(रेलवे अधिनियम, 1989 की धारा 20 (ई) के तहत)

का.आ. 455(अ).— जबकि भारत सरकार की अधिसूचना द्वारा रेल मंत्रालय (रेलवे बोर्ड) में अधिसूचना संख्या एस.ओ. 3569 दिनांक 12.09.2024 रेलवे अधिनियम की 20ए की उप-धारा (1) के तहत भारत के राजपत्र साधारण, भाग ॥, खंड 3, उप-खंड (ii), (इसके बाद उक्त अधिसूचना के रूप में संर्दर्भत) में प्रकाशित, 1989 (1989 का 24) (इसके बाद उक्त अधिनियम के रूप में संर्दर्भत), कें द्र सरकार ने विशेष रेलवे परियोजना अर्थात ईब फ्लाई ओवर रेल लाइन (झारसुगुडा जिला) के ओडिशा राज्य के निर्माण के निष्पादन के लिए उक्त अधिसूचना से जुड़ी अनुसूची में र्निर्दष्ट भूमि के अधिग्रहण के अपने इरादे की घोषणा की।

और, जबकि उक्त अधिनियम की धारा 20ए की उप धारा (4) के तहत धारा 20ए की उप-धारा (1) की अधिसूचना का सार दैनिक समाचार पत्र, उत्कल मेल राउरके ला, टाइम्स ऑफ़ इंडिया भुबनेश्वर, कलिंगा समाचार राउरके ला एवं आरूप झारसुगुडा में दिनांक 22.09.2024 को प्रकाशित किया गया था। जबकि कोई भी आपत्ति इस संबंध में सक्षम अधिकारी को प्राप्त नहीं हुआ है और जबकि, उक्त अधिनियम की धारा 20ई की उप धारा (1) के अनुसार, सक्षम प्राधिकारी ने कें द्र सरकार को अपनी रिपोर्ट प्रस्तुत की है। अब, इसलिए, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने पर, 652 GI/2025

(1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और उक्त अधिनियम की धारा 20ई की उप धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार एतद्द्वारा घोषणा करती है कि अनुसूची में र्निर्दष्ट भूमि इसके साथ संलग्न पूवोक्त प्रयोजन के लिए अधिग्रहण किया जाएगा; और, उक्त अधिनियम की धारा 20ई की उप धारा (2) के अनुसरण में, कें द्र सरकार एतद्द्वारा घोषणा करती है कि इस अधिसूचना के आधिकारिक राजपत्र में प्रकाशित होने पर, इसके साथ संलग्न अनुसूची में र्निर्दष्ट भूमि पूरी तरह से सभी प्रकार के बंधनों से मुक्त कें द्रीय में निहित होगी।

NOTIFICATION

Bilaspur, the 22nd January, 2025

(under section 20 (E) of Railways Act, 1989)

S.O. 455(E).—Whereas, by the notification of the Government of India, in the Ministry of Railways (Railway Board) Notification No. 3564 dated 12.09.2024 published in the Gazette of India Ordinary Part-II, Section 3, Sub section (ii), (hereinafter referred to as said notification) under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (herein after referred to as said act), the Central Government declared its intention to acquire the land specified in the schedule annexed to the said notification for execution of Special Railway Project, namely IB Flyover New Rail Line Project (09km) in Jharsuguda district of Odisha.

And whereas the substance of the 20A notification under sub-section (1), under sub section (4) of section: 20A of the said act was published in the daily newspapers Utkal Mail Rourkela, Times of India Bhubaneswar, Kalinga Samachar Rourkela and Aaroop Jharsuguda on dated: on 22.09.2024 respectively. Whereas no objections were received in the stipulated period from the land losers to the Competent Authority and whereas, in pursuance of sub- section (1) of Section 20E of the said Act, the Competent Authority has submitted his report to the Central {{^{{FOOTNOTE 3 }}}} [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण

Government. Now, therefore, upon receipt of the said report of the Competent Authority, and in exercise of the powers conferred by sub-section (1) of the Section 20(E) of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto should be acquired for the aforesaid purpose, and further in pursuance of sub-section (2) of Section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central Government free from all Encumbrances.

Brief description of the land to be acquired, with or without structure, for the Special Railway project, namely,

IB Flyover New Rail Line Project (09km) (for Jharsuguda District) in the State of Odisha.
