah Bridge (Amendment) Act, 1965 (West Bengal Act XII of 1965), in respect of the following specified income arising to that body, namely:
(a) Proceeds from Taxes of Municipalities / Municipal Corporation and Railways;
(b) Miscellaneous income like Rental and Maintenance charge, income for laying optical fibre cable, way leave rent, Damage cost recoverable; and
(c) Interest earned on bank deposits.
2. This notification shall be effective subject to the conditions that 'The Commissioners for the Rabindra Setu, Kolkata':-
(a) shall not engage in any commercial activity;
(b) activities and the nature of the specified income shall remain unchanged throughout the financial years; and
(c) shall file return of income in accordance with the provision of clause (g) of sub-section (4C) of section 139 of the Income-tax Act, 1961.
3. This notification shall be deemed to have been applied for assessment years 2019-2020 to 2023-2024 relevant for the financial years 2018-2019 to 2022-2023 respectively.
