आदेश

नई दिल्ली, 30 जनवरी, 2025

का.आ. 529(अ).—भारतीय मानक ब्यूरो अधिनियम, 2016 (2016 का 11) की धारा 16 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा एयर कू लर और एयर फ़िल्टर (गुणवत्ता नियंत्रण) आदेश, 2023 के अधिक्रमण में, ऐसे अधिक्रमण से पहले किए गए या किए जाने के लिए छोड़े गए कायों के सिवाय, कें द्र सरकार का, भारतीय मानक ब्यूरो से परामर्श करने के बाद यह मत है कि यह जनहित में आवश्यक अथवा हितकर है, अत: एतद्वारा निम्नलिखित आदेश करती है, नामत:-

1. संक्षिप्त शीर्षक और प्रारंभ - (1) इस आदेश को एयर कू लर और एयर फ़िल्टर (गुणवत्ता नियंत्रण) आदेश, 2025 कहा जाएगा।

(2) यह आधिकारिक राजपत्र में इसके प्रकाशन की तारीख से लागू होगा।

2. मानक चिह्न का अनिवार्य प्रयोग – तालिका के कॉलम (2) में विर्निर्दष्ट वस्तुएं या सामान तालिका के कॉलम (3) में उल्लिखित तदनुरूपी भारतीय मानक के अनुरूप होंगे तथा उन पर भारतीय मानक ब्यूरो (अनुपालन मूल्यांकन) विनियम, 2018 की अनुसूची-II के स्कीम-I के अनुसार ब्यूरो के लाइसेंस के तहत मानक चिह्न लगा होगा।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बशते कि सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, 2006 (2006 का 27) के तहत परिभाषित लघु उद्यम और सूक्ष्म उद्यम, तालिका के क्रमशः कॉलम (6) और (7) के तहत संबंधित प्रविष्टि में र्निर्दष्ट तिथि से ऐसे भारतीय मानकों का अनुपालन करेंगे:

बशते कि इस आदेश में से कु छ भी निर्यात की जाने वाली स्वदेश में विनिर्र्मत वस्तुओं या सामान पर लागू नहीं होगा।

बशते यह भी कि इस आदेश की कोई भी बात, कें द्र सरकार के सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय के "उद्यम पोर्टल" पर पंजीकृ त किसी उद्यम द्वारा घरेलू स्तर पर विनिर्र्मत उन वस्तुओं या सामानों पर लागू नहीं होगी, जिनमें मूल लागत पर संयंत्र और मशीनरी या उपकरण में निवेश पच्चीस लाख रुपए से अधिक नहीं है और पिछले वित्त वर्ष का टर्नओवर दो करोड़ रुपए से अधिक नहीं है और जिसे चार्टर्ड अकाउं टेंट द्वारा प्रमाणित किया गया हो।

बशते यह भी कि इस आदेश की कोई भी बात एयर कू लर और एयर फिल्टर के विनिर्माताओं द्वारा अनुसंधान और विकास के प्रयोजन के लिए प्रतिवर्ष आयातित दो सौ वस्तुओं या सामानों पर लागू नहीं होगी, तथा साथ ही यह शर्त होगी कि ऐसी आयातित वस्तुओं और सामानों को वाणिज्यिक रूप से बेचा नहीं जाएगा और उन्हें स्क्रै प के रूप में निपटाया जाएगा तथा विनिर्माता ऐसे माल या वस्तुओं का वर्षवार रिकॉर्ड रखेंगे और कें द्र सरकार को प्रस्तुत करेंगे।

बशते यह भी कि इस आदेश में से कु छ भी, संगत सामानों या वस्तुओं के लिए ब्यूरो द्वारा प्रमाणित विनिर्माता या विनिर्माता जिसने प्रमाणन के लिए ब्यूरो को आवेदन किया है, द्वारा इस आदेश के प्रारंभ की तारीख से पहले घरेलू रूप से विनिर्र्मत या आयातित सामानों या वस्तुओं पर लागू नहीं होगा तथा ऐसे विनिर्माता को ऐसे घोषित स्टॉक को 31 अक्टूबर, 2025 तक बेचने या प्रर्दर्शत करने या बेचने का प्रस्ताव करने की अनुमति होगी, जो इस शर्त के अध्यधीन है कि ऐसे विनिर्माता ने ब्यूरो को इस आशय की घोषणा की हो।

3. प्रमाणन और प्रवर्तन प्राधिकरण – ब्यूरो तालिका के कॉलम (2) में विर्निर्दष्ट वस्तुओं या सामानों के लिए प्रमाणन और प्रवर्तन प्राधिकरण होगा।

4. उल्लंघन के लिए पेनल्टी – इस आदेश के प्रावधानों का उल्लंघन करने वाले व्यक्ति को भारतीय मानक ब्यूरो अधिनियम, 2016 के प्रावधानों के तहत दंडित किया जाएगा।

ORDER

New Delhi, the 30th January, 2025

S.O. 529(E).— In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Air Cooler and Air Filters (Quality Control) Order, 2023, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order, namely:-

1. Short title and commencement.- (1) This Order may be called the Air Cooler and Air Filters (Quality Control) Order, 2025.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. Conformity to Standard and Compulsory use of Standard Mark.- Goods or articles specified in column (2) of the Table shall conform to the corresponding Indian Standard mentioned in column (3) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018:

Provided that the small enterprise and micro enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively:

Provided further that nothing in this Order shall apply to goods or articles manufactured domestically for export:

Provided also that nothing in this Order shall apply to goods or articles manufactured domestically by an enterprise, registered under "Udyam Portal" of the Central Government in the Ministry of Micro, Small and Medium Enterprises, wherein the investment in plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not exceed two crore rupees for the previous financial year as certified by a Chartered Accountant:

Provided also that nothing in this Order shall apply for two hundred numbers of goods or articles imported for the purpose of research and development by manufacturers of Air Cooler and Air Filters per year with the condition that such imported goods and articles shall not be sold commercially and shall be disposed of as a scrap and the manufacturer shall maintain a year-wise record of such goods or articles and furnish to the Central Government:

Provided also that nothing in this Order shall apply to goods or articles domestically manufactured or imported before the date of commencement of this Order by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification for the relevant goods and articles and such manufacturer shall be permitted to sell or display or offer to sell such declared stock up to the 31st October, 2025 subject to the condition that such manufacturer shall made a declaration to this effect to the Bureau.

3. Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for the goods or articles specified in column (2) of the Table.

4. Penalty for Contravention.- Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.

TABLE

Note.-For the purposes of this Table, the latest version of Indian Standards including the amendments thereof, as notified by the Bureau of Indian Standards from time to time shall apply.
