सा.का.नि. 73(अ).— के न्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, 1986 (1986 का 29) की धारा 3, धारा 6 और धारा 25 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्द्वारा प्लास्टिक अपशिष्ट प्रबंधन नियम, 2016 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. (1) इन नियमों का संक्षिप्त नाम प्लास्टिक अपशिष्ट प्रबंधन (संशोधन) नियम, 2025 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. प्लास्टिक अपशिष्ट प्रबंधन नियम, 2016 में-
(i) नियम 11 में, उप-नियम (1) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा:-
"(झ क) कोई उत्पादक, आयातक या ब्रांड स्वामी तारीख 1 जुलाई, 2025 से उप-नियम (1) के अधीन निम्नलिखित विर्निर्दष्ट जानकारी भी उपलब्ध कराए : -
(क) प्लास्टिक पैके जिंग पर मुरित बारकोड या किि रिस्पांस कोड में;

(ग) वतर्मान में प्रवृत्त किसी विधि जिसमें, उप-नियम (1) के उपबंधों को ऐसी संख्या जारी करने से पहले पूरा किया जाना अपेक्षित है; के अधीन जारी की गई विशिष्ट संख्या को प्लास्टिक पैके जिंग पर मुरित करेगा, परन्तु, विवरणिका या विशिष्ट संख्या उत्पादक या आयातक या ब्रांड स्वामी कें रीय प्रदूषण नियंत्रण बोर्ड को बारकोड या क्यूआर कोड, विवरणिका या विशिष्ट संख्या के प्रकाशन के ब्यौरे को सूचित करेगा: परन्तु, के न्रीय प्रदूषण नियंत्रण बोर्ड अपनी वेबसाइट पर ऐसे उत्पादकों, आयातकों अथवा ब्रांड स्वामियों, की सूची प्रकाशित करेगा और प्रत्येक तिमाही में उसे अद्यतन करेगा जिन्होंने ब्यौरे और उत्पाद सूचना उपलब्ध कराई है।
ii) नियम 18 के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात :-
"19. उल्लंघन करने पर कार्रवाई- कोई भी व्यक्ति जो इन नियमों के उपबंधों का पालन करने में विफल रहता है या इनका उल्लंघन करता है, वह अधिनियम की धारा 15 के उपबंधों के अनुसार दंड का दायित्वाधीन होगा।

201 (अ) तारीख 14 मार्च 2024 के अधीन संशोधित किए गए थे।

NOTIFICATION
New Delhi, the 23rd January, 2025
G.S.R. 73(E).— In exercise of the powers conferred under sections 3, 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Plastic Waste Management Rules, 2016, namely:-
1. (1) These rules may be called the Plastic Waste Management (Amendment) Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Plastic Waste Management Rules, 2016,-
(i) in rule 11, after sub-rule (1) the following sub-rule shall be inserted:-
"( 1 A) A producer, importer or brandowner may, with effect from the 1st July, 2025, provide the information specified under sub-rule (1) as given below,-
a. in a barcode or Quick Response code printed on the plastic packaging;
b. in the product information brochure;

c. print on the plastics packaging the unique number issued under any law for the time being in force, wherein, the provisions of sub-rule (1) are required to be fulfilled before issuance of such a number:
Provided that the producer or importer or brandowner shall inform the details of publishing of a barcode or QR code, brochure or unique number to the Central Pollution Control Board:
Provided further that the Central Pollution Control Board shall publish the list, of such producers, importers or brandowners, who have provided with details and the product information using any one of above option, on its website and update the same every quarter.
ii) after rule 18, the following rule shall be inserted, namely:-
"19. Action for contravention.- Any person who fails to comply or contravenes the provisions of these rules shall be liable to a penalty in accordance with the provisions of section 15 of the Act."
