का.आ. 5686(अ).—यत:, कें द्र सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना का.आ 2818 (अ) दिनांक 21 जून 2022 द्वारा बिहार सरकार को राष्ट्रीय राजमार्ग-227 एफ का खंड सुपुर्द किया है;
अतः अब, राष्ट्रीय राजमार्ग शुल्क (दर अवधारण एवं संग्रहण) नियम 2008 के नियम 3 (जिसे इसके बाद "नियम" कहा जाए) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कें द्र सरकार एतद्द्वारा बिहार राज्य में एनएच-227 एफ के चोरमा - बैरगनिया खंड के डिजाइन किमी 0+000 से किमी 34+566 तक पेव्ड शोल्डर वाले दो लेन के उपयोग के लिए नीचे दी गई सारणी 1 के कॉलम (1) में विर्निर्दष्ट वाहनों के प्रकार पर 24.972 किमी की निवल सड़क लंबाई [सारणी -2 ] और 1.340 किमी (0.134 किमी की लंबाई [सारणी-4]) समतुल्य संरचना लंबाई (60 मीटर से अधिक लंबाई वाली) के लिए सारणी 1 के कॉलम (2) में विर्निर्दष्ट आधार दर का 60% की दर से और दस करोड़ रुपये या उससे अधिक लागत वाले 9.46 किमी [सारणी-3] लंबाई वाले बाईपास के लिए आधार दर का 90% की दर से शुल्क उद्ग्रहीत करती है एवं भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को अपने अधिकारियों या किसी संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने के लिए प्राधिकृ त करती है, अर्थात:-

1. इसके अंतर्गत उद्ग्रहीत और संग्रहीत शुल्क, ऐसे शुल्क प्लाजाओं के अंतर्गत विर्निर्दष्ट निवल सड़क की दूरी हेतु शुल्क प्लाजाओं में देय और संदेय होगी, अर्थात:-

2. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाजा पर 10 करोड़ रुपये या उससे अधिक लागत वाले बाईपास के उपयोग के लिए निम्नलिखित शुल्क भी देय और संदेय होगा, जो ऐसे शुल्क प्लाजा के लिए विर्निर्दष्ट निवल बाईपास लंबाई के लिए होगा:-

3. उपयु र्क्त के अतिरिक्त, निम्नलिखित शुल्क प्लाजा पर 60 मीटर से अधिक लंबाई वाली निम्नलिखित संरचनाओं के उपयोग के लिए संरचनाओं की लंबाई को 10 के समतुल्य कारक से गुणा करके राजमार्ग की समतुल्य लंबाई में परिर्वर्तत करके निम्नलिखित शुल्क भी देय और संदेय होगा :-

4. गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृ त यांत्रिक वाहन के स्वामी और पथकर प्लाजा से बीस किलोमीटर तक की दूरी के भीतर निवास करने वाले व्यक्ति के लिए मासिक पास की दर वर्ष 2025-26 के लिए 340/-रूपए (तीन सौ चालीस रूपए मात्र) है और उक्त नियमों के प्रावधानों के अनुसार प्रतिवर्ष संशोधन के लिए अध्यधीन है।
5. राजमार्ग खंड पर एकाधिक यात्राओं के लिए, निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात: -

6. जिस जिले में शुल्क प्लाजा स्थित है, वहां पंजीकृ त वाणिज्यिक वाहन (राष्ट्रीय परमिट के तहत चलने वाले वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित दर का 50% होगा, बशते ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई र्सर्वस रोड या वैकल्पिक सड़क उपलब्ध न हो।
7. संबंधित श्रेणी के वाहनों के लिए विर्निर्दष्ट अनुज्ञेय भार से अधिक भार लदे यांत्रिक वाहन का चालक या स्वामी या प्रभारी व्यक्ति, राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए टोल संग्रहण एजेंसी को ऐसी श्रेणी के वाहनों के प्रवेश के लिए, कथित नियमों के नियम 10 के उप-नियम 1ए में विर्निर्दष्ट शुल्क के समतुल्य शुल्क का भुगतान करने के लिए उत्तरदायी होगा और वह राजमार्ग खंड का प्रयोग करने के लिए तब तक हकदार नहीं होगा जब तक ऐसे यांत्रिक वाहन से लदा अतिभार हटाया नहीं जाता।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 8. सभी परिभाषाएं, यांत्रिक वाहनों की श्रेणी, इनके अनुज्ञेय भार, छू ट प्राप्त वाहनों की श्रेणी, र्सर्वस रोड, वैकल्पिक सड़क इत्यादि उक्त नियमों में विर्निर्दष्ट परिभाषाओं के अनुरूप होंगी।
9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रर्दर्शत किया जाएगा।
ंजीगत लागत ₹648.37 करोड़ रुपये है। चू ंकि, भूमि अधिग्रहण, उपयोगिता ंजीगत लागत परिवर्तन के ंजीगत लागत का भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा 10. उपयु र्क्त सारणी – 1 में यथा उल्लिखित आधार वर्ष 2007-2008 के लिए प्रति कि.मी .शुल्क की आधार दर के आधार पर यांत्रिक वाहनों से शुल्क की वास्तविक राशि और छू टों की गणना भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खंड की पूरी हो गई लंबाई के आधार पर की जाएगी और उसे उक्त नियमों के नियम 5 के अनुसार प्रतिवर्ष संशोधित किया जाएगा तथा तदनुसार उसे अँग्रेजी और क्षेत्रीय भाषा के कम से कम एक–एक समाचार पत्र में प्रकाशित किया जाएगा। 11. इस परियोजना की अनुमानित पू स्थानांतरण, पेड़ों को काटने, इत्यादि कार्यकलापों को अभी पूरा किया जाना है, इसलिए, पू अध्यधीन है। प्राप्त प्रयोक्ता शुल्क के माध्यम से वसूल की गई पू रिकार्ड रखा जाएगा।

NOTIFICATION
New Delhi, the 9th December, 2025
S.O. 5686(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2818(E) dated 21.06.2022 issued under Section 5 of the National Highways Act 1956 (48 of 1956), the Central Government has entrusted the stretch of NH-227F to the state Government of Bihar.
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at 60% of the base rate specified in column (2) of the Table 1 for net road section length of 24.972 km [Table-2] and for equivalent structure length (having length more than 60m) of 1.340 km (having length of 0.134 km [Table-4]) and at 90% of the rate specified in Column (2) of the Table 1 for bypasses having length of 9.46 kms [Table-3] costing rupees ten crore or more on the type of type of vehicles specified in column (1) of the Table 1 below for the use of 2 lane with paved shoulder of Chorma - Bairgania section of NH-227F from design Km 0+000 to Km. 34+566 in the State of Bihar and authorises the National Highway Authority of India to collect, either through its officials or through a contractor, the said fee, namely:-

3. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Fee Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10: -

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs 340.00 (Three Hundred and Forty Rupees Only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules.
5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules.
9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules.
10. Based on the base rate of fee per kilometer for the base year 2007-08 asmentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the National Highway Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language.
11. The estimated capital cost of the project is Rupees 648.37 Cr. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed. The National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realised.
