फा.सं. एपीडा/पीएडी-2017-18-000044—कृ षि और प्रसंस्कृ त खाद्य उत्पाद निर्यात विकास प्राधिकरण (एपीडा), कृ षि और प्रसंस्कृ त खाद्य उत्पाद निर्यात विकास प्राधिकरण अधिनियम,1985(1986 का 2) की धारा 7 की उपधारा (3) के साथ पठित धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार की पूर्व मंजूरी से कृ षि और प्रसंस्कृ त खाद्य उत्पाद निर्यात विकास प्राधिकरण भर्ती विनियम 2022 एतद्वारा निम्न प्रकार से संशोधित है, अर्थातः—

1. (i) यह विनियम कृ षि और प्रसंस्कृ त खाद्य उत्पाद निर्यात विकास प्राधिकरण (भर्ती) विनियम संशोधित, 2025 है ।

(ii) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे |

2. कृ षि और प्रसंस्कृ त खाद्य उत्पाद निर्यात विकास प्राधिकरण (भर्ती) विनियम, 2022 के निम्नलिखित अनुसूची एतदद्वारा निम्न प्रकार से संशोधित है :—

सामान्य टिप्पणी 1: जहां प्रोन्नति को भर्ती की पद्धति के रूप में निर्धारित किया गया है / भर्ती की पद्धति 'प्रतिनियुक्ति/प्रोन्नति' के अलावा अन्य में से एक है, निम्नलिखित शर्त उन पदों/ग्रेड के संबंध में लागू होगी जिनसे प्रोन्नति की जानी है:

जहाँ कनिष्ठों, जो कि अर्हक या पात्रता सेवा पूरी कर चुके है, पर पदोन्नति के लिए विचार किया जा रहा है | उनके वरिष्ठों पर भी विचार किया जाएगा बशर्त कि वे अपेक्षित योग्यता या अर्हता ऐसी योग्य या अर्हक सेवा के आधे से अधिक से कम ना हो या 2 वर्ष तक, जो भी कम हो और अगले उच्च ग्रेड पर अपने कनिष्ठों सहित पदोन्नति के लिए परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हो, जिन्होंने पहले ही ऐसी अर्हक या पात्रता सेवा पूरी कर ली हो |

सामान्य टिप्पणी 2: जहां इन विनियमों के अंतर्गत एक से अधिक ग्रेड/पदों से किसी ग्रेड/पद पर प्रोन्नति की जाती है वहां कार्र्मक एवं प्रशिक्षण विभाग, भारत सरकार द्वारा जारी अनुदेशों/आदेशों के अनुसरण में विभिन्न फीडर ग्रेडों से पात्र अधिकारियों की एक संयुक्त पात्रता सूची तैयार की जाएगी।

सामान्य टिप्पणी 3: जहां प्रतिनियुक्ति/प्रोन्नति को भर्ती की पद्धति/भर्ती की पद्धतियों में से एक के रूप में निर्धारित किया गया है, वहां ऐसे ग्रेडों पर निम्नलिखित शतें लागू होंगी, जिनसे प्रतिनियुक्ति/प्रोन्नति की जानी हैः

(1) फीडर श्रेणी में विभागीय अधिकारी, जो प्रोन्नति की सीधी लाइन में है, प्रतिनियुक्ति पर नियुक्ति के विचारार्थ योग्य नहीं होंगे | इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के विचारार्थ योग्य नहीं होंगे।

(2) फीडर श्रेणी में विभागीय अधिकारियों की नियुक्ति के मामले में, पद/रिक्ति को प्रोन्नति द्वारा भरा गया माना जाएगा।

(3) प्रतिनियुक्ति की आरंभिक अवधि तीन वर्ष की होगी जिसे वर्ष प्रतिवर्ष आधार पर बढ़ाया जा सकता है। प्रतिनियुक्ति की अधिकतम लगातार अवधि पांच वर्ष होगी। कें द्रीय सरकार/राज्य सरकार/सांविधिक/ स्वायत निकाय (निकायों) के उसी या किसी अन्य संगठन /विभाग में इस नियुक्ति से तत्काल पूर्व धारित किसी अन्य संवर्ग बाह्य पद में प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्ति की कु ल अवधि सामान्य तौर पर पांच वर्ष से अधिक नहीं होगी।

(4) प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदनों की प्राप्ति की अंतिम तिथि को 56 वर्ष से अधिक नहीं होनी चाहिए |

सामान्य टिप्पणी 4: जहां सीधी भर्ती के लिए आयु सीमा निर्धारित की गई है, वहां निम्नलिखित शर्त लागू होगीः डाक (स्पीड पोस्ट सहित) /कू रियर द्वारा आवेदन जमा करने की स्थिति में, आयु सीमा निर्धारित करने के लिए निर्णायक तारीख भारत में अभ्र्यर्थयों से आवेदन प्राप्त करने की अंतिम तारीख होगी (यह निर्धारित अंतिम तारीख उनके लिए लागू नहीं होगी जो असम, मेघालय, अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिमिि, जम्मू और काश्मीर, लद्दाख, लाहौल और स्पीति जिले और हिमाचल प्रदेश के चम्बा जिले के पांगी उपप्रभाग, अंडमान और निकोबार और लक्षद्वीप के द्विपों में रहते हैं।)

सामान्य टिप्पणी 5: जहां सीधी भर्ती को भर्ती की पद्धति/ भर्ती की पद्धतियों में से एक के रूप में निर्धारित किया गया है, वहां सीधी भर्ती के लिए अपेक्षित शैक्षणिक और अन्य योग्यताओं के संबंध में निम्नलिखित शते लागू होंगीः- (1) अन्यथा रूप से विधिवत अर्हक अभ्र्यर्थयों के मामले में योग्यता में सक्षम प्राधिकारी के विवेकाधिकार पर छू ट दी जा सकती है।

(2) अनुसूचित जाति या अनुसूचित जनजातियों से संबंध रखने वाले अभ्र्यर्थयों के मामले में सक्षम प्राधिकारी के विवेकाधिकार पर अनुभव से संबंधित योग्यता में छू ट दी जा सकती है। यदि चयन के किसी स्तर पर, सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए इन समुदायों से अपेक्षित अनुभव रखने वाले अभ्र्यर्थयों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

सामान्य टिप्पणी 6 : सीधी भर्ती के मामले में, सीधी भर्ती के लिए निर्धारित आयु सीमा, शैक्षिक और अन्य योग्यता निर्धारित करने की निर्णायक तिथि उम्मीदवारों के लिए आवेदन प्राप्त करने की अंतिम तिथि होगी।

सामान्य टिप्पणी 7 : उक्त पद (पदों) पर पदोन्नति के लिए निर्धारित अपेक्षित सेवा अवधि (पात्रता सेवा) के साथ फीडर ग्रेड/पद में अधिकारियों की अनुपलब्धता के मामले में, इस तरह की प्रतिनियुक्ति के लिए कार्र्मक एवं प्रशिक्षण विभाग, भारत सरकार द्वारा जारी नियमों/आदेशों के तहत अपेक्षित शैक्षिक योग्यता और अनुभव निर्धारित करके प्रतिनियुक्ति द्वारा19 [भाग III—खण्ड ⁴] भारत का राजपत्र : असाधारण पदोन्नति के लिए निर्धारित पदों (पदों) को सक्षम प्राधिकारी द्वारा भरने हेतु अधिकार सुरक्षित है। इस तरह की प्रतिनियुक्ति पर नियुक्त अधिकारियों की समीक्षा र्वार्षक आधार पर की जाएगी जिससे पदोन्नति योग्य अधिकारी जिन्होंने फीडर ग्रेड / पद में सेवा की अपेक्षित अवधि (पात्रता सेवा) पूरा कर लिया हो अथवा पूरा करने वाले हो उन्हें आगामी निर्णायक तारीख को पदोन्नति हेतु विचार किया जा सके । विभागीय अधिकारी जो पदोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार के पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त अधिकारी प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

NOTIFICATION

New Delhi, the 22nd January, 2025

F. No. APEDA/PAD-2017-18-000044—In exercise of powers conferred under Section 33 read with sub section 3 of section 7 of the Agricultural and Processed Food Products Export Development Authority Act, 1985 (2 of 1986), the Agricultural and Processed Food Products Export Development Authority, with the previous sanction of the Central Government, hereby amend the Agricultural and Processed Food Products Export Development Authority (Recruitment) Regulations-2022 in the following manner namely:-

1. (i) These regulations may be called the Agricultural and Processed Food Products Export Development Authority (Recruitment) Amendment Regulations 2025.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In Agricultural and Processed Food Products Export Development Authority (Recruitment) Regulations, 2022, the Schedule attached therewith shall be replaced with the following Schedule:—

SCHEDULE

General Note 1: Where promotion has been prescribed as method of recruitment/one of the methods of recruitment other than the method of 'By Deputation/Promotion', the following condition shall apply in respect of grades/posts from which promotion is to be made:

Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ eligibility service or two years, whichever is less, and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/ eligibility service.

General Note 2: Where promotions to a grade/post are made from more than one grade/post under these regulations, a combined eligibility list of the eligible officers from various feeder grades shall be prepared in accordance with the instructions/orders issued by DOPT, Government of India.

General Note 3: Where Deputation/Promotion has been prescribed as method of recruitment/one of the methods of recruitment, the following conditions shall apply to grades from which Deputation/Promotion is to be made:

(1) The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly officer on deputation shall not be eligible for consideration for appointment by promotion.

(2) In case of appointment of departmental officers in the feeder category, the post/vacancy will be deemed to have been filled by promotion.

(3) The initial period of deputation shall be three years extendable on year to year basis. The maximum continuous period of deputation shall be five years. The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization / department of the Central Government/State Government/Statutory/Autonomous Body(s) shall ordinarily not exceed five years.

(4) The maximum age limit for appointment by deputation shall not exceed 56 years as on the closing date of receipt of applications

General Note 4: Where Age Limit has been prescribed for Direct Recruitment, the following condition shall apply:

In the case of requirement of submission of applications by post (including speed post) /courier, the crucial date for determining the age limit shall be the closing date for receipt of applications from candidates in India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Jammu, Kashmir, Ladakh, Lahaul &Spiti District and Pangi Sub Division of Chamba District of Himachal Pradesh, Andaman & Nicobar Islands and Lakshadweep)

General Note 5: Where Direct Recruitment has been prescribed as the method of recruitment/one of the methods of recruitment, the following provisions shall apply in regard to Educational and other qualifications required for direct recruitment:

(1) Qualifications are relaxable at the discretion of the Competent Authority in the case of candidates otherwise well qualified.

(2) The qualification(s) regarding experience is/are relaxable at the discretion of the Competent Authority in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selection, the Competent Authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancy reserved for them.

General Note 6: In the case of direct recruitment, the crucial date for determining the age limit, educational and other qualifications prescribed for direct recruitment shall be the closing date for receipt of applications from candidates General Note 7: The competent authority reserves the right to fill the post(s)earmarked for promotion by deputation by prescribing appropriate educational qualifications and experience as may be required under the rules/orders issued by DOPT, Government of India for such deputation, in case of non-availability of officers in the feeder grade/post with requisite length of service (eligibility service) prescribed for promotion to the said post(s). The position of officers on such deputation shall be reviewed on year to year basis so as to consider officers having completed or who would complete, on the ensuing crucial date of promotion, the requisite length of service (eligibility service) in the feeder grade/post. The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly officer on deputation shall not be eligible for consideration for appointment by promotion.
