का.आ. 5664(अ).— जबकि रेल मंत्रालय में भारत सरकार की अधिसूचना द्वारा (भारत के राजपत्र में प्रकाशित, अधिसूचना संख्या, 188(ई) दिनांक 11-12-2024 के तहत) असाधारण पी II धारा 3 उपधारा (II) (यहां के बाद में उक्त अधिसूचना के रूप में संर्दर्भत) रेलवे अधिनियम 1989 (1989 का 24) की धारा 20 ए की उपधारा (I) के तहत (यहां के बाद उक्त अधिनियम के रूप में संर्दर्भत) कें द्र सरकार ने विशेष रेलवे परियोजना, अर्थात् गुजरात राज्य में कच्छ जिला में मु ंद्रा पोर्ट और भुज परियोजना (10.69 किमी) की ओर सीधे प्रवेश के लिए गांधीधाम आदिपुर में नई ब्रोड गेज बाईपास लाइन वाई कनेक्शन को भूमि अधिग्रहण परियोजना के निष्पादन के लिये आवश्यक है, ऐसी भूमि के अर्जन करने के आशय की घोषणा करती है।
और, जबकि, उक्त अधिसूचना का सार दैनिक स्थानीय समाचार पत्र "कच्छ उदय " (गुजराती), " राजस्थान पत्रिका (हिंदी) & "टाइम्स ऑफ इंडिया "(अंग्रेजी ), 24 दिसंबर, 2024 में उक्त अधिनियम की धारा 20 ए की उपधारा (4) के तहत प्रकाशित किया गया था, और जबकि, आपत्तियां प्राप्त हो गई हैं और सक्षम प्राधिकारी द्वारा अस्वीकृ त कर दी गई हैं;
और, जबकि. उक्त अधिनियम की धारा 20 ई की उपधारा (एक) के अनुसरण में, सक्षम प्राधिकारी ने कें द्र सरकार की अपनी रिपोर्ट प्रस्तुत की है;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अब, इसलिए, सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने पर, और उक्त अधिनियम की धारा 20 ई की उप-धारा (एक) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्र सरकार अब यह घोषणा करती है कि अनुसूची में र्निर्दष्ट भूमि उपरोक्त उद्देश्य के लिए अधिग्रहण की जाएगी;
और आगे, उक्त अधिनियम की धारा 20 ई की उपधारा (2) के अनुसरण में, कें द्र सरकार अब यह घोषणा करती है कि आधिकारिक राजपत्र में इस अधिसूचना के प्रकाशन पर, उक्त अनुसूची में र्निर्दष्ट भूमि सभी बंधनों से मुक्त पूरी तरह से कें द्र सरकार के अधिकार में होगी।अनुसूची

NOTIFICATION
Mumbai, the 8th December, 2025
S.O. 5664(E).— whereas, by the notification of the Government of India, in the Ministry of Railways (Railway Board), number, S.O. 188(E), dated the 11th December, 2024 published in Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (ii), dated the 11th January, 2023 and issued under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government, declared its intention to acquire the land specified in the Schedule annexed to the said notification for the Purpose of execution, maintenance, management and operation of the Special Railway Project namely, New Broad Gauge Bypass Line Y Connection at Gandhidham Adipur for direct entry towards Mundra Port and Bhuj Project (10.69 Km) in Kutch District in the State of Gujarat, hereby declares its intention to acquire such land:
And, whereas, the substance of the said notification was published in the daily newspapers namely the "Kutch Uday" (Gujarati), "Times of India" (English), & "Rajasthan Patrika" (Hindi) dated 24th December, 2024 under sub-section (4) of section 20A of the said Act;
And, whereas, nil objections were received and same have been considered and disallowed by the Competent Authority and accordingly orders have been passed;
And, whereas, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;
Now, therefore, upon receipt of the said report of the competent authority, and in exercise of the powers conferred by sub-section (1) of section 20E of the Said Act, the Central Government hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose;
And, further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
