का.आ. 242(अ).—जबकि मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड, जिसका पंजीकृ त कार्यालय प्लॉट नंबर 152, सेक्टर- 44, गुरुग्राम, हरियाणा- 122002, भारत में स्थित है, ने ट्रांसमिशन योजना "राजस्थान के बीकानेर में मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड को उसकी 300 मेगावाट की सौर ऊर्जा परियोजना के लिए कनेक्टिविटी प्रदान करने के लिए ट्रांसमिशन प्रणाली " के तहत ओवरहेड ट्रांसमिशन लाइन बिछाने के लिए विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत प्राधिकृ त करने हेतु आवेदन किया है।

और जबकि, विद्युत मंत्रालय, भारत सरकार ने अपने पत्र सं. 25-17/10/2024-PG दिनांकित 16.02.2024 के द्वारा ट्रांसमिशन योजना "राजस्थान के बीकानेर में मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड को उसकी 300 मेगावाट की सौर ऊर्जा परियोजना के लिए कनेक्टिविटी प्रदान करने के लिए ट्रांसमिशन प्रणाली" के अंतर्गत आने वाली ओवरहेड ट्रांसमिशन लाइनों के लिए विद्युत अधिनियम की धारा 68(1) के अंतर्गत पूर्व अनुमोदन प्रदान किया था।

मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड ने स्थानीय समाचार पत्रों द टाइम्स ऑफ इंडिया (अंग्रेजी में) दिनांक 08.08.2024, द इंडियन एक्सप्रेस (अंग्रेजी में) दिनांक 08.08.2024, दैनिक नवज्योति (हिंदी में) दिनांक 08.08.2024, दैनिक युगपक्ष (हिंदी में) दिनांक 08.08.2024, राजस्थान पत्रिका (हिंदी में) दिनांक 08.08.2024, दैनिक भास्कर (हिंदी में) दिनांक 08.08.2024 और भारत के साप्ताहिक राजपत्र दिनांक 24.08.2024 में ट्रांसमिशन योजना के लिए प्रस्तावित ट्रांसमिशन मार्ग पर प्रकाशन की तारीख से 2 महीने के भीतर आम जनता की टिप्पणियों / अभ्यावेदन की मांग करते हुए 359 GI/2025

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नोटिस प्रकाशित किया था। इसके पश्चात, मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड ने 19.12.2024 दिनांकित एक हलफनामा प्रस्तुत किया, जिसमें घोषणा की गई है कि भारत सरकार के आधिकारिक राजपत्र एवं स्थानीय समाचार पत्रों में प्रकाशन की तारीख से 2 महीने के भीतर कोई टिप्पणी / अभ्यावेदन प्राप्त नहीं हुआ था।

और अब आवेदक ने विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत "राजस्थान के बीकानेर में मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड को उसकी 300 मेगावाट की सौर ऊर्जा परियोजना के लिए कनेक्टिविटी प्रदान करने के लिए ट्रांसमिशन प्रणाली" के तहत ट्रांसमिशन लाइन बिछाने के लिए उसे वे सभी शक्तियां प्रदान करने का अनुरोध किया है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं। योजना के अंतर्गत निम्नलिखित ओवरहेड ट्रांसमिशन लाइन हैं:

1. एक्मे सोलर होल्डिंग्स लिमिटेड सौर ऊर्जा परियोजना (जनरेशन स्विचयार्ड गांव जैमलसर, जिला बीकानेर, राजस्थान में स्थित) - बीकानेर-II (आईएसटीएस) पूलिंग स्टेशन 220 के वी एस/सी लाइन

उपरोक्त योजना के अंतर्गत ओवरहेड ट्रांसमिशन लाइन राजस्थान के निम्नांकित गाँवों, कस्बों और शहरों से होकर, उन पर से, उनके आसपास से और बीच से होकर गुज़रेगी।

अब, सावधानीपूर्वक विचार करने के पश्चात, विद्युत मंत्रालय, भारत सरकार, मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड को उपरोक्त ओवरहेड ट्रांसमिशन लाइन को लगाने के लिए वे सभी शक्तियां निम्नलिखित निबंधनों एवं शतों के साथ प्रदान करता है, जो भारतीय टेलीग्राफ अधिनियम, 1885 के तहत टेलीग्राफ के प्रयोजन के लिए सरकार द्वारा स्थापित अथवा अनुरक्षित किये गए टेलीग्राफ लाइन एवं खम्भे या इस प्रकार की स्थापना और अनुरक्षण किये जाने के लिए, टेलीग्राफ प्राधिकरण को प्राप्त हैं-

i. यह अनुमोदन 25 वषों के लिए प्रदान किया जाता है।

ii. आवेदक को प्रस्तावित लाइन की स्थापना से पूर्व संबंधित प्राधिकरणों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी।

iii. आवेदक को विद्युत अधिनियम, 2003 के तहत समुचित आयोग के द्वारा तैयार किए गए ट्रांसमिशन, ओ एंड एम, ओपन एक्सेस आदि के विनियमों/संहिताओं का पालन करना होगा।

iv. आवेदक कें द्र सरकार के विद्युत निरीक्षक/मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात ही लाइन का प्रचालन करेगा। v. यह अनुमोदन आवेदक द्वारा विद्युत अधिनियम, 2003 के प्रावधानों और उसके तहत बनाए गए नियमों की अपेक्षाओं का अनुपालन किए जाने के अध्यधीन है।

vi. मेसर्स एक्मे सोलर होल्डिंग्स लिमिटेड को विद्युत निरीक्षण के समय विमानन एवं रक्षा प्राधिकरणों इत्यादि, से अपेक्षित अनुमति को प्राप्त करने के बाद, इसे कें द्रीय विद्युत प्राधिकरण को विद्युत निरीक्षण के समय प्रस्तुत करना होगा।

vii. यदि उपरोक्त ओवरहेड लाइनों का मार्ग (या उपरोक्त ओवरहेड लाइन के मार्ग का कु छ भाग) ग्रेट इंडियन बस्टर्ड (जीआईबी) क्षेत्र में आता है तो आवेदक को ग्रेट इंडियन बस्टर्ड (जीआईबी) मामले के संबंध में 2019 की याचिका {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

संख्या 838 पर माननीय उच्चतम न्यायालय के आदेशों का और माननीय उच्चतम न्यायालय द्वारा गठित तकनीकी/विशेषज्ञ समिति के निदेशों का पालन करना होगा।

New Delhi, the 13th January, 2025

S.O. 242(E).— Whereas M/s ACME Solar Holdings Limited having its registered address at Plot No. 152, Sector-44, Gurugram, Haryana - 122002, India, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under the transmission scheme "Transmission System for providing connectivity to M/s ACME Solar Holdings Limited for its 300 MW Solar Power Project in Bikaner, Rajasthan".

And whereas, Ministry of Power, Government of India vide its letter No. 25-17/10/2024-PG dated 16.02.2024 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under the transmission scheme "Transmission System for providing connectivity to M/s ACME Solar Holdings Limited for its 300 MW Solar Power Project in Bikaner, Rajasthan".

M/s ACME Solar Holdings Limited had published notice for transmission scheme in local newspapers The Times of India (in English) dated 08.08.2024, The Indian Express (in English) dated 08.08.2024, Dainik Navajyoti (in Hindi) dated 08.08.2024, Dainik Yugpaksh (in Hindi) dated 08.08.2024, Rajasthan Patrika (in Hindi) dated 08.08.2024, Dainik Bhaskar (in Hindi) dated 08.08.2024 and in Weekly Gazette of India dated 24.08.2024 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s ACME Solar Holdings Limited has submitted an affidavit dated 19.12.2024 declaring that no observation/representation was received within 2 Months from the date of Publication in the official gazette of Government of India.

And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under the transmission scheme "Transmission System for providing connectivity to M/s ACME Solar Holdings Limited for its 300 MW Solar Power Project in Bikaner, Rajasthan". The following overhead line is covered under this scheme:

1. ACME Solar Holdings Limited Solar Power Project (generation switchyard located in village Jaimalsar, District Bikaner, Rajasthan) - Bikaner-II (ISTS) Pooling Station 220 kV S/c line.

The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan:

Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s ACME Solar Holdings Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above-mentioned line, namely:

i. The approval is granted for 25 years.

ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line.

iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003.

iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government.

v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.

vi. M/s ACME Solar Holdings Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection.

vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon'ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon'ble Supreme Court in this regard.
