का.आ. 117(अ).— चू ंकि, के न्र सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना का.आ.
910 (ई) दिनांक 21 अप्रैल 2010 द्वारा मध्य प्रदेश राज्य में नए राष्ट्रीय राजमार्ग-47 (राष्ट्रीय राजमार्ग-59ए) के इंदौर- बैतूल खंड के किमी 0.55 से किमी 277.20 तक का खंड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसके पश्चात् 'प्राधिकरण' के रूप में उल्लिखित है) को सुपुर्द किया है;
अतः अब के न्र सरकार, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम, 2008 (जिसे इसके पश्चात "नियम'' के रूप में उल्लिखित है), के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 47 के डिजाइन किमी 95.000 से किमी 142.445 तक नानासा से पिडगांव खंड तक चार या अधिक लेन खंडों के उपयोग हेतु सड़क खंड की निवल लंबाई 35.227 कि.मी. (तालिका-2) तथा 7.95 कि.मी. (जिनकी कु ल लंबाई 0.795 कि.मी. (तालिका-4) है) कु ल लंबाई की समकक्ष बुनियादी ढांचा (जिनकी लम्बाई 60 मीटर से अधिक है) हेतु यांत्रिक वाहनों पर तालिका 1 के स्तंभ (2) में 185 GI/2025
(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] विर्निर्दष्ट आधार दरों पर और बाईपास जिनकी लंबाई 11.545 किमी (तालिका-3) है, और लागत दस करोड़ या उससे अधिक है, के उपयोग हेतु तालिका-1 के स्तंभ (1) में विर्निर्दष्ट वाहनों पर आधार दर के 150% की दर से शुल्क उद्ग्रहीत करती है एवं प्राधिकरण को अपने अधिकारियों अथवा संविदाकार के माध्यम से उक्त शुल्क का संग्रहण करने के लिए प्राधिकृ त करती है, निम्नानुसार: -

1. इसके अंतर्गत उदगृहीत और संगृहीत फीस ऐसे पथकर प्लाजाओं के अंतर्गत विर्निर्दष्ट दूरी हेतु निम्नलिखित पथकर प्लाजाओं में देय और संदेय होगी, अर्थात:-

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित बाईपास जिनकी लागत 10 करोड़ रुपए से अधिक लागत वाले बाईपास के उपयोग हेतु ऐसे शुल्क प्लाजा के लिए उल्लिखत बाईपास की निवल लम्बाई हेतु निम्नलिखित शुल्क प्लाजा पर निम्नलिखित शुल्क देय और भुगतान योग्य होगा:

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाजा (प्लाजाओं) पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित अवसंरचनाओं के उपयोग के के लिए 10 के समतुल्य गुणक द्वारा ऐसी अवसंरचनाओं की लंबाई को गुणा करके राजमार्ग की समतुल्य लंबाई में अवसंरचनाओं की लंबाई को परिर्वर्तत करके निम्नलिखित शुल्क भी देय और संदेय होगी:-

4. गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किमी की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2024-25 के लिए 340/- रुपए (तीन सौ चालीस रुपए मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के अध्यधीन है।
5. राजमार्ग खंड पर बहुल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्:-

6. शुल्क प्लाजा स्थित होने वाले जिले में पंजीकृ त वाणिज्यिक वाहनों (राष्ट्रीय परमिट के अधीन प्रचालित किए जा रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशते कि ऐसे वाणिज्यिक वाहनों के प्रयोग के लिए कोई र्सर्वस रोड या वैकल्पिक सड़क उपलब्ध न हों।
7. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश लिए, कथित नियमों के नियम 10 के उप-नियम 1ए के अनुसार अनुप्रयोज्य फीस के समतुल्य फीस का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता।
8. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।
9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।
10. यांत्रिक वाहनों से फीस की वास्तविक राशि उपयु र्क्त तालिका-1 में यथा-उल्लिखित आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर प्रभारित होगी और छू टों की गणना प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रति वर्ष संशोधित किया जाएगा तथा तदनुसार उसे अंग्रेजी और क्षेत्रीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।
11. इस परियोजना की अनुमानित पू ंजीगत लागत 1563 करोड़ रुपए है। चू ंकि, भूमि अधिग्रहण, सार्वजनिक जन सुविधाओं के स्थानांतरण, पेड़ों को काटने, इत्यादि कार्यकलापों को अभी पूरा किया जाना है, इसलिए, पू ंजीगत लागत परिवर्तन के अध्यधीन है। प्राप्त प्रयोक्ता फीस के माध्यम से वसूल की गई पू ंजीगत लागत का प्राधिकरण द्वारा रिकार्ड रखा जाएगा।

New Delhi, the 3rd January, 2025
S.O. 117(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 910 (E) dated 21st April 2010, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 0.55 to km 277.20 of Indore – Betul Section of New NH-47 (NH-59A) in the state of Madhya Pradesh to the National Highways Authority of India (hereinafter referred to as the "Authority");
Now, therefore, in exercise of the powers conferred by section 7 of the National Highway Act, 1956 (48 of 1956), read with rule 3 of the National Highway Fee (Determination of Rates and Collection) Rule, 2008 (herein referred to as the "rules"), the Central Government hereby levies the fee at the rate specified in column (2) of the Table 1 for net road section length of 35.227 km [Table-2] and for equivalent structure length (having length more than 60m) of 7.95 km (having length of 0.795 km [Table-4]) and one and half times the base rates for bypasses having length of 11.545 km [Table-3] (costing rupees ten crore or more) on the type of vehicle specified in column (1) of the Table 1 below, for the use of four or more lane of Nanasa to Pidgaon section from design km 95.000 to km 142.445 of National Highway number 47 in the State of Madhya Pradesh and authorises the Authority to collect, either through its officials or through a contractor, the said fee, as under:-

3. In addition to above, the following fee shall be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza, by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalisation factor of 10:-

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance to twenty kilometers from the fee plaza is Rs. 340.00 (Rupees Three Hundred forty Only) for the year 2024-25 and is subject to revision every year as per the provision of the said rules.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said rules.
9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the7 [भाग II—खण्ड 3(ii)] भारत का राजपत्र : असाधारण basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
11. The estimated capital cost of the project is 1563 Cr. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
