का.आ. 493(अ).—यतः, के न्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का .आ . 1667(अ(, दिनांक 26.05.2020 द्वारा पंजाब राज्य में राष्ट्रीय राजमार्ग संख्या-64 (नया एनएच–54) के किमी 10.820 से किमी 38.220 )जोधपुर रोमाना-मंडी डबवाली ( तक का खंड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ) जिसे इसके पश्चात् 'प्राधिकरण' कहा जाए (को सौंपा है;

अतः, अब, के न्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क

)दरों का अवधारण एवं संग्रहण (नियम , 2008, )जिसे इसके पश्चात "नियम'' कहा जाए(, के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पंजाब राज्य में राष्ट्रीय राजमार्ग संख्या-54 (नया (के जोधपुर रोमाना -मंडी डबवाली खंड के डिज़ाइन किमी 0 . 000 से किमी 27 . 400 तक के सड़क खंड की निवल लंबाई 23 . 133 किमी ) चार या अधिक लेन के खंड के प्रयोग हेतु (तथा 1 . 34 किमी ) जिनकी लंबाई 0 . 134 किमी है (लंबाई की समकक्ष संरचना ) जिनकी लम्बाई 60 मीटर से अधिक है (के लिए यांत्रिक वाहनों पर सारणी 1 के स्तम्भ ) 2 (में विर्निर्दष्ट दरों पर और बाईपास, जिनकी लंबाई 4.

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] आधार दर के डेढ़ गुणा पर शुल्क उद्ग्रहीत करती है एवं प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात :-

1. नीचे उद्ग्रहीत एवं संग्रहीत शुल्क, निम्नलिखित शुल्क प्लाजा पर, ऐसे शुल्क प्लाजा के लिए विर्निर्दष्ट सड़क की निवल लंबाई हेतु शोध्य और संदेय होगा, अर्थात;

2. उपयु र्क्त के अतिरिक्त, 10 करोड़ रुपये या उससे अधिक लागत के बाइपास के उपयोग के लिए निम्नलिखित शुल्क प्लाजाओं पर निवल बाइपास लंबाई के लिए निम्नलिखित शुल्क भी शोध्य और संदेय होगा:

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित संरचनाओं, जिनकी लंबाई 60 मीटर से अधिक है , के उपयोग के लिए ऐसी संरचनाओं की लंबाई को समकरण गुणक से गुणा करके राजमार्ग की समकक्ष लंबाई में परिर्वर्तत करते हुए , निम्नलिखित शुल्क प्लाज़ा पर,

4. विभिन्न प्रकार की यातायात गतिविधियों जिनके लिए तय की गई वास्तविक दूरी के आधार पर उपयोगकर्ता शुल्क निम्नानुसार लिया जाएगा:

शुल्क प्लाजा पर एकत्र किया जाएगा 5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

* बशते कि उपयोगकर्ता वापसी यात्रा करते समय समान प्रवेश और निकास शुल्क प्लाजा का उपयोग करे। 6. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग में प्रवेश कराने के लिए शुल्क संग्रहण एजेंसी को उपयु र्क्त नियमावली के नियम 10 के उप नियम 1 ए में उल्लिखित शुल्क के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।

7. वैध सक्रिय फास्टैग वाले वाहनों को पहुँच-नियंत्रित राजमार्ग पर अनुमति दी जाएगी। जिन वाहनों में वैध सक्रिय फास्टैग नहीं है, गैर-फास्टैग वाहन, कम बैलेंस, ब्लैकलिस्टेड फास्टैग आदि हैं, उनसे उस श्रेणी के लिए देय शुल्क के दो गुना के बराबर शुल्क लिया जाएगा।

8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छू ट -प्राप्त वाहनों की श्रेणी , र्सर्वस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियमावली में विर्निर्दष्ट परिभाषाओं के अनुसार होंगी।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा। 10. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और कटौतियों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंडों की पूरी कर ली गई लम्बाई के आधार पर की जायेगी और उसमें उक्त नियमावली के नियम 5 के अनुसार र्वार्षक तौर पर संशोधन किया जाएगा तथा उसे, तदनुसार, अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाशित किया जाएगा।7 [भाग II—खण्ड ³(ii)] भारत का राजपत्र : असाधारण 11. परियोजना की अनुमानित पू ंजीगत लागत 789.26 करोड़ रुपए है। पू ंजी लागत में परिवर्तन हो सकता है क्योंकि भूमि अर्जन, जन -न बदलनेउपयोगिता सेवाओं का स्था , पेड़ों की कटाई आदि जैसे क्रियाकलाप अभी पूरे किए जाने हैं और अंतिम पू ंजीगत लागत अलग से अधिसूचित की जाएगी। प्राधिकरण द्वारा वसूल किए गए प्रयोक्ता शुल्क के जरिए पू ंजीगत लागत की वसूली का रिकॉर्ड रखा जाएगा।

NOTIFICATION

New Delhi, the 24th January, 2025

S.O. 493(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways S.O. 1667(E ) dated 26 05.2020 issued under Section 11 of the National Highways Authority of IndiaAct,1988 (68of 1988) ,the Central Government has entrusted the stretch from kilometer 10.820 to kilometer 38.220 (Jodhpur Romana-Mandi Dabwali) of National Highway no. 64 (New NH-54) in the state of Punjab to the National Highways Authority of India (hereinafter referred to as the "Authority");

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length of 23.133 km [for use of four or more lane section] and for equivalent structure length (having length more than 60m) of 1.34km (having length of 0.134km) and at one and one half times the base rate for bypasses having length of 4.133 km costing rupees ten crore or more on the type of vehicles specified in column (1) of the Table 1 below of Jodhpur Romana-Mandi Dabwali section from design kilometer 0.000 to kilometer 27.400 of National Highway number 54 (new) in the State of Punjab and authorises the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

1. The fee to be levied and collected hereunder shall be due and payable at the Fee Plaza for net road length specified for such Fee Plaza(s) namely:-

* For traffic exiting at Km 13+680(LHS), the fee shall be levied from starting of stretch i.e Km 0+000 **User Fee from/to km 0.000 to/from km 18.500 shall be levied at Main Fee plaza (Km 18.500)

*User Fee shall be collected at subsequent Exit toll booth

2. In addition to above, the following fee shall also be due and payable for the use of bypass costing Rs. 10 Cr. or more at the following Fee Plaza for net bypass length specified for such Fee Plaza:-

* User Fee from/to km 0.000 to/from km 18.500 shall be levied at Main Fee plaza (Km 18.500)

^ User Fee shall be collected at subsequent Exit toll booth

4. The various types of traffic movements for which the user fee will be charged on the basis of actual distances travelled is as under:

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:-

* Provided that the user uses the same entry and exit fee plazas while performing the return journey.

6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. Vehicles with valid functional FAStag will be allowed on the access-controlled highway. A fee equal to two times of the fee payable to that category will be levied from the vehicles who are not having valid functional FAStag, non- FAStag vehicles, low balance, Blacklisted FAStag etc.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.

9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.

10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.

11. The estimated capital cost of the project is Rs. 789.26 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realised.
