रेलवे अधिनियम एक हजार नौ सौ नवासी की धारा बीस ए के तहत सूचना

का.आ. 34(अ).—रेलवे (संशोधन) अधिनियम, 1989 (24/89) (जिसे इसके बाद उक्त अधिनियम कहा गया है) की धारा 20A की उप-धारा (1) द्वारा प्रदत्त शक्तियों के तहत, कें द्र सरकार इस बात से संतुष्ट होने के बाद कि सार्वजनिक उद्देश्य के लिए, भूमि, जिसका संक्षिप्त विवरण यहां संलग्न अनुसूची में दिया गया है, विशेष रेलवे परियोजना के निष्पादन के लिए आवश्यक है, अर्थात्, आंध्र प्रदेश राज्य के विशाखापत्तनम जिले में "गंगावरम पोर्ट – विशाखपट्टनम इस्पात संयत्र के बीच टाई लाइन सहित वड्लापुडी (वीडीपीडी) - गेट जंक्शन के बिन (जीजेसी) के बीच तीसरी और चौथी लाइन (12.04 कि.मी.)", इसके द्वारा ऐसी भूमि का अधिग्रहण करने का इरादा घोषित करती है।

उक्त भूमि में रुचि रखने वाला कोई भी व्यक्ति, अधिसूचना के राजपत्र में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर, उक्त अधिनियम की धारा 20D की उपधारा (1) के अधीन पूवोक्त प्रयोजन के लिए ऐसी भूमि के अधिग्रहण पर आपत्ति उठा सके गा।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्रत्येक आपत्ति सक्षम प्राधिकारी अर्थात विशेष भूमि अधिग्रहण अधिकारी, "गंगावरम पोर्ट – विशाखपट्टनम इस्पात संयत्र के बीच टाई लाइन सहित वड्लापुडी (वीडीपीडी) - गेट जंक्शन के बिन (जीजेसी) के बीच तीसरी और चौथी लाइन (12.04 कि.मी.)", को लिखित रूप में प्रस्तुत की जाएगी और उसके आधार निर्धारित किए जाएंगे और सक्षम प्राधिकारी आपत्तिकर्ता को चाहे वह व्यक्तिगत रुप से हो या फिर किसी विधि व्यवसायी के माध्यम से, सुनवाई का अवसर देगा, और ऐसी सभी आपत्तियों को सुनने के बाद और आवश्यक आगे की जांच, यदि कोई हो, करने के बाद, जैसा कि सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा, आपत्तियों को स्वीकार या अस्वीकार कर सकता है।

उक्त अधिनियम की धारा 20D की उपधारा (2) के अंतर्गत सक्षम प्राधिकारी द्वारा दिया गया कोई भी आदेश अंतिम होगा। इस अधिसूचना के अंतर्गत आने वाली भूमि की भूमि योजनाएं और अन्य विवरण उपलब्ध हैं और इच्छु क व्यक्ति द्वारा सक्षम प्राधिकारी के उपरोक्त कार्यालय में उनका निरीक्षण किया जा सकता है।

आंध्र प्रदेश राज्य के विशाखापत्तनम जिले में विशेष रेलवे परियोजना, अर्थात् "गंगावरम पोर्ट – विशाखपट्टनम इस्पात संयत्र के बीच टाई लाइन सहित वड्लापुडी (वीडीपीडी) - गेट जंक्शन के बिन (जीजेसी) के बीच तीसरी और चौथी लाइन (12.04 कि.मी.)", के लिए संरचनाओं के साथ या बिना संरचनाओं के अधिग्रहण की जाने वाली भूमि का संक्षिप्त विवरण (अनुलग्नक-I) संलग्न है। जिले का नामाः- विशाखपट्टनम अनुलग्नक-1

Notice under Section 20A of the Railways Act, 1989

S.O. 34(E).—In exercise of powers conferred by sub-section (1) of section 20A of the Railways (Amendment) Act, 1989 (24/89) (hereinafter referred as the said Act.), the Central Government, after being satisfied that for the public purpose, the Land, brief description of which is given in the schedule annexed {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

here to ,is required for the execution of Special Railway Project, namely, "3rd & 4th Line between Vadlapaudi (VDPD)- Gate Jn. Cabin (GJC) including Tie Line between Gangavaram Port – Visakhapatnam Steel Plant (12.04 Km.)" in Visakhapatnam district in the state of Andhra Pradesh, hereby declares its intention to acquire such land.

Any person interested in the said land may within a period of thirty days from the date of publication of the notification in the Official Gazette, raise objection to the acquisition of such land for the aforesaid purpose under sub-section (1) of section 20D of the said Act.

Every objection shall be made to the competent authority, namely. Spl. Land Acquisition Officer, 3rd & 4th Line between Vadlapaudi (VDPD)- Gate Jn. Cabin (GJC) including Tie Line between Gangavaram Port – Visakhapatnam Steel Plant (12.04 Km.)" in writing, and shall set out grounds thereof and competent authority shall give the objector an opportunity of being heard, either in person or through a legal practitioner, and may, after hearing all such objections and after making such further inquiry, if any, as the competent authority thinks necessary, by order, either allow or disallow the objections.

Any order made by the competent authority under sub-section (2) of 20D of the said Act shall be final.

The land plans and other details of the land covered under this notification are available and can be inspected by the interested person at the aforesaid office of the competent authority.
