सं. पीआर/जी/40/2021/डीडी/77/2021/डीसी/1577/2022.—चार्टर्ड अकाउं टेंट (वृत्तिक और अन्य कदाचार के अन्वेषणों और मामलों के संचालन की प्रयििा) नियम, 2007 के नियम 18(17) के साथ पठित, चार्टर्ड अकाउं टेंट अधिनियम, 1949 की धारा 21ख(3) के उपबंधों के निबंधनानुसार अनुशासन समिति ने सीए. अक्षय जैन (सदस्यता संख्या 241125), डी नंबर 23-7-86, दूसरी मंजिल, शिखर दर्शन, राव बहादुर मेदा के सामने, गु ंटूर 522003 (आंध्र प्रदेश), को पूवोक्त अधिनियम की दूसरी अनुसूची के भाग I की मद (7) और पहली अनुसूची के भाग IV की मद (2) के अर्थान्तर्गत वृत्तिक और अन्य कदाचार का दोषी अभिनिर्धारित किया है और इसके परिणामस्वरूप अनुशासन समिति ने पूवोक्त नियमों के नियम 19(1) के निबंधनानुसार सुनवाई का अवसर प्रदान करने के पश्चात्, सीए. अक्षय जैन (सदस्यता संख्या 241125) के नाम को 05 (पांच) वर्ष की अवधि के लिए सदस्यों के रजिस्टर से हटाने का आदेश दिया और साथ ही 5,00,000/- रुपए (के वल पांच लाख रुपए) का जुर्माना भी अधिरोपित किया, जिसका संदाय 90 (नब्बे) दिन के भीतर किया जाना है और अनुबंधित समय के भीतर उक्त जुर्माने के संदाय में व्यतिमि की दशा में उसके नाम को 01 (एक) मास की अतिरिक्त अवधि के लिए सदस्यों के 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] है, अत: अनुशासन समिति के पूवोक्त आदेश के अनुसरण में और चार्टर्ड अकाउं टेंट विनियम, 1988 के विनियम 18 के साथ पठित पूवोक्त अधिनियम की धारा 20 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सीए. अक्षय जैन (सदस्यता संख्या 241125) का नाम 3 जनवरी, 2025 से 05 (पांच) वर्ष और 01 (एक) मास की समेकित अवधि [05 (पांच) वर्ष धन अतिरिक्त 01 (एक) मास] के लिए सदस्यों के रजिस्टर से हटा दिया गया था । इसी दौरान प्रत्यर्थी ने माननीय आंध्र प्रदेश उच्च न्यायालय में रिट याचिका 30264/2024 फाइल की, जिसका निपटारा 3 जनवरी, 2025 को किया गया था । पूवोक्त रिट याचिका का निपटारा करते हुए माननीय उच्च न्यायालय ने आईसीएआई को यह निदेश दिया कि वह तब तक याची के विरुद्ध दंडादेश को कार्यान्वित न करे जब तक कि याची 04 (चार) सप्ताह के भीतर अपीलीय अधिकरण के समक्ष अपील फाइल नहीं करता है । तदनुसार, तारीख 3 जनवरी, 2025 की वह अधिसूचना, जिसके द्वारा सीए. अक्षय जैन (सदस्यता संख्या 241125) के नाम को सदस्यों के रजिस्टर से हटा दिया गया था, को वापस लिया जाता है ।

No. PR/G/40/2021/DD/77/2021/DC/1577/2022.—In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 read with Rule 18(17) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, the Disciplinary Committee has held CA. Akshay Jain (Membership No. 241125), D No. 23-7-86, 2nd Floor, Shikar Darshan, Opposite Rao Bahadur Meda, GUNTUR 522003(Andhra Pradesh), guilty of Professional and Other Misconduct falling within the meaning of Item (7) of Part I of Second Schedule and Item (2) of Part IV of First Schedule to the aforesaid Act and consequently after affording an opportunity of being heard in terms of Rule 19(1) of the aforesaid Rules, ordered for removal of name of CA. Akshay Jain (Membership No. 241125) from the Register of Members for a period of 5(Five) years and also imposed a fine of Rs. 5,00,000/-(Rupees Five Lakhs only) to be paid within 90(ninety) days and in case of default in payment of fine within stipulated time his name shall be removed for a further period of 01(One) month. Since the Respondent had failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, the name of CA. Akshay Jain (Membership No. 241125), was removed from the Register of Members for a consolidated period of 05(Five) years and 01(one) month [05(Five) years plus additional 01(One) month] with effect from 3rd January, 2025. In the meantime, the Respondent approached Hon'ble High Court of Andhra Pradesh by filing writ petition no. WP 30264/2024, which was disposed off on 3rd January, 2025. While disposing off the aforesaid writ petition, the Hon'ble Court directed the ICAI not to implement the punishment Order against the Petitioner till the petitioner files the Appeal before the Appellate Authority within 04(Four) weeks. Accordingly, the notification dated 3rd January, 2025, wherein the name of CA. Akshay Jain (Membership No. 241125) was removed from the Register of Members stands withdrawn.
