का.आ. 198(अ).— के न्रीय सरकार ने कोयला धारक क्षेत्र (अर्जन और विकास) अधिनियम, 1957 (1957 का 20) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 7 की उपधारा (1) के अधीन ज़ारी भारत सरकार के कोयला मंत्रालय की अधिसूचना संख्यांक का. आ. 3057(अ), तारीख 31 जुलाई, 2024 द्वारा जो भारत के राजपत्र, असाधारण, भाग II, खण्ड 3, उपखण्ड (ii), तारीख 31 जुलाई 2024 में प्रकाशित की गई थी, उक्त अधिसूचना से उपाबद्ध अनुसूची में र्वणंित परिक्षेत्र में 127.93 हेक्टर (लगभग) या 316.12 एकड़ (लगभग) माप वाली भूमि में और ऐसी भूमि में या उस पर के सभी अधिकारों के अर्जन करने के अपने आशय की सूचना दी थी;
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 8 के अनुसरण में के न्रीय सरकार को अपनी रिपोर्ट दे दी है ;
और के न्रीय सरकार का, पूवोक्त रिपोर्ट पर विचार करने के पश्चात् और महाराष्ट्र सरकार से परामर्श करने के पश्चात्, यह समाधान हो गया है कि इससे संलग्न अनुसूची में यथा र्वणंित 127.93 हेक्टर (लगभग) या 316.12 एकड़ (लगभग) माप वाली भूमि और ऐसी भूमि में या उस पर के सभी अधिकार र्अर्जत किए जाने चाहिए;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अत:, अब, के न्रीय सरकार, उक्त अधिनियम की धारा 9 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि अनुसूची में यथा र्वणंित 127.93 हेक्टर (लगभग) या 316.12 एकड़ (लगभग) माप वाली भूमि में या उस पर के सभी अधिकार र्अर्जत किए जाते हैं;
इस अधिसूचना के अंतर्गत आने वाले क्षेत्र के रेखांक धारक संख्या सी-आई(ई)/III/जेजेआर/1124/1022, तारीख 25 नवंबर, 2024 का निरीक्षण कलेक्टर, जिला यवतमल, महाराष्ट्र के कार्यालय में या कोयला नियंत्रक, कोयला नियंत्रक संगठन, कोयला मंत्रालय, स्कोप मीनार, 5वीं मंजिल, कोर II, लक्ष्मी नगर, दिल्ली-110092 के कार्यालय में या विभाग के प्रमुख या महा प्रबंधक (खनन), भूमि और राजस्व, वेस्टर्न कोलफील््स लिमिटेड कोल एस्टेट, सिविल लाइन्स, नागपुर- 440001, महाराष्ट्र के कार्यालय में किया जा सकता है।

NOTIFICATION
New Delhi, the 9th January, 2025
S.O. 198(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S. O. 3057(E), dated the 31st July, 2024, issued under sub-section (1) of section 7 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 31st July, 2024 the Central Government gave notice of its intention to acquire 127.93 hectares (approximately) or 316.12 acres (approximately) land and all rights in or over such land specified in the Schedule annexed to that notification;
And whereas the competent authority in pursuance of section 8 of the said Act, has made his report to the Central Government;
And whereas the Central Government, after considering the aforesaid report and after consulting to the Government of Maharashtra, is satisfied that the land measuring 127.93 hectares (approximately) or 316.12 acres (approximately) and all rights in or over such land as described in the Schedule appended hereto, should be acquired;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 9 of the Coal Bearing Areas (Acquisition and Development) Act, 1957, (20 of 1957), the Central Government hereby declares that all rights in or over the land measuring 127.93 hectares (approximately) or 316.12 acres (approximately) as described in the said Schedule are hereby acquired.
The plan bearing number C-I(E)/III/JJR/1124/1022, dated the 25th November, 2024 of the area covered by this notification may be inspected in the office of the Collector, District Yavatmal, Maharashtra or in the office of the Coal Controller, Coal Controller's Organization, Ministry of Coal, Scope Minar, 5th floor, Core II, Laxmi Nagar, Delhi 110092 or in the office of the Head of Department or General Manager (Mining), Land and Revenue Department, Western Coalfields Limited, Coal Estate, Civil Lines, Nagpur-440001, Maharashtra.
